Boiler....i need some help i know you are very very much familiar of the law.this is for one of my mate he is from pakistan stayed in UK for 4 years for study purposes,he got a police caution 3 years ago for false representation,thats the only thing he have in his police record,he never been to court or prision.police constable gve him caution on police station.as i can see that false representation comes in (CIMT).just to clear that thats the only thing is in his police record..he has applied for the IR1 visa.what are the chances?do you think he will be in trouble or caution is ok.please need your opinion.....thanks in advance

afarooq..wel they just asked basic question how long you know each other?how did you met?who arranged your wedding?how many people were present?show the pictures?asked my wife to show your us passport?asked her are you relative?and also he focused on us domicile just to clear for you that my wife is here with me from last 3 years so specially he focused on domicile but we have already arranged job letter for my wife and accomodation letter for both of us from usa ,one of our family frnd have resturant there and he mailed us job letter and accomodation letter and my wife showed it to CO than he said thats fine no problem....but at the end its common AP in pakistan so we are suffering...if you need any kind of help or information,you are most welcome to ask...btw when is your hubbys interview?

I was planning to go with him but there r folks that r telling me not to go with him.

afarooq101..wel i dont understand why you are trying to hide that you are not in pakistan basically its a good sign that you are here and this will help to get visa,but one thing i don not understand that if you or your husband tried to lie with CO than forget about the visa because they have all your entry and exit record and they know that where you are now,so be gentle and tell the reality other wise we male in pakistan are waiting in AP from years so think about this long AP before trying to hide anything...

dear Thanksgiving answer me every time. i want to ask you during your AP what you learn .may be you travel out side the country that's why they put you in long AP.because i and my wife really do,t have idea after interview these things happens.if i informe before i must make plane to ask them passport back.CO didt lett me he put me in AP he just ask me my passport and tell me every thing is ok. i was thinking may be with in some days i will get back my passport with visa bcz they give me one paper indicate visa express courier service . but later on i Google these thins and realize that this is ###### system .i abusing my wife also she do,t have any knowledge about these things..now she is going to force me to stay at least 2 or 3 months .other wise i must ask CO . if you are issue me visa now ok if not give me my passport back i go back and going business again.now dear friend i am trying to involve my self in social activities.

they didt ask you to give them fresh medical and fresh DS 230 form now bcz you already 11 months . you must ask your wife to contact in USA any official, i can check in my case line category got 10 people under AP last month June they issue 3 visa in my case no line.i realize only CO officer satisfied then he can issue you visa other offical can not like DOS. or senetore

there is no need to say thanks ali as iam also in the same boat and i been and still going through this pain full process.ali brother what i learnt is that never leave yor job,business or other life activities because of AP,because to me its like a gambling as every gambler has its day so you have to carry on what ever you are doing never wait for this unpredictable process,ali as i adviced you in early posts that dont just wait for it carry on what ever you are doing,as i done that stupid mistake of waiting and my uk visa was expired and what ever i saved its about to finish as you know everything is expensive here in pakistan and my wife is also here with me.the first 6 months of AP was like prison i was just thinking about visa and visa and than i felt that my brain is hurting and health is going down so its best to wait thats what iam doing.my wife contacted embassy senator and white house but they all have same standard answer your case is pending in AP embassy will contact your husband upon completion so iam hope less and help less from every side.i think travel history is also big red flag as i also stayed in uk for few years and just returned before interview so in my personal opinion that they have to check everything where ever you traveled or stayed so like they have to do back ground check where ever you lived.see brother ali its not your wifes fault its not in her hand if you read posts on this site you find that no one knows about AP even me and my wife.basically its responsibility of uscis to inform every one all the steps and about ap aswel but they have no time.they havent contacted me yet i think they will soon ask me for the fresh medical and pcc and ds 230 just to keep in the office for expiration,and yes my passport is also with them...

ali2971...bro its really hard to tell that how long this AP will take its really pain and depressing.when they work on your case than its get updated or if you send them email,than they update your case,..wel regarding that how many time they update and make decision its really hard to predict i seen some cases updated like 5 to 6 times and visa issued and some are just updated regularly but no out come,this is my 11th month in AP at the end of interview co said that you get visa in 3 to 6 months but still in AP and my case was updated like more than 40 times but still in AP.so just prey from ALLAH for the best,no one is helping us or tellinh us just be positive and keep your faith strong and positive....

Aoun..if you are lucky and luck is with you than you will will be approved but if not AP is common doesnt matter where ever you lived.i lived in UK for 8 years even with my usc wife but its 11th month iam still in AP,so for my side it doesnt worked.in my personal opinion i think if you lived some where else AP takes too longer than normal but once again its my personal opinion..wel wish you best of luck..

I can't really answer for what the embassy in Pakistan requires. An ACPO certificate will not list the charge, dates, etc if the caution had expired or been "expunged" from the general records. There is still a record that is not routinely divulged on the ACPO certificate. London doesn't want to hear the applicant's retelling of the story without some actual documentation from the law's side. Normally a court record would be required, but cautions skip a court date. A subject access report reveals the details of the "hidden from most" charge. So if you have nothing but your memory of the incident, it might be good to get some documentation of it. No LIVE trace on ACPO means there is more.

West Midlands Police are hardly immigration specialists so may not be the advice to take. Before ACPO centralized records around 2007/8, the local station did police certificates. Maybe they are just thinking an ACPO certificate is the only way to go now.

Again I don't know Pakistan procedures. If it was London, the criminal charges would have been discussed and documented at the interview or the applicant would have been told as the OP experienced. London AP means all the basics are done and approved, but security checks more related to terrorism are being done, not local cautions for juvenile crimes. In Pakistan they may think the words "no live trace" in the UK means all is fine and the record is spotless. Lucky you.

Nich-Nach. thanks for your time to reply me with precious information,on my ACPO police certificate its clearly mention "caution",but at the time of interview in pakistan embassy the CO asked me that what is this caution for?i explained him all the scenario and than he consulted with the senior immigration officer about that "caution",then he said ok have you got any other caution or warning or trouble with the police i replied no that is every thing mentioned on this ACPO certificate.after that he carried on further with other question,at the end of interview he gave me 221g denial for further ADMINISTRATIVE PROCESSING(common in pakistan with no time limit goes upto 7 years)its been 10 month in AP but so far they never asked for everything when ever i call them or email them the answer is its in AP,we will contact you when your AP is complete.

the reason i am asking you because they might ask for the detail of that caution,so i wanted to get it from police as iam in pakistan now but when i contacted the west midland police i gave them all the information that by law i can get my subject access than they asked my why do you need it,i replied i have caution on my police certificate i need to keep it for record,if embassy may ask,than police replied you donot need subject access report for immigration purpose.i am worried now i dont know who do i need to contact?because by the law of data protection i am allowed to get my subject access report.i was about to post the form with fee from here but i have there email if embassy ask me for subject access i will forward them the email...please i need your kind advice and thanks for your precious time.

I think people don't understand that a "caution" can be given in the UK on minor crimes and settled without going to court, just to free up the courts. Accepting a caution is admitting guilt to a charge. It's still a conviction despite if a fine was assessed.

The reason I say go ahead and get paperwork--a couple from the UK filed I-129F same day as us. Our timelines stayed fairly close through the processes and we applied for citizenship within a month of each other. He had to get some paperwork from the UK on a delinquency thing from when he was 12 years old or so, even though it had never come up before. So easier to get right now while in the UK and file away with important papers in case it ever pops up again.

hello Nich-Nick,i need some help from your side please,as i have caution from west midland police in 2009 and it appears on ACRO police certificate,for a safe side i wanted the subject access report if embassy may ask for caution detail,when i contacted the west midland police through email that i need my subject access report for immigration purpose as i have caution on my police certificate,they replied me that you dont need subject access report for immigration purpose the acro police certificate is enogh,as my case is in AP in pakistan,i just wanted to keep it for a safe side.please help me in this situation what should i do?do i need to contact ACRO for subject access or do i need to get any other report to get my caution detail.waiting for kind reply...thanks

I think that would be a good idea. My husband's case has been in AP for 13 months and we have no information. No congressman's office in my state has been able to help us at all. Everytime I call DOS they tell me they think the case should be almost finised in AP, I have been hearing this for 8 months now.

SHUSS..agree with you but for that we have to be large majority to contact with news channel.iam also stuck in AP and completed 10 months in AP,no one is really helping at all started from senetor,congressman,white house and embassy they all have same standard answer pending under AP embassy will contact you upon completion of AP.but you tried to find the reason but they are not telling.so basically we are being punished in AP for nuthing.like we are in prison without any offence.

just keep your hope up and positive your husband will get visa soon,never think negative just be positive and sure.time will come for us

haboosh...nothing new from DOS always same answer from last 10 months its pending under AP and we are working on it.they never tell you the reality,if they are working than why its taking too long and last time they worked on my case was mid march so its relly useless to call them....

I added the following suggestions. Mushashi, I left the spousal bit because there are people here in other categories besides CR-1. I think you should post it on Organization of Action since you are probably more familiar with it than I am. As for the White House Website, they require 100,000 signatures in thirty days. I dont know how I feel about that. I want to be realistic. Its better to make one petition and focus all of our attention on it than creating multiple ones. Another question that I have been struggling with is that who is our decision maker (who we are appealing to?) President? Prime Minister? Richard Olson? DOS? My two cents are that we make a petition and each time any of us send out an inquiry to a senator, congressman, white house or embassy include this petition with it to raise more awareness and to show that there are other people fighting for the same cause.

Administrative processing is a term used to describe a visa application that has been set aside for further review by the embassy.

Most administrative processing cases are resolved within 60-90 days after interview in most countries. However, the majority of the applicants in the Islamabad embassy of Pakistan have been waiting for months and years to get a response. During this long waiting period, the petitioner and beneficiary go through pain and suffer, as there is no time frame, access to any information, or deadlines. The DHS - Ombudsman department oversees the process if the USCIS takes longer than the given time frame but there is nobody to oversee the Administrative Processing. The embassy fails to provide any information to the petitioner or beneficiary except for a generic response that the case is still under administrative processing. 



While the reasons of establishing such procedure is understandable, it seems inhumane and out of proportion to put people in the prison of time just because they want to travel to the United States-- mostly to be with their loved ones, to add to economic or/and intellectual growth of the nation. It is thus evident that the US government, especially in the context of this problem, is yet to realize the delicate balance between securing borders and opening doors.

Please bring some transparency in this process to expedite it. Provide a clear explanation to the candidates that are put under admin processing. Give a deadline as to when the visa will be issued along with access to more information. Help alleviate the large backlog within the FBI and other agencies handling the security and background checks to make this a fair and reasonable process.

my advice would be that best site is white house,we need to put our petition there and regarding 10,000 signature i think its not really hard to get that signature and INSHALLAH we will achieve our target less than 30 days,reason iam saying is that social media is much fast and advanced nowadays and everyone have more than 100 friends on facebook,we just have to forward it everyone who is added on facebook.if you take it as that if i have 100 than those 100 must have 100 plus so i think ALLAH is with us and please put it on white house website and pass link all vj members and they will forward it to there contacts.......please do it by the morning of monday so we can get some hope.my all the hopes are in ALLAH he is the one who gave us this path,so please dont delay it,start it with the name of ALLAH...please

we tried alot calling DOS every single day,tried to find out the reason after 6 months email to white house and we clearly asked for the reason but that was standard that your case is pending in AP.after 5 months in AP i got call from isl embassy operator asked me have you ever travelled to middle east countries he mentioned names of 3 countries as saudi arabia,iraq and afghanistan i replied no, because i never been there the only country i travelled and stayed was uk which embassy knows,then he said have u got previous expired passports i said i have 2 xpired pak passport he said mail it to us with explaination letter which i did on the same day and then after 1 week my case was updated every single day including saturdays for about a month and than no movement on my case since march.i dont know what do to.as no one is helping,iam just crying in front of allah for help,because our relation ship is genuine my wife is my second cousin and she was with me during the interview and CO asked questions from her and me togather in good mode one stage i was 100 percent sure that my visa will be issued today but its 10 months..waiting,waiting and goes on...just prey for me....

yes they can you never know.other wise its really easy to get pakistani visa without any interview or any objection.

Yes definitely we have to write to him. Its becoming hard just sitting and doing nothing. If nothing else atleast all this will give us some peace of mind that we are doing something. I also tried to find his email some while back ago but couldnt find anything. Carolyn has contacted the embassador before so she will probably have the info on contacting him via letter or so. As you said, cases have been frozen since march, so has ours I dont understand what exactly are they doing. I hope we all see progress soon.

SJ24 .yes its the time i know every one is active but we must have some one to lead and take quick action on this and make every one aware.we have to options 1)every one have to write there letter with the detail of there case 2)as mentioned by SOCCER PLAYER we have to write the letter and signed by everyone who is in AP.

in both cases we have to post letters on the same day i think posting all letter on the same day atleast it will record our protest,as MR AMBASSADOR will see all these letters and he might take some action(hope so).other thing is this we have to contact pakistani news channels and tell them our stories because media is independent and they will contact the embassy to find out the reason atleast peoples sitting in embassy might come into action...but for all these we all have to unite.for sending the letters to mr ambassador or contacting the pakistani media atleast we need 15 to 20 members minimum,iam repeating thats minimum requirement and the maximum will help much.

What are the embassy in islamabad doing if they are not working on our cases?

i think they are in pakistan and they are working like our pakistani police that if something happen today they will take the action on that after few years.so i think they are just enjoying the weather and food in islamabad coz no one is there to ask them....ALLAH will punish them hard beacuse they are doing wrong to us..

I received a letter from my Senator's office today. They emailed the embassy to ask why the embassy would ask for fresh documents and not issue the visa. The embassy replied that they asked for fresh documents so they could update the case file. The embassy wanted fresh documents so they could update their records.

I am very angry after reading this. They got my hopes up that we were finally going to get our visa in a short time. The embassy received our documents on April 25th and after that no work has been done on our case. So maybe that is why so many of us have sent fresh documents and haven't gotten out of AP. The embassy is updating their records.

carolynhotstuff they are just playing with us and with our fellings if they are not ready to issue the visa or if there intention is that keep the case in embassy for years and not working on it than why they are asking for the fresh documents its not free to get pcc or medical or mailing them everything they required,by doing this there intentions are clear that they are just playing with our fellings.please encourage every one that sign a letter and send it to MR RICHARD OLSON,so he must be aware that how his mission is working in islamabad,they are just wasting the precious time of our life keeping us far away from our spouses.i think they have no fellings for huminity they claim that they belive in huminity but they are just playing there politics.
