  1. Can we file K1 visa even though we've only been together for 1 1/2 year?

    Of course you can apply, it is not how long you have been together, it is that you are BOTH free to marry and that you have MET EACH OTHER within 2 years. Please look at the "Guides" section on this website and look under K1 and it will help you with what you need to apply, also look at the Example Forms. Good luck to you :thumbs:

  2. Im wondering if my fiance will need the original copy of the I129 petition and all supporting evidence when she goes for her interview and if so, how many copies? thanks for your help

    My fiance had her interview last week. The original I-129F should have been submitted with your initial application. She will need original I-134. She will also need your latest Tax Return and maybe previous years (just in case), your W2s, divorce decrees (if applicable), updated letter of intent to marry, proof of ongoing relationship, employment letter, some paystubs/paychecks, NOA2, your birth certifica, cenomar. I hope this helps.

    Funny thing is that they only thing they asked from my fiance was the I-134 and Tax Return. Good luck to you :thumbs:

  3. I would like to have some information on Police Certificate required at the time of interview. I haven't received my NOA2 yet, but trying to gather some information beforehand.

    Foreign police certificates: Applicants who have resided in any other country for one year or more after the age of 16 may also be required to submit police certificates for these countries. Applicants may check the visa reciprocity table on the website: www.travel.state.gov regarding obtaining such certificates. U.S. police certificates are not required for applicants who have lived in the U.S.A. Non-Indian immigrant visa applicants residing in India should obtain police certificates from the district police station serving their area of residence."

    I have found the above information on US Embassy, New Delhi website in "INFORMATION FOR K1 (Fiancé) VISA APPLICANTS (PACKET 3)". After my previous marriage, I stayed in Oman for 13 years. Just before our separation I was on employment visa. When I got separated from my ex-husband, I resigned from my job & returned to India. So my employment visa automatically got cancelled. And I never went back to Oman after October 2007. I am staying in India for past 5.5 years now. In this case, is it mandatory for me to get Foreign Police Certificate from Oman?

    Hi, this is from the official US Government website. I have attached the link, just click on the country in question and scroll down to Police Certificate section and it will tell you how to go about getting it or if it is not available. If it is not available, then print it out in its entirety where it states that as proof for your interview. I hope this helps. Good luck. :thumbs:

  4. Hello everyone,

    I have my MNL case number already.My petition papers for K1 visa has already been sent to the US embassy too.

    I am so worried about on thing.We have an immigration lawyer, and she told us that my fiance needs to revisit me

    and be with me at my interview to get a better chance of being approved.me and my fiance have talked about this already

    and we both agreed that he don't revisit anymore since we're saving money for our new house.Our lawyer told us that

    we won't be getting a refund just in case I get disapproved as my fiance told her at the start that he had plans of coming back.

    Is she right about it?By the way, my fiance arrived August 3,2011 and left May 3, 2012 (he stayed here for 9 months)

    Hi, I would like to share our experience. My fiance had her interview on March 25, 2013 and she was approved. I ONLY was able to visit her 1 time and it was just for 1 week. There have been many couples who were only able to meet their fiance one time and not nearly as long as your fiance was with you. You guys are the exception, that someone can stay for 9 months. At my fiance's interview (which I was not able to attend), everything went well. My fiance told me that they just asked for our I-134 and Tax Return and only talked to my fiance about her working abroad. It was very informal and no questions were asked about me. She told me that they said they could tell how much she loved me.

    What I'm trying to say is that it is not necessary for your fiance to visit you again. Good luck and please keep us posted. :thumbs:

  5. Hey...October CSC filer here. Here's the thing: I used an attorney for petition. I know...bad move. I joined this great group in February, and have learned so much. I contacted my attorney, and mentioned the letter of intent. He said we didn't need one due to the other evidence we already have. I know now that I will probably get an RFE, so I've had my fiance sign one and send it to me. My question is, should I send hers and mine now? Or, should I wait until I get the RFE?

    I would wait and see if you get an RFE, and if you do send it in at that time. I would also go over your entire package that was initially sent it. If your lawyer doesn't even know that Letter Of Intent is a requirement, it makes me wonder what else they forgot. If you do get an RFE, I would have long talk with your lawyer about getting some of your funds back because of his/her incompetence. Good luck :thumbs:

    im on the process of preparing our necessary forms for the petition. now as this is being prepared i looked forward to preparing the photos that i will be showing to the us embassy for my interview. is it fine to have all photos in a scrap book making it as thick as 2 inches book? im worried they might refuse to take it because its so big/thick. Do you have the best advice on how to prepare the photos to show proof of bona fide on going relationship? please help... :)

    My fiance just had her interview and had a big scrapbook full of our pictures and it was at least 2 inches thick. It was very flexible, something she thought about if they needed to put it through the window. If it is too big, I have heard that they will just ask you to open it up and show them a few pictures. I wouldn't worry about it, as long as you have it, you should be ok. They did not even ask to look at my fiance's photo scrapbook. Good luck to you. :thumbs:

MY 1ST QUESTION IS, DO I HAVE TO SEND IN AN AFFIDAVIT OF SUPPORT BEFORE MY FIANCE GOES IN FOR HIS INTERVIEW OR IS THAT DONE AFTER WE ARE MARRIED IF WE GET APPROVED @ CSC AND HIS INTERVIEW GOES WELL? MY SECOND QUESTION IS, DO I FILL OUT THE I-134 FORM OR THE 1-864, I-864A, OR I-864EZ? WHICH FORM DO I FILL OUT AND WHICH FORM DOES MY SPONSOR FILL OUT?

    I AM STILL WAITING FOR CSC TO APPROVE OR DENY MY APPLICATION, BUT I WOULD LIKE TO HAVE THINGS READY IF THINGS WORK OUT IN MY FAVOR. I GUESS I CAN GET THINGS IN ORDER AS I SIT AND WAIT. I DID NOT KEEP A COPY OF ANYTHING THAT I SENT IN LAST YEAR ALONG WITH MY APPLICATION, SO NOW I HAVE TO PREPARE THEM NOW.

    Hi, you need to fill out the I-134 and also send your Tax Returns, W2s, recent paystubs (3 or 4) and employment Letter. Good luck :thumbs:

  8. Thank you everyone for all of the nice messages. My fiance will post something online later, but she told me that they did not ask her any questions about me. I couldn't believe that. She said that they spoke about her working abroad and only asked for my I-134 and ITR. We had so much information and photos to provide but they were not needed.

    Correct me if I am wrong but I thought a few months back you created a thread asking members you only had one visit to Philippines and stayed at your fiancee's place for 1 week and were worried if that was going to be enough. Did you make another visit after that?

    I ask this question because I made only one visit too-- but in my case I went to the USA to see my fiancee and I spent about 10 days with her. Please do let me know if you have made an additional visit.

    You are correct. I only had one visit to my fiance. I wasn't able to make another trip, but everything went extremely well. They only asked her few questions and NONE of the questions were about me. I was only there on my visit for 7 days. You will not have any problems. Good luck to you :thumbs:
