Since Vermont is so far behind California why don't they just send some petitions to Cali. Its not fair that the January and February filers from Vermont have been waiting all these months and California is approving applications dated late March and early April. They need to balance this out.

You should state why you didn't marry in 90 days because right now everyone is assuming it is because you two just didn't follow the rules. But could it have been due to illness or hospitalization or something like that? If so then maybe just maybe you can have the 90 days extended but if its bc you guys just didn't get married within 90 days then you have to redo everything but now with a marriage visa. And the international spouse most likely will have to go back to their home country to wait the approval of the new visa. When the tell you to get married within 90 days then you MUST get married within 90 days unless there was some type of complication which meant you physically could not get married.

That is exactly what my fiance and are are going to do. When he comes to USA we are going to get married at the town court in a civil marriage then in a few months we are going to get married at the catholic church and have a reception after. My parents did the same thing over 30 years ago. I've been told it is very common. I am not exactly sure how you would file everything but I know it can be done.

Does your fiance live with his father? If so he'll have to fill out an I-864A at least that is what USCIS said to me. Since my father will be my co-sponsor and at the time of filing I am living in his home.

Bueno todo depende. Yo mira la misma cosa y vi que para mi novio y yo la visa K-1 era lo mejor. Cuando hable con USCIS me dijieron que es mas facil la visa K-1 porque solo tienes que mostrar evidencia que tu y tu novio estan en una relacion pero una con la visa de esposo tienes que mostrar evidencia que estan casados. Por ejemolo la evidencia de la visa K-1 son toda la evidencia que muestra que se han visto en los ultimo dos anos y se quieren casar 90 dias de llega a los EEUU. Mientras la visa de esposo tienes que mostrar que estas casado por ejemplo que han vivido juntos, que tienen una cuenta de ahorros en el nombre de los dos y mucho mas asi. Entonces todo depende pero tambien la visa K-1 dicen que es mas rapido para tenerlo. Tienes que ver bien pero cuando yo hable con USCIS me dijieron que si no estoy casada con mi novio todavia que no lo hago y debo obtener una visa K-1. Espero que esto ayuda.

I haven't received an RFE yet, but I do remember someone here saying they received an RFE because he/she wrote "N/A" where he or she should have written "None". It sounds trivial, but. . . . it's worth making the distinction if failing to do so results in an RFE...

This is where this thread is going to confuse many. Getting an RFE for lack of evidence to prove you have met in the past two years almost always is due to a lack of primary evidence. Supplying more, or many photos (secondary evidence) will usually not overcome the burden of proof.
This has been borne out time and again by USCIS decisions whereby they have found mostly in favor of primary evidence and rejected secondary evidence such as photos when submitted as sole proof.
Primary evidence is documentary in nature: airline boarding passes, passport exit/entry stamps, hotel receipts, atm withdrawals in city of question, utility bills, apartment leases, etc.
Secondary evidence The USCIS defines secondary evidence as any documentation that can be used to supplement primary evidence but in itself cannot stand alone to prove ones assertions.
Photos are secondary; so are letters from relatives, neighbors or acquaintances, bus/train tickets and essentially anything that cannot be used to prove your point with a very high degree of certainty.
To sum up; very good Primary evidence with some secondary evidence = NO RFE
very weak Primary evidence with some, or lots of secondary= Possible RFE
No Primary evidence..........................................................= RFE
No Primary, lots of secondary.............................................= RFE

My 'tip' is concerning final divorce papers and may be just for UK couples as I am not sure what the documents look like other countries....but in the UK the 'Decree Absolute' is not very impressive and the document title is in small words at the bottom of the page!!! We were RFE'd because they said we didn't send it, and we did....so when we sent it for the 2nd time, we highlighted the words 'Decree Absolute' on the photocopy and were approved 2 weeks later!
I really don't think they knew what the document was....hope this helps
