An update on this issue for anyone else that has this problem. Apparently, this mistake has happened a few times over the years for international students with my sister in laws university. The international student coordinator said it was an easy fix. All that panic for nothing!
 

As long as the error is a USCIS error you can work. She must provide the current card to the place of employment, keep copies of the card, then send the original EAD in for correction to the issuing center with an explanation letter and proof the error was the fault of USCIS. No fees are needed. They will simply reissue the card. Even if we had not caught this now, it could have been corrected when she applied for OPT (though it may cause a delay at that time). Anyways, hopefully this information can help someone down the line. 
 

edit: Additionally, the typographical error form is not the correct form, despite the automated system directing us to use it. We must mail the physical card and letter in to the issuing center.

She would need to apply again for CPT and wait until she receives that. It's going to take like 5 months. 

 

No! She should NOT work at all. This EAD card does NOT work and she can get into serious trouble. It can be fraud.

 

Please understand,

 

(1) CPT or OPT is supposed to be on something related to what she is studying. She cannot get any job.

 

(2) The time she is working on CPT is going to be discounted from OPT. So if she works 6 months now, she will have 6 months less once she graduates if she wants to use OPT. 

 

(3) She is supposed to have money to pay for her studies, so work should not be necessary.  

 

I think it's better if she finds more work on campus. That is not going to be deducted from OPT and she doesn't need to do any paperwork or has the risk to get into trouble.

 

Thank you for your reply. We did fill out the forms correctly, write the letters, and submit evidence of economic hardship. All these forms had to be approved first by her international student coordinator (and so he also has copies). This is completely a USCIS error which makes it so frustrating. She has tried to get more work on campus, but so many places are closed because of COVID or only available to work study students etc.

Any idea on infopass or a number where we can actually speak with an agent? The number included with the card simply had an automated message and they hung up. 

Mistaken Code on EAD

Hello, I hope I am posting in the correct forum.

My sister in law is here on an F-1 visa and applied for an EAD card based on Severe Economic Hardship, C3iii.  If it matters, we filled out the forms with the correct code. It was approved, and she received her card last July 2021. In the meantime she found an on campus job and started working, so did not need to use her EAD card. Now, December 2021, she accepted an off campus job and is supposed to start working on Friday. Her international student coordinator just emailed her today stating that there was a mistake on her EAD card and it was issued for C03B or post completion OPT. 

Questions- how do we correct this error? The typographical error form did not work on either of our computers. Can we do infopass? Can she still start working on Friday as she has already completed all of her pre-hire paperwork? 

Additionally, can someone provide us with a phone number that we can actually speak to an agent?

My husband just filed for my sister in law. So... 10+ years to go, right? She's currently here on a student visa, expecting to have to go home when she finishes college. 

You might need to try some tough love. The situation is draining for you, but it's also not healthy for your mother. You could start by helping her sign up for some English as a Second Language classes at a local community college, many of them offer them at little or no cost. That would get her out, meeting people in similar situations to her own. I would also gradually start giving her more responsibility for things- be "busy" all the time. She's gotten into this routine, but a little at a time you need to take your life back. Good luck!

My interview is on 6/05.  Is there a parking structure nearby, for the interview I mean?  Thanks in advance.

We got to the interview location 45 minutes early and looked for parking everywhere, and ended up parking several blocks away in a structure and barely made it on time. I will message you the parking structure’s address, hopefully it won’t be so busy downtown for you. 

I never received my oath letter, online in the documents tab or in the mail. Since the interviewing officer told me my ceremony would be May 15 (this Tuesday) I called the number yesterday, punched in the secret code to get a live person and they ended up faxing me the letter for the ceremony. So, Tuesday is the big day!

Thank you! I received the email notice that the oath has been scheduled, but nothing was uploaded onto the website  the interviewing officer said it’s probably going to be May 15 though! Just waiting for the official letter now  

Passed the interview! The officer didn’t ask to see any documents I brought. Now just waiting for a letter with the oath date. This process has gone very smoothly! 

Hello, 

We are unable to locate one of our two children’s birth certificates, and the naturalization interview is Thursday. We have one of them, but just moved and everything is still in boxes. I can get another, but it’s a three hour drive with a baby in the car so it’s not ideal. We have plenty of other evidence, but is children’s birth certificate required or just recommend as evidence? Thank you 

Thank you! I have had my green card for 5 years through marriage. So I think the 5 year rule? 

Just got an update that our interview was scheduled for April 26th at 10:50! Can someone update me, I’m on my phone for the next week. 

Just got an email that, "There are no updates at this time." :/ 

Estimated completion date just jumped from January 2019 to March 2019. Is it common for them to change like that? How accurate are these dates, anyone know? Thanks!

Is there a trick to seeing everything in the online account? We applied yesterday, everything went through perfectly, but when we log into the MyAccount we only see this despite trying on different computers/phone:

Thanks! We are worried that he would have to give up his Japanese citizenship to naturalize, which he does not want to do.

This is a last minute decision to apply on my MIL and FIL part, and there a little confusion about their eligibility. My MIL is born in China, but my FIL is born in Japan (so would be eligible). This paragraph is a little confusing for us (quoted from the instructions):

If you were not born in an eligible country, there are two other ways you might be able to qualify.  Was your spouse born in a country whose natives are eligible? If yes, you can claim your spouse’s country of birth – provided that both you and your spouse are named on the selected entry, are found eligible and issued diversity visas, and enter the United States simultaneously.

My FIL does not have a high school diploma, though my MIL does, and is a nurse. Would she be able to apply for the DV lottery, using my FIL country of birth (Japan) even though he isn't able to enter because of his education? Thank you. 

Yeah, part of the problem was that my husband's green card was still valid at the time, but would be expiring within 6 months (which is when you're required to file the I-90). Apparently since banks are so heavily regulated they kept citing regulations requiring the I-90, no matter how much info we provided them from USCIS. It was ridiculous.

jgalt, hope you get smarter lenders than we had! Hopefully you are in a big enough city that you can deal face-to-face with a lender, rather than through email and phone calls. Talking to someone face-to-face would have been really helpful.

Bank of America gave us a really tough time actually, they kept insisting we provide an I-90 even though we explained that we were filing I-751 and the I-90 wasn't the correct form. Was a huge mess and took weeks to resolve because it had to approved by higher-ups. Good luck!
