    1.  Only a US citizen can petition a parent.

    2.  MIL cannot enter the US as a visitor with the intent to stay and adjust status.  That is fraud.

    3.  If your wife is a US citizen, she can start the consular process at any time by filing an I-130 to petition her mother.

@Crazy Cat I see. I was trying to understand what it meant on the USCIS website when adjusting the status if we plan to petition my mother in law. Is there anything else that needs to be filled aside from I-130?

OK my Mum did not need a visa but if she did and was applying now.

She worked until retirement age, which in the UK is now 67, I do not know what the retirement age is in PI.

She had a State Pension and a Work Pension, my Dad did not like travelling but she did so was always off somewhere.

The big issue for her last trip was Travel Insurance, by then 2 weeks Travel Insurance was the same cost as the flight! Hopefully your MIL does not have any medical conditions.

They had a house they had lived in since 1959, like I said my Dad did not travel, and if the situation had come up a lot of reasons to go back, biggest one was Medical I guess.

I see @Boiler . That’s good your mom has ties to the UK. Well, I did not mention this before but my wife is pregnant. Is it a valid reason my Mother in law is coming over to take care of my wife?

Not many people can afford to retire at 60 nowadays, having a good pension will help.

Since you brought up 'pension', what are the best examples to show ties with the Philippines @Boiler ?

Again, I think it will be likely that she’s seen as an immigrant risk.

It’s your $185 to try your luck though.

What are the best examples to show ties with the Philippines @SalishSea ?

Yes, it will be a negative.   B visas are judged on the applicant’s ties to their home country, and a job is a reason to return.

Can we not say she’s unemployed? Because she’s a senior citizen, so technically she is retired. @SalishSea

She fills out the DS160 and then goes to the interview. she can bring documents showing her ties to the Philippines but the CO does not have to look at them.
When I went for my B1/B2 visa I was only asked questions. Didn’t show any documentation.

She needs to show strong ties to home.  Being unemployed is a negative.  They don't look at documents during the interview, as 100% of the info needed to make a decision is contained in the DS-160.

You might be better off having your wife sponsor her when she becomes a citizen.

Thank you for the information @SalishSea! What do you mean by “unemployed is negative”? Will it be a negative impact on her application?

  7. Hello everyone! My wife and I are planning to bring my mother-in-law here in the US from the Philippines using a tourist visa. I was going through their website and my question is what supporting documents does she need to present during the interview so that she has a higher chance of getting approved. She is 60 years old and unemployed. Thank you!

  8. She doesn't need to renew her card (form I-90), she needs to file for removal of conditions (form I-751) before her conditional card expires. See the I-751 instructions here: http://www.uscis.gov/sites/default/files/files/form/i-751instr.pdf

Also refer to the I-751 guide here:

    http://www.visajourney.com/content/751guide

We already filed for I-751 and we received the receipt notice of action. I just can't inquire her receipt because of the said error that I am getting.

Another question: how long will it take for her to receive the biometrics letter/appointment?

  9. Hello Everyone!

So I tried to inquire my wife's case status both over the phone and online and they are giving me an error saying that the case or receipt number that I entered is not available at this time. I tried to get hold of a representative from the US Customs and Immigration Services (USCIS) over the phone and they wont direct me to anyone.

The reason why I wanted to inquire about the case is that my wife's permanent resident card is expiring this month and I was just wondering if extending her Conditional Resident Status is the same as renewing her card. If not, what is the process of renewing her card? This year is her second anniversary here in the US.

    Thank you!

    Kenneth

  10. Yes, it is a Consular Report of Birth Abroad. If she qualifies as a US citizen through birth by virtue of your brother being a citizen she must obtain this. Then she applies for a US passport. If she is eligible for US citizenship she will not be issued a visa as no visa is needed for a US citizen to travel to the US.

If the child was born out of wedlock, is there anything the mother needs to do during this process? Do we need to obtain information from her for this process?

  11. Click this link and see if his daughter qualifies for CRBA and would be an automatic USC.

    http://www.travel.state.gov/law/citizenship/citizenship_5199.html

Now, if you think his daughter is... then here's a link on how to file Consular Report of Birth Abroad (CRBA)

    http://www.travel.state.gov/law/citizenship/citizenship_5199.html

    Good luck!

The CRBA has to be filed abroad? In our case in the Philippines?
