  1. I think as much as I'd like to say, yes, it will happen, I'm preparing for mid to late June.

    My birthday is in early May and man would that be a great present, (F) but emotionally, I need to think June.

    I'm an actress and a producer so I'm dumping all my energy into saving money, creating, building my company, hobbies etc.

    Put your energy where it can be the most productive. You can't make the process go faster, but you can find a better you, work on something you love, or create.

    Thank u for the adivce :) And I am truly jealous of everybody who is able to work and keep themselves busy during this process. It's the best thing u could possibly do. Unfortunately I don't have the energy anymore but I guess there will be better times. Just gotta think positive... I hope and pray for everyone that their petition will get approved asap.

  2. Completely ramdom, I know... but I am very curious as to how other people do it. For me is a first time. I am madly in love with my boyfriend (soon to be husband) who lives in another country. I never thought I would be the one to do a long distance relationship. NEVER in my wildest dreams I thought I could... but true love takes us to different places, and makes us do things we thought we never could.

    It is, without a doubt, the hardest thing I have ever had to do, but we are soooooo worth it. We have our ups and our downs, but most importantly we are always there for each other. I just wonder, how other people do it? how do you deal with the distance? Just curious...

    Of course we're trying to talk as often as possible and see each other on Skype every day.

    It's been hard for the both of us but I'm trying to tell myself that everything will be over soon and that every day that goes by is a day closer to him and the kids... Always trying to be positive and stay focused.

  3. I just dont understand why people are so worried about their NOA2 or processing time.. I see it like this.. it will come when it comes, as far as customer service, of course thats what their going to tell you because you havent met the 5 mon. line. so your still going to be in the pending period. people need to learn to be patient. its gonna be 4 mon on the 16 april, i havent called them, maybe in the beg. of this process, but ive learned its NOT gonna come in 2 mon time or 3 mon. time. it TAKES time to come. so why stress about it... BE PATIENT :thumbs:

    Some people have a lot of patience, some don't. Me, myself... I'm not a patient person at all... I've definitely learned to be MORE patient but I totally agree with unlockingsky. I am suffering, my fiance is suffering and my kids are suffering. We've spent more money on travelling than on anything else. But most importantly I will miss valuable time with my family.

  4. While I agree to your statement about them being low on manpower and taking into account the seriousness of immigration law and national security, I cannot help but to laugh after reading an ad in local classified newspaper.

    E2: For $80,000 to $150,000 depending on business plan and State Processing time: 2-3 months (visa in hand)

    E1: $50,000 to $100,000 depending upon trading plan Processing time: 2-3 Months (visa in hand)

    EB-5: $500,000 investment in Government approved project. Processing time up to 3 months. Yes, this one gets you a Green card as well. (More sugar you add, sweeter it gets).

    All these categories are also shown on USCIS website chart for processing time.

    Moral of the story: When money talks, everyone else just listens.

    Then there is no worry about national security and immigration laws. You give them what they want and you can have what you want. No need to wait for 6-7 months for them just to adjudicate your petition.wacko.gif All the long wait and AP is for common people like us, not for the rich ones who can buy their way out.

    What CAN'T u do with money nowadays? ... Sad but true.

  5. While browsing and reading the forums I remember a senior member saying that once USCIS actually adjudicates your petition, it only takes few hours to 3 days. The long wait which kills us is the time taken for the petition to reach adjudicator's desk.

    So I will agree with tweety on this one point. Get more people, assign them different categories. Just like adding more RAM to a computer or getting a dual core processor with ability to handle more processes at a time. That should help to reduce backlogs and in the long run everyone will have less waiting and separation time. Not saying they should give priority to recent filers but one backlog leads to another.

    Only the U.S. Citizens or legal permanent residents are eligible to file a petition for fiance/fiancee, spouse or relatives. I believe all of you pay your state and federal taxes. Do you still deserve to be treated this way and be forced to undergo the long painful separation? Don't mark one person as selfish. He or she only talked about a flaw in the system and proposed a suggestion to improve it. Nothing wrong with that. Just because we cannot do anything about a flawed system does not mean we start bashing the one who pointed out that flaw. Remember, opinions are like a.. holes and everyone has one. Cheers!

    I hope one day USCIS gets more people in order to process the applications faster or deal with the backlog. Plus the long waiting time causes a lot of people a lot of problems...

  6. If there are back logs of files uscis should have persons personally to deal with that. The files they recieve recent should not have to wait until they have finish with there back logs because this is messing with the timeline for persons. It is unfair to file my petition and my five or six months has past and i have to wait on uscis to finish with there back logs before they can deal with the recents filers.......Something needs to be done about this. This is very bad service......persons wants to be with their love ones.....this is foolishness :angry::angry::angry::angry::angry::angry::angry::angry::angry:

    I agree with everyone that said that USCIS is doing their best to process all the applications as fast as possible, no doubt ! On the other hand I understand teweety&irv. We turnt in our application beginning of February and even though we've "only" been waiting for 2 months, I sometimes feel like I wanna choke everyone that works for USCIS lol. Being far far away from ur significant other is super tough ... We have kids involved which makes it even harder for me. It literally breaks my heart seeing them grow up without me (even though it is just a couple months being away from them but especially the little one is growing up sooo fast) and them struggling ... And come one people, I think everyone has/had those times wondering why in the heck USCIS is takin so long and why other applications are being processed faster than others.

    Some of us have to wait longer than others, yes that is completely true but honestly ... That doesn't make my situation (or everyones else' situation)

    easier. U might just feel a little better knowing that other people are going through the same.

    Well in the end we will all have to go through it and obviously it is for a very good reason. Keep ya head up and everything will be over sooner or later. Always make the best out of every situation. Stay focused and positive, have faith in god and URSELF and good will happen.

  7. No, it is not discretionary. It is the VWP policy that a person is no longer eligible to use the VWP if they previously failed to comply with its regulations. See here: http://travel.state.gov/visa/temp/without/without_1990.html#national It says (last bullet point) that a person requires a visa to travel to the US if the person "Has been refused admission to the United States before, or did not comply with the conditions of previous VWP admissions (90 days or less stay for tourism or business, etc.)."

    If you had a tourist visa, then a one day overstay would not make you ineligible automatically to revisit. In that case admittance would be discretionary. But you do not have a visa, you travelled on the VWP and did not comply with its requirements so you are no longer eligible to use it. Don't confuse your situation with someone who has a tourist visa.

    Oh Lord ... All of that because of 1 day ...

    But thank u very much. Helped me a lot. I guess I have to wait till I have the K1 visa ...

  8. How did you answer the ESTA question about previous overstays ? If you fudged the esta answers you will still be turned away, they know you overstayed and are no longer able to enter on VWP. If you don't believe it try.

    Thought the ESTA was valid for 2 years?

    And I never said I didn't believe it, I'm just asking and making sure.

  9. They denied me due to lack of ties to Canada, I had never been asked before and didn't have anything on me for ties to Canada. Also they were trying to say that I was working and living illegally in the us.

    I have never been in the us longer than 2 or 3 months at a time, another problem in their eyes was that my daughter was born in the us...

    So because of my daughter being an American citizen, they considered me to be an immigration risk... I explained to the CBP that I have been visiting on and off for almost 4 years and now there's a problem.???

    The second time I tried to cross they asked me to provide all my

    Roof of ties to Canada, I felt as though I had more than enough proof of ties to Canada, but they felt like still I was an immigration risk since they denied me the first time now I'm an even greater immigration risk....

    I just don't want to do that again. The first time they held me and my daughter for 4 hours and refused to let me give her a snack.

    Ugh sometimes I feel like the IO's make their decisions based on their mood... Luckily they have never asked me to provide any ties to my home country (I wouldn't even have any) but I'm in the same situation as u. Won't see my fiance until I have the visa :/

  10. So here's my new situation:

    Since I have an overstay of 1 day, I don't really wanna take the risk of being denied at the airport and be taken back to Germany immediately.

    My fiance (US citizen) then tried to get his leave approved and visit me in May. Unfortunately he can't take leave to travel INTERNATIONALLY.

    I'm now thinkin about going back for a couple of weeks. I know I can be denied entry due to my overstay and I'm still not sure whether to take the risk or not. Maybe some people can tell me about their experience. I think it would help me a lot and make my decision (whatever it may be) easier.

  11. Thanks so much everyone! And I'm so jealous that you can see your fiancé while the k1 is being processed. I have been denied at the border 2times and don't feel like going through that again with a 2year old!!

    I'm trying to cover all bases with our proof of ongoing relationship and hope I have more than enough even if they don't ask for it!!!

    If u don't mind me asking: What was the reason u were denied?

    I can only imagine what it's like with a 2 year old ...

  12. It will pick up again. statisically the service centers receive the fewest number of submitted petitions in the months of December and January. They will most likely move through adjudication of these petitions at a faster rate than the previous months and then as visa journey members update their timelines it should all even out. I'm still hoping that I might get lucky with a late April approval. I'm feeling May is the month for January filers however.

    It seems like they've been working pretty fast, especially VSC. I'm a February filer and I'm HOPING to get mine approved in May!
