  1. My wife and I married in 2007 and I'm just now submitting the I-130 package. Is this going to cause me problems?

    The reason we waited so long is: First I was moving around and wanted to wait until my residence was settled. Then, she got pregnant and we thought it would be better for her to be with her family so they could take care of her during the pregnancy. Her family are well off and have a nice home. I was living in an area in which I didn't know anybody and I lived 90 minutes from my work, and we thought it would not be good for her to be alone (while I was at work) and pregnant in the USA. Then, after she had the baby, we were in the same situation. Finally, I started making arrangements for me to move close to my family, so that when they got here, we would have a family support system in place. And that is where I'm at now.

    I have traveled to the Philippines once a year for a 2-week visit. We were married in the Philippines and I was there when my daughter was born and was there for both of her birthdays (she just turned 3).

    We have a lot of photos of us together during my 2-week trips, which I'll be sending some of those with the I-130. Also, I have copies of phone bills, Skype logs, and emails. We have some letters, but we didn't write that often, because we talked on the phone or Skyped every night.

    So, is that fact that we've been married almost 6 years going to cause us trouble? Should I submit a spousal affidavitt of bona fide marrage and affidavitts from third parties as well?

I've read that some embassies are "appointment post" and some are "standard," and as far as I can tell the difference is that for "standard" you have to submit all of your supporting documents with the DS-230, whereas for "appointment post" you do not submit with the DS-230, rather, you bring them to the interview. I have not been able to determine whether the embassy in Manila is "standard" or "appointment post." Does anyone know?

    Also, I've read that you cannot have the DS-230 completed before your case goes to NVC, because you have to submit the DS-230 that NVC sends you, because it has a barcode on it. But, I've also read some posts which imply that the barcode is on a coversheet, which means you can attach it to a pre-completed DS-230. Can anyone clarify this?

  3. I am a US citizen and my spouse is a Filipina. We married in the Philippines and had a daughter after our marriage. Do I need to submit things such as copies of emails, letters, Skype logs, etc., with the I-130 package? Our daughter will serve as proof of our bona fide marriage. Also, my wife will be bringing the following to interview: photo album showing pictures of us together during all of my trips to the Philippines; Western Union receipts showing that I have been supporting her; a few love letters, a few emails.

    From what I read, it seems like the secondary proof of relationship is needed for the interview, but does not need to be submitted with the I-130.

  4. Only US notaries are accepted in the US. I doubt there are US notaries everywhere in Manila/Makita. Since posting my questions, I've discoved that that by law, the US embassy has to provide US notary service to non-US citizens. However, that doesn't solve my problem of making the appointment.

  5. Can my spouse get her signature notarized at the US Embassy in Manila? I am a US citizen and she is not. If she can use the Notary Service, do I put her passport number or mine when making the online appointment? Note that a passport number MUST be provided. Being that she isn't a US Citizen, I doubt they'd be interested in her passport number. But If I use mine and she shows up (without me), will they see her?

Do I, the petioner, mail the DS 230 along with the I-130 or does my spouse mail the DS 230 after she's received the package from the NVC ( after the I-130 has been approved), or does my spouse just take the completed DS 230 with her to the interview at the US embassy in Manila? Also, if the answer is that I should mail the DS 230 along with the I-130, do I send the fees for both the I-130 and DS 230 together?

    Yes, you still need evidence of a bonafide relationship because, even though it sounds crude, a baby is proof you were together one night, not that you have a genuine relationship. Show your phone bills, some letters/ emails... maybe you send gifts by post and can prove that somehow? Boarding passes from when you visited, photos together?

    We have lots of photos. Also, I send her money via Western Union every month and she has the receipts.

  8. you need an exit permit for the child before leaving the phils. but if your child has a Phil. passport too then exit permit is not needed anymore. Aside from that your child is fine...no need for vaccination record at the immigration. But just tell your wife to bring her vaccination record from the hospital where he got his vaccinations.Because if your child will soon study here they will ask what vaccines he already got. And its just easy for you guys to show that to the doctor here in the US so they will know what vaccines are missing.

    When we entered US,my son has a Phil. and US passport.So no need for exit permit. Just show my sons US and Phil passport at the immigration and hes fine.Then when we arrived at US airport just show my childs US passport at the immigration officer.(dont show the phil passport anymore).
