  1. Regarding the question "Is the child immigrating with you?" on the DS-260:

    My wife, the beneficiary/applicant, is in the Philippines with our daughter. I am completing the DS-260 for my wife.

    We already have the CRBA and US passport for our daughter, therefore she is considered a US Citizen. Therefore I don't think she would be considered to be "immigrating." Therefore, I think the answer to the question "is the child immigrating with you?" would be "No". Correct?

  2. Here is what I'm submitting for my IV supporting documents package (my wife is the beneficiary/applicant):

    Cover Sheet with bar code

    Cover Letter listing contents

    2 passport photographs of my wife

    Copy of the biographical data page of my wife's passport

    Certified copy of my wife's birth certificate (from NSO)

    Certified copy of marriage certificate for my wife and I (from NSO)

    Original NBI Clearance for my wife (green copy)

    A photocopy of the birth and marriage certificate listed above

    Is that everything I need?

    Note: My wife does not have any prior marriages; she has never been outside of the Philippines; and we have a daughter.

  3. I received an email from NVC saying that I have been registered as my wife's agent. Also, it included Immigrant Visa Application Processing Fee Bill Invoice with instructions on paying the fee. However, I'm having difficulties paying the fee online. Under the section that says "IV Application Processing Fees" there isn't any information on the applicant. There is nowhere to click on to make payment.

    Question: Do I still selected "Petitioner" from the drop down menu, or "Third-Party Agent"?

  4. Yes, they email it. I'd been calling evey week to check the status and each time I asked if a case number had been assigned. They would tell me that a case number had not been assigned and to call back in 10 days. I was planning on calling again tomorrow; however, I received the emails yesterday (with the case number and other info.). NVC received my case on 01/26/2014 and I received the emails yesterday.

  5. I received 2 emails from NVC. One contained a letter addressed to me (as a PDF file) that said my next step is to pay the AOS processing fee; said my wife should submit DS-261; provided my NVC Case Number and Invoice ID Number; and instructions on paying the AOS fee. The other email contained a letter addressed to my wife (again as a PDF File) and said her immigrant visa petition is ready for further processing; provided her NVC Case Number, Invoice ID Number, and Beneficiary ID Number; provided instruction on submitting DS-261;

  6. If your spouse didn't have any income, you could claim an exemption for her by doing the following: First, get an ITIN for your spouse. Then when you file, your filing status should be "Married Filing Separately" and claim an exemption for your spouse. Per IRS Publication 501 "You can claim an exemption for you spouse only if your spouse has no gross income, is not filing a return, and was not a dependent of another person." I have been married for 6 years (my wife lives overseas) and have done this every year. For every year except this past year, the IRS has denied the exemption at first. But then I call them and tell them to check Publication 501 under "Married Filing Separately" and they grant it. This past year I attached a copy of the pertinent page from Publication 501 and highlighted the relevant paragraph and attached a note asking them to read the paragraph before denying the exemption, to my tax return. And the granted it first time. Originally I went to H&R Block, but their software wouldn't allow it. So I started using TurboTax, and it's software will ask you "Does Your Spouse Have any Gross Income?, Is our spouse filing a return?' Can someone else claim your spouse as a dependent?" And if you answer correctly it gives you the exemption. But you won't be able to e-file.
