i have a friend who filed for AOS last october 2016. He went to biometrics and submitted them.  he and his wife separated they currenlty live separated for a couple of months now. he asked me to find out if his wife files for divorce can he be deported since removal of conditions was not completed? he said he can prove that the divorce as valid and no fraud the marriage just failed and they grew apart.  his aos extension expires on october 2017.

please assist so that i can give him some direction

is it just fomr ds160 and pay the fees then provide the evidence?

just an update on how this turned out.

we talked to the supervisor at the asc center. he was a very nice man. we explained the situation. we had the passport, state of illinois ids, and appointmetn letter. he was able to verify the docuemnts and let wife and kids take fingerprints. we were about to mail in the replacement for greencard and spend another 1500 bucks. this man helped us glad he was able to let them take their fingerprints. its worht a try talk to supervisor at the asc and tell them incase this happens to you

a friend of mine asked me this quesiton so im posting to get him some answers.

he sponsored a forigner. and go approved for 129f applicaiton.

she was approved for her greencard and they divorced due to irreconsilable differences.

he is a us citiziane and has met someone else. is there a ban on sponsroing his second wife? is that even possible ?

we lost the conditional greencard and could not take fingerprints for 751.

what are our options?

do we have ot file replacement for conditional greencard and wait till it arrives. this is very trajic situation.

should i reprint a new one and sign everything with a new date or just fill in the old returned application?

he filed separately and it was returned because i did not answer section 3. i left it blank. it asked

my spouse is deceased

my marriage was entered in good fatih but hte marriage was terminated

my parent entered the marriage in good faith and i was battered

the temrinat of my status and removal from the united stated would result in extrem hardship

i called uscis and found the right fees.

child that is 12 years = 505

child that is 15 = 590

ok wifes petition was approved she received noa1 so her 590 were accepted by uscis.

do i just send the 85 dollars for biometrics for each child?

dependetn child 1= 85

dependent child 2= 85

ok i think i finally understood the filing fees... i send 590 for each child. in reality i just needed to send in each dependent childs application separate along with their 85 biometric fee.

2 money orders for 85 instead of 590 for each child?

kid 1 = 09/04/2014

your i 751 is being returned as the dependent child became a conditional resident:

before the alien parent became a conditional resident therefore the dependent child must submit a separate petition with fees.

what does this mean?

wife received her approval but her kids received this returned noticed along with the money orders for 590 each.

im guessing they want 2 separate applications for both kids. but what evidende is needed to be submitted for these 2 applications?

thanks for your help. I am filing for divorce next week. she can take care of her immigration issues on her own. I just wanted to find out what the consequences of filing for divorce during roc.

so after divorce is processed she can present the divorce decree and still remain in usa without being deported.

if i file for divorce during removal of conditions will they loose their greencard status? the petition was submitted on 09/06/2016. if if file for the divorce this month will they be deported. the realtionship has hit ireconcilable differences but i want to be fair since there are kids involved and its not their fault

the full amount will be gathered on sept 15. the removal expires on sept 24. would it be ok if it goes out the door on sept 15?

removal of conditions expires sept 24 of this year. still short on the money to cover it.

what will happen if its filed after sept 24 2016?
