you can certainly get married on VWP (and go back to file immigration visa), but if the intention is to use VWP to come and get married and adjust, then it's visa fraud.

OP,
I recently took Darnell's advice and started the DCF process. I can tell you that if you follow the links provided, the websites literally lay out every step of the process. The forms are provided via editable PDF that you can print out after completing. You can go to the Consulate website to set up your first appointment to turn in the I-130. When I signed up for mine it was only about a 2 week wait, I am in Suzhou, so I use the Guangzhou consulate, might be different in Beijing. That is just to turn in the first form. Darnell's timeline is accurate, and the websites even give you approximate wait times for each stage. Check it out and good luck!

Well, we don't know for sure what the OP's status is in China. He may have residency there. All we can do is show him the option(s) available to him and he will have to decide which is the most appropriate.
my apology, it appears that he does have residency status in china. He is able to file DCF for a much faster process.

The OP is already married. They are no longer eligible for a K1 Fiancee Visa.
As Ryan H pointed out, DCF is possible at the US Embassy in Beijing: http://www.uscis.gov/about-us/find-uscis-office/international-offices/china-uscis-beijing-field-office and at the US Consulate in Guangzhou: http://guangzhou.usembassy-china.org.cn/cis.html One of those offices should be contacted for specific information and requirements.

altho DCF is possible, i highly doubt the OP have anything other than a tourist visa for china, if that's the case, he is not eligible for DCF.

just want to update you guys.
I sent in couple affidavits from friends, some more updated bank statements, letter from my parents regarding our housing situation, letter from myself regarding the lack of some of the requested items, a letter from our doctor regarding the pregnancy.
We finally got a reply over the weekend, and her ROC is finally approved, just waiting for her green card to arrive in the mail now.

Okay, after searching about wire transfer money from China to US, I came across this old thread...
So my fiance is planning to wire me about $10,000 to purchase the rings and some other things for the wedding here in the US, because we are planning to have a wedding ceremony in Bali next year, probably before the K1 is approved.
I was just wondering if this would be a good evidence in the future, or would it be any harm to my case.

I don't think it would help op at this point, it would look like op is trying to salvage some evidences for rfe list.
Will and medical power attorney might help though.
Op best bet is to explain everything on a letter. An interview is not the bad if they are legit.
I am going to get the will and medical power attorney and plus the doctor's note regarding my wife's pregnancy.
I will also attach a letter explaining the lack of some of those evidences.
At this point, i'd rather they schedule us for interview (but hopefully not during when my wife will be delivering the baby)

Do either of you have jobs or benefits or insurance? If so, you should have information about who is covered and who benefits from payouts etc.
Did you include your tax returns?
tax return was included, and the RFE did not ask for tax return.
We have joint healthcare insurance.

We filed in feb.
Wife doesn't have a driver license, so her name is not on he auto insurance. I got her credit card in her own name to build credit, so we do not share a credit card.

Hi guys,
After waiting for over 6 month for the i-751, we finally got RFE today in the mail.
In the RFE, it's asking for evidence for good faith marriage.
I have sent in the below items, can anyone else think of more evidence to send with the RFE?
1. Joint bank account statement spanning over 1 year period
2. Joint Health Insurance
3. Wedding Pictures and other pictures of out life together
We are living with my parents (their house), so we do not have rental agreement to show. Can we have my parents sign affirmative confirming that we live with them?
As we do not own a house, so we don't have a house loan, and I have a car loan, but that was only in my name.
Because we live with my parents, we do not have utility bills with our name on them.
In the RFE it also said we could provide "legible copies of the civilly registered birth certificate for any child(ren) born to you and the petitioning spouse"
We don't have any children yet, but the wife is pregnant due in Nov. Can we use some sort of doctor's note saying she is pregnant?

Aaron, also, would you happen to know that if my brother is under the immigration process, can he still apply for non-immigrant visa and visit us during Chinese new year and then return back to China when his school starts? I remember I saw it somwhere that if he is under the process of immigranting to the US, he cannot apply for a non-immigrant visa to visit. is it true? I can't seem to find the same article online anymore. Thanks!
He can certainly apply for tourist visa while his immigrant visa is being processed, but it's very unlikely that his tourist visa will be approved.

Our petition finally made it to the consulate in China. The concern I have is when we go to the CEAC website to check the status it does not show up under the non-immigrant status page. If we go to the immigrant status page it shows up. Is this the correct categorization? Or should it get moved over to non-immigrant.

even though K1 is technically non-immigrant visa, but it's categorized as immigrant visa at the consulate.

You do not have to visit the embassy. Apply for a F visa.
You pay a little more but you can use some of the online companies if you are in a hurry.
why F visa, not L?

To meet the exemption for an international marriage broker the company needs to offer comparable rates and services to people regardless of nationality, gender, etc... If you can show that the company meets that via their terms of service agreement, I would think that would cover the exemption.
We had the same RFE with Okcupid. I don't have the website address for the specific letter, but if you search for Okcupid RFE K1 visa you should eventually find a discussion in which someone posted the letter they sent in. You can edit it for your purposes and send it it. That's what we did.

You can use any number of visa agent service. You mail out your application to them, and you take your application in on your behalf. (for a fee)
just google chinese visa agency.
