    From my knowledge, pretrial diversion program ends the case before it makes it to the judge. You should hire an attorney and let him know you aren't a citizen and the consequences of a conviction. He can negotiate with the DA to waive the admission of guilt if it's a requirement for entry into the pretrial diverison and you can always say you were misunderstood that's why you were arrested. With that, there would be no problem. Hope this helps you.

    ciaobella80, I'm in the boat with you. I was involved in an arguement with my wife and she called and accused me I pulled her hair which got me arrested. The DA didn't press no charge and I did obtain a certified letter from the DA saying no charges were filed and a certified letter from the court showing my arrest. You were very brave to travel overseas. I'm dying every single minute of the day regretting even arguing and what my interview would be like when I file for N400. I refuse to travel overseas until I naturalize. I realized you said you slapped your wife or something. That alone is enough for the DA to put you on probation and you need to quit saying that. If you admit that during your interview, you might have problem. You need to come up a way to explain the incident incase they ask you that's why it won't be a bad investment hiring an attorney. Also make sure those documents are certified. During your return back to the country, did they fingerprint you? Did they send you for a secondary inspection? Did they ask you questions concerning the arrest? To be honest, go consult with an immigration attorney even if you don't hire them and have them advice you. No mistake is worth it this last stage of the immigration process.

    Could you give further information so people could help you. You are not paying anybody and people are here to help themselves as a family. If you can't give more details then users would assume you dont really need help. Your situation isn't the worse on visajourney.     I'm very happy for you and the way the whole thing went. You have an arrest record for sure but it can be expunged. Did you have to take anger management class? I'm actually in the same situation as you are now and if you search for my posts, you would see. I was charged for domestic violence battery and it was dismissed by pretrial diversion. Me and wife took 2hrs anger management class and the DA dismissed the case, I didn't even make it before judge and was never charged. You will get your removal of condition approved for sure, don't worry. I received an email 2days ago about my approval and an immigration attorney will be helping me for my N400. Make sure you talk to one.
    Let this incident teach you a lot of lesson and I'm sure you have learned. I'm happy for you. No need to worry anymore and make sure you consult an immigration attorney.
    P.S. This don't mean no conviction for immigration, it was just an arrest and people always get arrested for the wrong reason. If no probation, deferred sentence, parole, guilty plea infront of a judge, you are good. Just consult an immigration attorney to advice you.
