  1. I would like to share my K1 Visa Experience at the US Embassy Manila even my Fiance did not meet the Federal Poverty Guidelines Last Year. He only got $13,xxx and we passed.

    3am - I woke up so early even my interview was at 7:30am. (I did that because I thought that the first to arrive will be serve first but I was wrong because you will be allowed to enter at least an hour prior to your interview.) But I did not arrive early because I looked for an open printing shop to print out the latest pay stub of my Fiance.

    5:30 am- I arrived at the Roxas Boulevard. Many people are already waiting outside the US Embassy and the Applicants with 6:30 am appointment were entering the gate. There was a drizzle that time and I'm wearing a corporate attire but actually, you don't need. (Even a casual attire is allowed at the embassy.)

    The vendors helped the applicants on what to bring inside the embassy. I gave my staple to one of them but I forgot to give my scissors. Even cologne spray and alcohol is not allowed inside. I also got a problem with the musical card that my fiance gave to me. It's allowed, however , batteries should be removed to avoid delay because it is being detected by the Xray upon entering the embassy.

    At around 6:30 am, applicants with interview time of 7:30 were asked to fall in line before entering the gate of the embassy.

    When I entered the security check, the machine alarmed. I was wondering why because, as far as I know, I removed all the prohibited things prior to entering the embassy. I was surprised because the female guard told me to remove the battery of my 2 musical cards. I thought that she wants me to throw them away. Then she told me that only the batteries must be removed because those cards were my evidences. I threw my scissors as well.

    I got number 6118.

    upon entering the building, we were asked to place the appointment letter/ confirmation to Window 39. Then afterwards, I was called again to the same window and gave all my Visa Application forms or the DS-156, DS-157, and DS-156K.

    I return to waiting area after that. About an hour when my number appeared in the Q-board for Window 43. I had my Finger Print Scan there. The women in that Window is nice. I was just asked about my name and Date of Birth.

    After more than 1 and a half hour, my number appeared again in the Q-board for Window 46. A young Filipino Consul was there that seemed in his late 20's. He was serious. I smiled at him but still, he remain serious. He asked me to Complete My DS-156, on number 37, (Status of my Relatives in the US because I only crossed-out my fiance's status). Then, he told me to write my Fiance's name and I signed the DS-156K. After that, he asked me the following questions. He also asked me about the NBI Clearance, CENOMAR, Birth Certificate and the Affidavit of Support of my Fiance.

    I was really nervous about the affidavit of support of my Fiance because last year, he only got more than $13, 000 which was below the Poverty Guidelines. He just included in the form I-134 his savings of $2000, and his car as his property with the amount of $4000. The Supporting documents were his W-2, ITR form, his latest pay stubs (6), Employment Letter (He got a new job last September 2011 and he expected to earn aroung $18,000 at the end of 2012) Bank Statements, the form of his car, and explanation letter/email why his salary was low last year.

    (I was prepared about the Co-sponsor it was not asked by the Filipino consul that's why I just present it to the American Consul.)

    When the Filipino consul saw that he had low income last year, he seemed to frown even more and he wrote it in the form. Then he asked me what's my name, my Date of Birth, My Petitioner's name, and what does he do for a living. I answered all of his questions with a smile and confidence. I told him that my fiance and I have known each other since we were young because our families are friends. He clarified if we are childhood friend but I answered him "NO" because he is older than me and there was conflict of interest when we were young until we meet again after more than 8 years. Then he browsed my DS forms and saw that I'm a nurse. "so you are a nurse". I answered him "Yes, Sir". After that, He asked me if my fiance was married before. I told him "No Sir, I'm his first, and he is my first boyfriend as well." He smiled lightly and asked if i am sure about that. I told him yes because his family says that. After that, he told me to return to my sit because he have no questions to ask anymore. He also said that he was sure that I have pictures and just show them to the American Consul.

    I was really nervous and really afraid that I might fail this interview but still, I'm excited to be interviewed by the American consul.

    9:45am - I sat again and waited for my number to be called for American Consul's Interview. After 2 hours, all applicants that were not called was asked to have their lunch. We went back at 1 pm. I waited for more than 1 hour again. at around 2:15pm, my number flashed to Window 62. I'm a bit nervous but still in my senses. The Consul I think was a Chinese-American man. He speaks in good English that can be understand easily. He told me to promise to tell the truth and I said Yes. He asked my name, My Fiance name, Date of Birth, the City where my Fiance live, how did we meet, and how did we meet again within two years. Actually, with my confidence, I also told him the information which were not asked.(hehe)He did not asked about our proof of Genuine Relationship, even our pictures because he just looked to the pictures that my Fiance sent along with the I-29f Petition. When he was finished asking, he told me to return to my sit and wait to be called to the last. Then he asked me if I'm willing to marry my fiance within 90 days in the US and with full of conviction, I told him "Yes Sir, I swear".

    I was shaking when I offered the I-134 form of the brother-in-law- of my Fiance. He saw that they are living at the same house and he accepted it. He didn't told me if I was approved or not until I was called to Window 72 and the the man in the Window told me to go home because my Visa will be delivered. I asked him if I'm already approved and he checked it on the system. He said to me Yes because my Visa was already issued and will be delivered to my address.. I'm so happy to hear that but I still don't want to be relaxed until my visa is already delivered.

    Thank You Lord for guiding us and for allowing me to pass the Interview. It's all because of you Lord. We love you.

    ** The best weapon in this interview is to be over prepared. Bring everything you can that is pertinent to your relationship even if will not be asked because it's better to be over prepared than to be under prepared.

Hello and thanks for share with us your good experience with the interview at the Embassy, I personally think the best advice that you made is to be ready and prepared bringing all the documents related to the relationship just in case they ask you for anything and show them that you were ready for any situation like that as you said it's better to be over prepared than to be under prepared.

    Yes that is what I really mean. I brought a big bag pack for that interview but they did not ask anything as a proof of our genuine relationship. The picture that my fiance submitted with the I-29f petition was enough for them. I really want to show what I have to them that time but they said already to return to my sit and I will be called again.:)

    1. you need to provide the latest income tax return which is on 2011.

    2. For Co-sponsor, my fiance only earn 13, xxx last year. He got a full time job last year Sept2012 until now and expected to earn $18,xxx-$19,xxx at the end of this year. It's still not that big. He just included an explantion letter stating why his salary is below the poverty guidelines, employment letter, and 6 latest pay stubs as a proof of current sustained income. Then, He gave me his latest bank statement of $2,000. and lastly, his car worth $4000, he included the property certificate as a proof of ownership. The CO in Manila didn't ask for a co sponsor. I just told the American Consul to please accept our co-sponsor which is his brother in law and he placed it on my file. I got approved.

    3. If you include your savings, I think, your current work will be the proof that the savings is yours or just state it in your explanation letter if you will make one.

    4. They are very particular with the financial support. Even though you will see them only glancing at it, maybe inside the window/after the applicant has been interviewed, they will review everything that they submitted. They are also asking about the current job of the USC fiance.

  5. MarMire, I apologize. I shouldn't have been so cut and dry initially speaking because of the variations. Another example of how consulates can vary is that Manila in many cases does not accept a cosponsor for K-1 visa applicants. In theory, they should because the I-134 allows for cosponsors, but Manila is very strict concerning the Affidavit of Support.

    I know that they are very strict but there are some cases that they allows it and I'm really praying that everything will be alright. :)

  6. That is correct, 125% is for I864, the required poverty level for I-134 Affidavit of Support is only 100%

    Thank you. My fiance has no dependent because he is a single and at the end of this year, his salary will exceed the required 100%. Do you think, they will acknowledge that even his salary last year is below the required poverty level and that above 100% is by the end of 2012?

  7. The possibility of you becoming a public charge may very well decrease if you are working. However, the requirement the CO will be looking at is the petitioner's ability to provide the necessary income. Only the USC or a cosponsor are eligible to meet this. If the petitioner's income meets the requirement, and supporting documents show this, there should be no problem. The I-134 is used for different types of visas. The 125% guideline comes from the I-864P form. The I-864 form is what is used when Adjusting Status after marriage. The CO looks for 125% because this is the actual level needed for a successful AOS.     Yes, I know that the I-864 is required for the immigrant visa and for AOS but for us there will be no problem with regards to the oo-sponsor because the USCIS allows it and we can ask my Fiance's immediate family and relatives. Right now, I've been thinking about my admission to the US using K1 visa because in the US Embassy Manila, it depends on the CO if they will acknowledge it. Thank you for all the information.:)

  8. Welcome. As long as the petitioner can prove that he/she makes more than the 125% guideline at the time of interview, it will be okay. The evidence as a whole needs to point to CURRENT income. It doesn't matter if the beneficiary has a job or not. The beneficiary would only lose that job once he/she was in the US anyway. The petitioner is the sponsor. The burden of financial support falls on the USC petitioner.

    My fiance is already working full time and at the end of this year, his ITR will increase and will reach the required poverty level. On the other hand, I thought that the required poverty level for I-134 Affidavit of Support is only 100%? I'm also thinking that because I'm currently working and had finished a degree, my possibility of becoming a public charge may decrease. Thank you so uch for your reply and Godbless..:)

  9. The beneficiary's job chances will not mater, she doesn;t have the job yet.

    The petitioner "soon" making enough won't matter, if he doesn't make enough now; you may want to delay the interview until he does make enough.

    If you mean the petitioner didn;t make enough last year but is this year then that should be fine.

    Yes, at the end of this year, we estimated his income and it will now reach the required poverty level. Thank you so much for your your reply. God bless.:)

  10. Good day VJ'ers. I'm the beneficiary of my USC fiance. he is a Filipino as well.

    My Fiance's Federal Tax Return last year 2011 was just $13, 325 because he attended school although, he still wasn't able to finish it. Currently, he is working full time at Walmart and earning $8.9 per hour. Just recently, it increased to $9.3. I know it's very low income but when we estimated his salary for the whole year, it's about $17-19,000 which is already within the poverty guideline.

    About my Educational Attainment, I graduated as a Nurse but still haven't take the NCLEX.

    Is there a possibility that my K1 visa will be approved even though his income tax return last year was low and that estimated income is still not completed? another thing, is my educational attainment has a weight with regards to avoiding the chances of becoming a public charge?

    These are the questions that bothers me. Thank you so much and God bless everyone.

  11. Hello there I would like to ask something, My fiance is currently unemployed due to their company cut off some employee on May 2011. But he was with them for six years. Anyway, since my birth month is JUNE he didnt apply yet and traveled to my country. He does have enough savings to travel from then and now, for Christmas and etc. However, since we are filing for K1 visa we are going to have his father sponsor us and file the 134 form. I have checked the qualification and we have more than the requirement they are asking for a sponsor.

    :P My question is will I have any problem for Manila Embassy and with my papers? Any possible denial?cause I heard something like co sponsor is not allowed in manila? is that right? I am a bit confused.
