  1. Hi! I don't think the actual place is of upmost concern for them, but instead the city and country. We also had the vows read in one place and the celebration in another and I only put the name of the city and country on the I-130. I don't think it will be a problem :)

    Yes, by "place of marriage" they mean City and Country, not what address or location within the city. How did you fill in an entire address in that little space? Anyway, I doubt it will be a problem.

  2. That's getting quite long. Are you a US citizen? IF so, Contact the ombudsman and/or your congressman and get some pressure on. Call USCIS and make a service request. Their online estimate is back to 5 months, so 8 is far outside current processing times, unless you're a permanent resident and not a citizen.

  3. so should we send a photocopy of our DL card along with the AOS package?

    I sent in a photocopy of my state DL, along with evidence of US bank accounts, a copy of my student visa with the approaching expiration date, and my flight itinerary back to the US. I think they also consider state taxes filed and voting records, if you happen to have them. I didn't have a problem with what I sent. Write a cover letter explaining and send it all in along with the AOS package.

    Read pages 5-6 of the I-864 Instruction packet for more information.

    I'm not an expert on this (haven't interviewed yet), but when they sent the interview letter they included a checklist of documents already received, not required, and still required for your particular case. Presumably these are the official docs that are required at doc intake. They include "financial records." It also says:

    Reminders

    * Any original documents that were requested by the NVC but were not submitted to the

    NVC must be brought to the visa interview.

    * The applicant must bring his/her medical examination results to the visa interview in an

    envelope sealed by the medical office.

    * The applicant must bring the correct size and number of photographs to the visa

    interview. They must measure 2 inches by 2 inches (5 cm by 5 cm) on a white

    background.

    * IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of

    an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, the

    applicant must bring the sponsor's most recent Federal Income Tax Return to the visa

    interview.

    * Failure to present all necessary documents to the Consular Officer will result in the

    applicant's immigrant visa being refused at the initial interview.

    I'm guessing this form will be taken with the AOS info the day before the interview.

  5. I started my paperwork in November. I called USCIS on the 5th month mark April 4th and nothing....On the 23rd they created a service request. They said I have to wait 30 days. I have seen papers going faster than that. I wonder what is their criteria....I miss my husband. It seems like an eternity. I am really to the point of looking at this site everyday. We talk on skype everyday till we go to sleep but i want him here beside me.

    Hang in there, should be soon. Good to see CSC is back to estimating 5 months for processing. No real rhyme or reason to who gets approved first, seems pretty random. They also pretty much always say 30 days, might be much sooner. I had my Congressman inquire on my behalf, he reported back they needed another 30-45 days, and I got my approval the next day.

  6. My USC wife moved from CA to HI a couple of months ago for work, but her parents still live at the CA address listed in the I-130. It's getting fairly close to the NOA2 date and since her parents are still receiving mail at her old address, she'd like to just have the NOA2 sent there and rather use the new address during the NVC stage.

    As far as I understand, it should be ok to just leave the I-130 as it is, and just use her new address on all future paperwork during the NVC and consulate stage (From choice of agent and on)?

    So should we just leave it be, or is it absolutely necessary to notify the USCIS now?

    Shouldn't be a problem. You'll get the NOA2 there and then move into NVC. NVC never sent me any real documents, all correspondence was by email, and you can put the new address on the NVC forms or call in and give them the new one.

I have been here off and on for 3 years, permanently for 1 and i only worked officially for a year in the states i'm only 21 and the year i did work and received a w2 i filed my taxes. i think i would be exempt because i haven't made any money while here, my husband works but he is a Dominican citizen to that doesn't count right?

    If your husband does not have legal permanent resident status in the US, then he does not need to file, and you do not need to report his income. You still need to file though, assuming you are not exempt (see the 1040 instructions). Residing or earning income abroad does not exempt you from filing. If your income was below the filing requirement, that would be a possible exemption. Note that filing and paying taxes are not necessarily the same thing.

  8. Does a USC have to File Taxes while abroad? Living in another Country? Surely for the Petition they will need Proof of Income. But the USC is not in the States... I'd like to know too..

    Yes, as a US citizen or legal resident you have a legal obligation to file taxes, regardless of where you currently reside.

    From the I-864 Instructions:

    If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return. See "Filing Requirements" in the IRS Form 1040 Filing Instructions to determine whether you were required to file.

  10. My wife works in a hospital lab doing research and technical work. Somehow the VO took an interest in her work and started to ask questions. My wife speaks very little English, so VO requested a translator who couldn't translate much medical/clinic terms. So the VO said you need to provide a detailed resume/travel history/work plan according to our US laws. It was very weird. Very frustrating to us.

    I see, I've read that this can be a problem. I think they're looking for evidence that your wife will take the appropriate steps to legally practice medicine in the US with the proper certification, if that's her intent. Accordingly, I'd make it clear that you're aware of what she'll need to do to be licensed in the US and include that in your plan. Alternately, indicate what other career path she might be interested in.

    I hope it's resolved quickly for you.

  11. My wife had an interview in Guz a few days ago for CR1 visa, the VO requested to have a Resume/Travel history/Work plan. The first two parts are ok. The "Work Plan" asks: provide a work plan explaining where the applicant(s) will seek employment after immigranting to the United States.

    It's not clear to me what they want. Do they look for which company to seek employment or which city?

    I'd guess they want an overview of what the applicant's plan for finding work is. I'd write a letter trying to use my past education and work experience to show why I can do certain jobs in the future. Be as specific as possible, if you change your mind later it won't matter. If you've been seeking a certain kind of job, describe that. If you know where you'll live, you could include that, probably doesn't matter. Anyway, I don't have any experience with this but that would be my interpretation. You could always email the consulate for clarification.

    Any idea what triggered this request?

  12. Thanks for the advice. The uncertainty is quite frustrating! We are expecting the birth of our first child next month and I would like nothing more than for the three of us to be able to spend this Christmas together with my family in the USA. From the statistics I've seen on this site, we could be lucky and have a visa by October or unlucky and not get it until next year :/

    Unless you're filing from abroad, plan on a minimum of 5 months...

  13. Nice! That's the day after ours. I seem to remember Darnell mentioning a document intake day at some time immediately surrounding the interview for GUZ applicants. Did they tell you about this?

    The letter doesn't mention it but on the forum and also on Guangzhou's website it says the appointment date in the letter is for document intake, then the actual interview is the next day. I'll take it. Thanks for the heads up.

    Thanks! Very excited, feels like I've been working on this forever. We've been assigned May 23, that's much earlier than I had even hoped.

    I should add congratulations to you, too! With the time zone difference our interviews might be just about the same time!

    strange, whenever i received the attachment that was all green, there was a bill for me to pay... not the black-typed attachments that preceded each (both AOS and IV)...

    Just to add my two cents to this, whenever they send billing info to me and my wife, I always get documents with the green as the petitioner, her copy is all black, but the contents is always the same for both. Could this be the difference?

  15. Hi guys! I got my NVC case number and IIN day yesterday and I'm going to have to be sending out the IV packet soon. I want to know about the DS 230 that "expired" in February. Is there a new one available and where can I download it? Thank you!

    I just used the February form as the new one is exactly the same and I already had it set to go. If you download a new one now it will expire on 4/30, which is two days from now. My form appears to have been approved with no problems, I imagine they aren't too picky about this. The DS-3032 they sent me expired in 2006.
