  1. It doesn't matter whose name the assets are in, line item 28 allows the assets of the beneficiary to be included. Mike411's math appears to be correct that you'd only need $92,560 (1.25 [poverty line requirement] x 15,130 [2012 poverty line for family of 2] x 5 [assets valued at 1/5 actual value]), but the consular official could raise doubts about your ability to convert assets to cash "without undue harm." My guess is that this method will receive more scrutiny than using income, but will probably work, especially if you have more than one home.

    The following quotations are from the I-864 instructions. Note that you don't need an I-864A:

    How Can I Use Assets to Qualify?

    Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members. You may not include an automobile unless you show that you own at least one working automobile that you have not included.

    28. Assets of the Intending Immigrant.

    You may use the assets of the intending immigrant regardless of where he or she resides. The intending immigrant must provide evidence of such assets with this form. Form I-864A is not required to document the intending immigrant's assets.

    29. Total Value of Assets.

    In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference. If the intending immigrant is an alien orphan who will be adopted in the United States after the alien orphan acquires permanent residence, and who will, as a result, acquire citizenship under section 320 of the Act, the total value of your assets need only equal the difference.

    Example of How to Use Assets: If you are petitioning for a parent and the poverty line for your household size is $22,062 and your current income is $18,062, the difference between your current income and the poverty line is $4,000. In order for assets to help you qualify, the combination of your assets, plus the assets of any household member who is signing Form I-864A, plus any available assets of the sponsored immigant, would have to equal five times this difference (5 x $4,000). In this case, you would meet the income requirements if the net value of the assets equaled at least $20,000.

  2. we got our NOA2 16 march 2012 after 192 days from NOA1

    but i need to know because we sent expidite on march 9 then we speak to costumer service in USCIS we asked how long we have to wait for answer he said the guy he cannot know that but he told my wife dont be stressed just enjoy ur week end..then in hourz i checked the case status and i see the NOA2 with out e mail...

    1. how i can knows if the expidite works

    2.i have lawyer and we r gna work together for the second step but is there official website for NVC to check the status ...??

    192 days sounds like normal processing, but you only filed the expedite request 7 days before your NOA2, correct? Did you receive confirmation that your expedite request had been approved? Does it really matter at this point?

    NVC does have a website but you can only do certain things on it. You can check it out here: http://travel.state.gov/visa/immigrants/nvc/nvc_1335.html More than likely you'll also have to call to receive the information you want.

  3. I filed last July, got approval in January. Took about 6.5 months. When I called them after 5 months had passed they didn't even put in a service request for me and told me to just wait because "we are backed up"

    So yeah...California backed up a lot. I'm afraid you have no choice but to wait it out.

    Mine was also just approved and it took 6 months and 8 days. Seems that's about as fast as it's happening these days. Hang in there. CSC should be around Sept. 10th after today, but of course some are behind a bit, some are ahead a bit.

  4. Approved! Starting to worry I was going to get left behind. Priority date was Sept. 9th! It's already 8:30 Friday night in California so I figured I was going to have to wait until next week again.

    Sorry for the back to back posts, but just updated my timeline and checked Igor's list, looks like it might have been a big day for approvals. Hope a lot of other people got good news today, too!

Well at most POE they have a separate new immigrants window usually loacated next to the Air Crew and official business (it usually has no line) but very few people ever notice it and end up in the visitors line like my wife did for about 30 minutes till they realized and told her to move. but the new immigrant line is usually for those going solo

    US citizen/permanent resident line is fine, your wife can be with you in the USC line which is even fine for her alone.

  6. I'm in the regular cue, although I reside abroad with my wife. I could have filed at the Consulate, regret not having done so now that it's taking so long. I filed 10 months before our planned move to the US, at the time I-130s were taking about 4 months. I also didn't realize filing at the Consulate would be faster. I listed the US address on the I-130 although I made it clear on that and other forms that we reside together abroad. Perhaps whoever originally accepted the form didn't read it very carefully?

  7. Expect an RFE. Good thing you'll already have the correct document. Just have the pages scanned in order and emailed. No need for the original except to carry to the interview.

    One more question, we just got the official white books back from the Gongzhengchu. It has the translations inside, but for attestation only says:

    Notarial Matter: The translation version is in conformity with its original. This is to certify that the English translation of (...) attached hereto is in conformity with its Chinese original.

    Then the translation of the official stamp and the notary office information. Is this sufficient? Doesn't it need something about the competence of the translator, or is it okay because it's an official document?

My Wife flew in from PEK to SFO on Air China and once she got into SFO, the Officer mumbled something, but she did not quite understand, but it seems the Officer did not expect an answer of any kind. He took the giant brown package, ours was about 5" thick which had come back to her place in Shenyang 4 days via EMS from GUZ after her interview.

    She was not even asked to verify her address in the USA, she filled out no forms. The Officer just gave her an info slip on what to expect on an SSN and also about the permanent green card process near the 2 year anniversary with the POE date stamped on it. she got one stamp in her passport with "CR1" on it.

    The Officer did not take her Medical Exam CD, which we still have at home.

    This was the 2nd of March and now on March 6th, SSA already produced an SSN for her and it arrived via mail on the 12th of March. The production date on the SSN was the 6th. so that shows a pretty fast response between the POE and SSA.

    Still awaiting the actual conditional green card in mail.

    Thanks for posting your experience! I take it you were waiting in the US for her? I'm curious if my wife and I fly to the US together, can I accompany her through processing? Or do I have to go through the US citizen lines and then wait? Anyone know?

  9. Hi everyone! Just wanna ask what to do. My husband will be filing his income tax return this recent taxable year. We wanted to indicate his married status in the return. The person in IRS said he could file his tax with married status but file separately. but this is my situation. I am here in the Philippines and is still waiting for our Visa approval. I worked in another country as a teacher but when we decided to marry, i went back to the Philippines. Overseas Filipino Workers in the Philippines are exempted from tax. I looked into F2555 exclusion but it looks like it doesn't apply to me. :wacko:

    Anyone who has an experience like this? Than you so much and hoping for helpful replies.

    I am in the final stage of preparing my i-130 package.

    I have printed of photos for the evidence of relationship section.

    I have decided that I will type a "our story" timeline with references to our pictures together.

    How did you guys include photos? Did you write on the back of the phots? Glue them to a paper?

    I'm just curious.

    I wrote the dates on the back and then just stuck them in. I did include location, date, and short description of each one on the cover page I submitted with the packet. Your idea of making a timeline is nice. Just make it presentable and don't kill yourself, I don't think they give extra points for creativity (although sparkles are worth 10 points).

  11. I am a capital one credit card holder and have been trying to add my husband as an authorized user and they are requiring a sociL...WELL duh he doesnt have one and from the forums it seems like some people are having success at this...ugh frustrated..any advise???? this is just not my day

    I'm also a Capital One Cardholder and I added my wife who also has no SSN. The online form to add an authorized user requires a social security number to submit, but the service agreement says:

    Also, an authorized user does not need to be of a minimum age, a U.S. citizen, or a U.S. resident.

    Non-US citizens/residents don't have SSNs, so I sent a PM with the other requested info and saying my wife doesn't have an SSN and they immediately issued the card. Good luck.

    If extra space is needed to complete any item, attach a continuation sheet, indicate the item number, and date and sign each sheet.

    I-864 Instructions:

    If you need extra space to answer any item:

    -Attach a separate sheet of paper (or more sheets if necessary);

    -Write your name, US Social Security number and the words "Form I-864" on the top right conrer of the sheet; and

    -Write the number and subject of each question for which you are providing additional information

  13. I thought it was because some people aren't updating their timeline after they received their NOA2. Maybe the timeline goes on the back burner after they get the NOA2 or is forgotten all together. What does everyone else think about this?

    Yes, I'm not sure how much value the list has based only on your absolute ranking on it, because it depends on others updating their status as they're approved. A large number of people at the beginning of the list are unlikely to influence your result, as they have either not updated or have been skipped over by the progress of the Centers. It is nice to see your number move up, though!

  14. Ok So I am now at my 188th day of waiting on this precious NOA2 where are you triangle where the hell are you? Yeah I just had to vent....to sugars of trini how do you know that the embassy in Trinidad and Tobago is unfair at times. Please share with me what you hear or encounter there please...Cause I am a trini and thats the hole I would eventually be crawling into for y interview. I seriously do not want any suprises.

    If it makes you feel any better you're one day ahead of me, which means you should hear one day sooner! Also, I believe you're at 181 today, counting from your priority date. Hang in there.

  15. One is enough. I've seen USCIS send an RFE or the customary Notarial Translation from the Gong Zheng Chu. I doubt the self translation mentioned about made it through USCIS but it will definitely NOT cut it with the Consulate.

    Thanks for the quick response. We're getting it translated and notarized at the gongzhengchu as suggested on this forum. No reason to give any extra cause for delay. I did send a self-translation to USCIS, haven't heard anything either way on that yet. I'll report back when I do.
