Yeah just got a letter saying my second RFE is one the way. Maybe i misread something on the first RFE because my eyes were so full of tears. Good luck to you. Hopefully you don't have the same coming your way!
Ouch! I am so tired of waiting for some news. Even though the 60 days were not up, I was allowed to put in a service request and then after the fifteen day wait and no resolution I sent the email to the service center.
What did the supplental RFE entail?

Can ANYONE sympathize? We send in out i129f in late October and then recieved an RFE in March and they recieved our response on March 21. After 60 days, I filed a service request and we were ordered to wait ANOTHER 25 days! Our RFE was because I didn't check one box. ONE BOX. that shouldnt take over 2 months to check. My fiance and I have been together for over 3 years traveling together full time for half of that time. We are a completely legitimate couple in love. It makes me so angry that this process is taking so long for us whereas I have heard of others who have done it for the wrong reasons have their visa within their hand within months. AH! Anybody had a similiar experience???
I feel your pain, really. I'm in the Vermont Service Center and my response would take all of five minutes to review and approve. Have you heard anything yet?

We got a RFE because Patrick sent in only the first page of the Marriage Termination and they needed a copy of all the pages...awesome!!!!

That was similar to mine. Simple huh and I have been waiting 40 days since they got the response and yet no resolution.

I sent in a copy of my divorce decree that was sent to me by wife's attorney. It did not have any notation that it was filed with a court. In addition, there was another divorce many years earlier. I noted it but did not document it thinking that it since I subsequently divorced it was obvious that the long ago marriage was dissolved.
RFE asked for the later divorce with a stamp showing filed with a court as well as a copy of the old divorce similarly stamped. I rushed to get certified copies and sent them promptly.
My docket date for the petition is December 7th, 2011. I was expecting approval by May 7th, 2012. I relieved an RFE in April. The copy of the divorce decree did not show that it was filed. I rushed and got a certified copy, express mailed it and got a file date of April 25, 2012. The documents they requested were so simple, a five minute review would show that I complied with the RFE. After reading responses on this site indicating fast approvals after reply to RFE, I was expecting quick approval.
I'm still waiting and I have called three times. First call there was an understanding person that said to call later. I called and got another person that said she would put in an inquiry. I called about ten days after to check and got a rather rude person on the line that was quite cold, said the process could take even more than six days and essentially blew me off.
Well, I am still waiting and tomorrow will be six months since the file date and more than thirty days since the file date of the RFE response. ( Vermont has normal process time of five months)
Any thoughts or advice.

The Vermont Service Center recieved my reply to a RFE on April 25, 2012. My fince visa petition is dated Dec. 7, 2011. They just asked for copies of my divorce decree as filed. It was easy stuff to compile and I expected prompt approval. I have heard nothing yet. I have called three times but I can get no information.
It would have taken five minutes to review my response to the RFE.

As I said, it is free to be denied.
Maybe not, as one poster stated, it may cause someone to think the marriage is not real. My post should have stayed on the original thread were people were looking for solutions rather than waiting to shoot someone down.
Technically, she wouldn't be an employee, but rather a material participant in the business, and would be entitled to having part of the self-employment tax paid applied to her social security and medicare accounts. Depending on how the business is set up, partnership, sole-proprietorship, LLC, etc, the owners don't usually receive wages.
Now your talking, are you an accountant or something?

It is illegal to volunteer for a job that would otherwise be a paid position without an EAD. Even a family business. She won't be able to work or volunteer at your office until she has her EAD.
Oh, can you cite some authority for that. I think I may take issue with that one.

Also, if you want to rant and rave, blame the moderators. I posted this on another topic and it was moved to a new thread. There was some discussion about wheter a loss of a job by fiance or petitioner would form the basis of an expide. I posted on that thread. It is not like I just came up with this idea out of the blue.

I must be missing something as I don't see any reason for an expedite - I want her here to help in my office for no pay doesn't quite cut it in my thinking.
If I am having to support here there and she is not productive, I can support here here and she can help me also. As far as pay, the buisness profits really go to the family and she benefits equally.
Anyone who has run a small buisness understands the value of family support and help.

You need to follow the prompts for address change and an operator will pick up.
You will need to provide proof as to why you need the expedite request. It must meet the request criteria.
You can try but I don't think they will accept your request. With a K-1 she cannot work until she has an EAD or green card and that will be quite a few months after entry to the USA, marriage and filing for AOS.
Congratulations on your marriage and sucess. It seems that there would be no restrictioins on working in a family business as long as she does not get paid. What law can prevent a wife from helping her husband in the home or buisness? Of course the powers that be may see it differently. We come here to ask questions of each other and get help, share ideas, and compare notes. I appreciate receiving thoughtful responses like yours.

Won't work but it is FREE to get turned down.
She will not be able to work for some months after arrival either so it would be kind of silly to expedite the first part, the petition, only to have to wait many more months for her green card or EAD.
Perhaps you should consider a different attorney to handle your filing.
Why the quip about a different attorney. Was this just a nasty comment? My filing seems to be going fine thank you. If there are no grounds for an expidite a "different attorney" would not be helpful.

If you bring up the work issue, you may create a situation where it may be perceived that you do not a have a legitimate engagement and intent to marry.
You have a good point there. My x wife used to help me in the law firm. And anyone that runs a buisness knows how much better it is to have family support. The reasoning is simple really.
As far as working and the green card issue, it seems that there is no prohibition for her working and helping me if she is not getting paid. After all, man and wife are one unit under God and work for each other all the time without pay.
I don't mind waiting but why not explore the possibility of expiditing. This forum is for mutual help and discussion not like one poster did and take pot shots at me. Thanks for your valuable comments.

Expediting this will not work. Her employer's late payment to her is irrelevant. She can get another job that does pay her on time. There is a reasonable solution that doesn't require an expedited case.
If you need help to run your law offIce, then hire a US resident. You can solve your problem that way. There is reasonable solution that does not require to expedite this case.
I am not an immigration lawyer. I see no reason to be nasty on this forum. I would not do that to ou. It is not easy to get jobs in the USA much less in the Philippines. Anway, I don't need responses like yours.

Yes this happens when circuits are busy or out of coverage area. I remember my Fiance went to see her relatives in the province and all week I kept getting that message till she got back in QC.
I been using Nobel phone cards, rates are ok for cell but cheaper if they have land line.
Well, she had no plan to leave the coverage area and it seems like a long time for circuits to be busy.

When we were in Korea , my fiance wanted my itouch so bad. When I went to see her I bought her one. Then I saw they had that wireless broadband (first time I saw it anywhere) for a decent price , didn't cost no more then 1000 peso a month so I got that fro her to . She was so happy with the combo , and I could reach her anywhere. It was a little pricey at first , but she was so happy and she would call me on skype on her festivals and stuff. Then all that came to an end when her Ipod just quit charging one day. She was so sad, I thought we were going to have to have a funeral for the Ipod. It wasn't even a year old , I told her to go to a IMac store and get it fixed under warranty because Imac stores should be able to track the serial numbers and trace the warranty... Anyway can't do anything in the pines without them asking for money.... so now its just a pretty paperweight....
... now that was a vent...
So with the ipod, she can be on yahoo chat or email at most any time. And without the plan, she could go to a wirless zone and chat or email. Not a bad idea. How much was the IPOD?
I have not been able to contact my fiance in over twenty four hours. I am getting worried now.

My fiance is working for a company in the Philippines but sometimes her check is delayed for months. I run a small law firm and really need her help. I am thinking that my need for her help and her loss of income due to delayed pay may form a basis
for a request to expidite.
Any thoughts?
How does the phone request work? How do you get anyone on the phone? When I call all I get is automated responses.

I really feel sad for you. It has happend to me. How can you know, what is the gut feeling that lets you know something is wrong? Some people have questioned me, if my relationship is true and secure. How can any of us be sure?
I met my lady in person for the first time in November. When I had to leave her in Manila she was so crying and upset. She seems so emotionally attached to me and I love her very much. I have been approached by other women and feel the need for companionship but I cannot be unfaithful to her. Is there a litmus test for real love and faithfulness.
I am sorr for you, I feel your pain. Do you think she was just trying to get money from you?

A good investment would be either the new Magicjack (that works without a PC) or a NetTalk Duo and DSL Internet for her.
It would give her a US Phone number and the ability to call and be called directly at home for no additional expense.
I know MagicJack is sold in the Philippines, not sure about nettalk but I think Nettalk has much better quality.
Thanks, thats intersting. It may be less costly to pay for a DSL for her and Magicjack. Would I need DSL, MagicJack and a service like Nettalk?

My fiance and I basically gave up on trying to use the phone for communication. I have a landline, she has a cell and we never did get any worthwhile reception that lasted any usable length of time. I think the longest we ever actually talked was maybe 5 minutes.
I switched from my cable phone company to Vonage when they were offering their Unlimited Philippines calling plan. The problems continued with them, so after a month I switched my landline back to my cable company.
We use Yahoo Messenger as our primary comm link now. It works for us.
I feel for ya on the calling thing though. It's a real pain not to be able to talk.
Thaks, it really is painful when the proble persist for over a day. I hope she contacts me soon from work or that the lines clear.

You know that even the phone companies only have a finite amount of circuits right? That goes for every step of the way between you and the Philippines. If any point in between is experiencing heavy volume then they may not have an open circuit to completer the transfer.
I've experienced this same thing even calling locally on both my home line (VOIP) and my Cell Phone (AT&T) on occasion.
I'm calliing for Florida, USA. Southwest Florida to be more precise.
Probably whoever you have your long distance service through. I got one of those calling card services online, called Pingo. It kinda sucks for the same reason you describe, but it was convenient at the time and I stuck with it for the calling logs. I don't have day long problems, but it does happen from time-to-time.
I'm using PINGO now. I am not that happy with it but it sure beats the Verizon rates.

Your calling direct ? Man you must have a good call plan. I have Rebtel on my Droid and I pay like .9 cents to a cell phone in Davao. I put 10$ on it like 2 months ago and still have minutes ( Usally only call if I don't see her on Skype ... Usually means her internet is down) It lets me dial directly , but I have to place the + infront of the 63 for it to go through. To call from a landline depending on your service you have to dial 011 and the number. Don't know if thats what your looking for, Sometimes the lines are just that busy
I use Pingo for my main service but I do call direct just to check if it is a problem with PINGO or with the basic service. I get the same message on PINGO or direct through Verizon.
I filed for visa just one month ago. I will likely swich service sometime soon or go with Vontage. Now, I'm just in love and want to make contact keep daily contact with my fiance if its only very short to tell her I love her. I may call two or three times a day. If she wants me to call, she rings my number and I call her back.
She does not have a laptop or internet but uses a computer at work from time to time to message me on yahoo. Thanks for all the comments. It helps me feel better about not being able to get in touch with her.

From time to time, when calling my fiance I get this error message. "sorry, this call is not permitted"
The error message can last from minutes to more than a day. I get this message whether I call on a cell phone or land line and whether I call direct or using a call service.
My fiance says she has no idea why I get this message. It is very frustrating. I don't know what Philippine comany to call to check on this.

We are still wating on NOAA2 but I want to be ready for the next step. Where is St. Lukes? What do you do about vaccination records? My fiance has a list of vaccinations signed by health services. Is that enough?
