It is issued only if you have shown a birth certificate, naturalization of certificate or certificate of citizenship. So a passport is proof of citizneship. Plus I just read the instructions (wasn't sure because I filed under the 5 year rule and all this wasn't necessary). It says:

    If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:
    1. □ Evidence that your spouse has been a U.S. citizen for the last 3 years:
    a. Birth certificate (if your spouse never lost citizenship since birth); or
    b. Certificate of Naturalization; or
    c. Certificate of Citizenship; or
    d. The inside of the front cover and signature page of your spouse’s current U.S. passport; or
    e. Form FS-240, Report of Birth Abroad of a Citizen of the United States of America; and

     

    So section (d) is all you need. Why are you worrying about birth certificates and all. Just do what is asked in (d). It's not AND, it's OR. 

    The problem is I think they print something different on everyone’s form. For his letter for the interview it just says to bring: 

    -marriage certificate

    - proof of death or divorce for each prior marriage of yourself or spouse

    -your spouse’s birth or naturalization certificate or certificate of citizenship.

     

    Where did you see the instructions you are quoting? I will look into that. 

  2. My husband’s interview appointment is next month,  I am looking at the documents required for him to bring for his interview and it says for naturalization as the spouse of a US citizen he will need my birth certificate or naturalization certificate or certificate of citizenship. 

    We had submitted a copy of my passport (which is allowed) in our application to prove my citizenship. I do not have my birth certificate...just a photocopy of it because the original went to USCIS back in 2013 for the CR1 and it’s been misplaced somehow. Do you think they will accept if he brings my passport instead? Or do I need to rush order a certified copy of my birth certificate?

  4. Hi all! I haven’t really been keeping up with this thread very much but just wanted to jump on and share some good news. We received notice on 2/2/2021 for my husband’s interview scheduled for 4/7/2021. We are with the Atlanta field office if that helps any Atlanta folks too. I know Atlanta has been dragging. I’m sorry if this has already been answered but does he take the civics test that day too? Will he be notified of the decision the same day or does it come later on?

  5. I’ve seen a lot of posts here lately that people are getting their interviews scheduled and their cases have been transferred to local offices. I’m so confused. They sent us a letter a few weeks ago (posted here) that they will be reusing his biometrics. However there is no field office. The letter came from the National Benefits Center and his case completion date is expected July 2021 😩. Why is our case completion date is so far away? Why hasn’t our case gone to a field office if they will reuse our biometrics? We have a super easy case to process. We’ve been happily married for almost 8 years and “have all our ducks in a row.” I don’t get why this would take as long as it’s expected to.

    Congrats on the letter. When did your husband do his last biometrics? I am May 2020 filer and the last time I did biometrics was for my i751 case end of 2016. I have heard that the validity of the biometrics in only a year but I guess they are making exceptions due to Covid.

    He did his biometrics probably in 2016 I believe when he removed conditions for his green card.

    Just an update-we got the formal letter and they ARE using my husband’s past biometrics And fingerprints to process and he is not going in for an appointment. The letter we got just notified that we are still in process and nothing has been determined yet and no interview scheduled yet.  Good luck to all! 

  8. Hi! My husband came over here a few years ago on the IR1/CR1 visa. We are ready to apply for my husband’s naturalization. However I totally forgot to submit a change of address form when we moved about a year and a half ago (just to the next town over). Do you think I need to file a change of address form first or can I just file the N-400 with my new address? I don’t know if it would be problematic that his address is not on file with them. Thanks!

Does anyone know if the one year extension date is applied to the receipt date of the letter we received in January 2016 OR is applied to the expiration date of my husbands conditional green card? His conditional green card expired in march 2016, so he thinks that the one year extension is for march 2017. But it seems like a few of you say yours expires in January so you are need going to a field office to extend it.

  10. My husband just decided he will fly out to visit his mom later this week who is having surgery on Sunday. He will return a week from then. We filed in January 2016. I know the NOA1 indicates he can travel during the 1 year extension, and his GC doesn't even expire until 3/21/2016. I just want him to be prepared if there are any hiccups with immigration returning to the states. Should he bring anything else with him other than his passport, green card, and NOA1 letter? Anyone have experience with traveling pending removing conditions?
