  1. Hi All,

     

    Asking for a relative...since they don't know how to post here.

     

    Mom is a US Citizen, filed a petition I-130 (IR2 I assume) for her unmarried daughter in January of 2017. The daughter is in Pakistan.

    In June of 2021, the daughter received an email indicating that her interview will be scheduled within a couple of months in the Islamabad embassy.

    She has the NVC# and I assume the case was forwarded to the embassy, but there hasn't been any movement since.

     

    This seems like an unusually long waiting time, so wanted to see if this is normal, or what actions could be taken to find out the status/progress of the case.

    My in-laws are permanent residents and have been visiting the US and have been visiting every 6 months or sooner.

     

    When they came here in August, their passports were stamped with the following "5 months, Advised on time out". What does this mean?

    They would like to go back since they have a minor child back home, and had planned to come only for about a month before heading back to take care of the child.

    We are finalizing our packet for I-751 and have the following questions:

    1. USCIS asks for Tax Returns with verification they were submitted. What constitutes as proof that tax returns were submitted?

    2. Is it safe to include the copy of the entire Tax return? It has a lot of sensitive financial information.

    3. We have joint checking account and a few credit cards together. However there's a lot of sensitive financial information on them in terms of Account #s, Credit Card Numbers, Dollar amounts etc. Do these have to be disclosed to USCIS?

  4. I would recommend the IR1/CR1 route vs K1 because of following reasons:

    - I tend to think the success rate would be higher

    - Its cheaper overall

    - Less hectic (You have to get married within 90 days after POE for a K1)

    Make sure to get lots of pictures to prove that you've had a complete marriage and fulfilled all the rituals, including rukhsati.

    Like most other applicants, we checked the box on DS-230 to automatically have an SSN issued. However, its been almost a month since the POE and we haven't received anything from the SS Office. We have received the welcome letters and the temporary green card already. I am planning to go to the SS Office in person today.

    Looking through the previous posts, I found the following instructions from Darnell. Are they still valid? Can others share their experience regarding what they did to get an SSN, or how long they had to wait?

    'ticking the box' on the DS-230 is sorta teasing to any Visa Applicant.

    The SSN may get processed, it may not get processed - it just depends on the clerk doing the data entry work for the 'intake' on the casefile once yer wife handed it over to any POE staffer. I know, the tick box was ticked, there's a reasonable expectation that 'something will get done' based on that tick box...

    But -

    if it's been more than 2 weeks past the Port of Entry Date,

    then there's a good chance that the SAVE database system has synched up,

    and

    any SSA clerk, at the local SSA office, can find her in the SAVE database.

    Ya won't know till you try. Suggest you go in person, bring -

    --yer wife

    --her passport

    --filled out application (can get those at the office, too)

    and apply.

    Whilst at the SSA office -

    Ask any clerk to look her up in the SAVE database, in the VISA name and A#.

    If they can't find her by EITHER ONE (name or A#) - go away, do not allow the application to be accepted,

    come back in a week - SAVE system doesn't have her, yet. IF any SSA clerk mumbles 'need DHS/USCIS electronic verification' - do not allow the application to be accepted - come back in a week - SAVE system doesn't have her, yet.

    Although SAVE database is useful for 'status checking' at the SSA office (by the SSA clerks) -

    many of them are not trained on how to use it. If you get blank looks or mumbles, ask for a Supervisor,

    and ask the Supervisor to 'look her up' in SAVE. If she is found via A# but the VISA name is stored wrong, in SAVE, you'll need to do something else, with the SAVE unit, to get it changed. It's a hassle, sure, but suggest you do change it to proper spelling of 'VISA NAME' prior to SSN issuance.

    re: greencard - should arrive within 45 days. If not have it after that, don't sweat this, much, as she has an I-551 stamp in her passport that validates her VISA to be used as a temporary green card, for up to 1 year.

    Hey - you have any address issues? Do you still live at the address listed in the DS-230 ? If not, oh boy - you'll need to contact a Tier 2 Human with USCIS - see http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5 and ask

    --anything sent to that address yet?

    --you receive 'nixed' mail yet?

    --please resend all to the new address.

    Don't muck about with a Tier 1 Sub-Human, a CSR - you , instead, want/need/require - a Tier 2 Human , an ISO.

    also - checking in with the USCIS status portal can be useful - SOMETIMES it's updated properly and you'll see the 'card production ordered' status show up. Sometimes.

  6. if you both have smartphones, whatsapp, viber and skype are options. Viber and skype are free and even let you make free phone calls over cellular network or wifi.

    An added advantage is you can extract the message history and provide it at the time of the interview to prove your marital relationship.

  7. My nikkah wasn't done on the phone. I was physically there for it. However my question is that is it required to have ruksati done? Technically your married after your nikkah

    To answer your question, yes it is required.

    AP is standard for certain countries and in genral even when everything is ok applicant from pak would have to go thru AP process.

    That is not true. It is not a "standard". Many cases are put into AP, but it is certainly not a given.

  8. Congrats.

    For the USCIS stage, G325a is something you need her signature on. So make sure you get that signed. And passport pictures.

    You won't need anything else from her until you get to the NVC stage, a few months down the road.

    Something else that I did, and I think it helped me considerably was the following:

    I got my spouse's name change on all her documents: NIC, Passport

    I also used this opportunity to change her residential address to my residence in Pakistan.

    This will help you down the road when proving strong marital ties.

  9. You are only considered eligible for a IR1/CR1 visa once all marriage rituals are complete. Rukhsati symbolizes the consummation of marriage, and the marriage is not considered complete without it (see instructions for I-130: Cannot file for husband or wife if both were not physically present at the marriage and the marriage was not consummated).

    If you read past consulate reviews, some members have specifically been asked if the rukhsati was performed or not. If the answer is no, the consulate gives them a blue refusal sheet and asks for the rukhsati to be performed before the visa can be processed. At the same time, there have been instances when this question has not come up. In my case it didn't because I provided pictures from the valima, as well as post wedding pictures.

    If the question does come up, you have to be able to demonstrate that you lived as husband and wife after the wedding, i.e. pictures of the valima, or casual pictures after the wedding. However, always answer honestly. Not having done the rukhsati may only delay your visa. Lying on the other hand can have serious implications.

  10. I got married in 2011, returned to US and filed as "Married filing Separately". I insisted that my accountant enter my spouse's name on the tax return, and he did. In doing so, we did not need to file for an ITIN for my spouse. I had no problems going through the NVC stage and at the interview.

    I would say "Married filing separately" would not be an issue. If it is asked at the interview, just say that you will file an adjustment to "Married filing jointly" when your spouse is in the US.

  11. I just went through POE 2 weeks ago.

    They looked at my passport, opened the package of stuff that is sealed, went through the info and checked it against my visa in my passport for ID. Then took my signature and fingerprints and stamped my passport to show the date of my POE and sent me on my way. It took about 35 minutes. Very pleasant.

    Less than 2 weeks later I received my SSN card in the mail. I didn't have to go into the SSA office at all. BUT for many people this doesn't happen automatically and they have to go in and apply in person even though they checked the box. I suggest going in and checking to see if it's on its way a couple weeks after POE. If not, then apply for one in person there since the info might now have gotten transmitted properly from the border.
