    BTW I applied for the same mother daughter beneficiaries in June 2022 and it tool 2 days. They decided ot stay in Europe for various reasons, so I applied yesterday for them- again. I do not think this will be an issue (I hope) that they were approved but did not come....any thoughts?

    Sorry I don't have current info on processing time.

     

    Form my understanding, the previous application will not affect the process for the new one. They would just have to currently meet the eligibility.

    Yes, you can be a sponsor given you can provide the documentation need. This will have any effect either way on the N400.

  3. Some questions for discussion:

    Has anyone here on U4U started the TPS process? Or thinking about starting the process?

    My understanding that if you file for TPS it does not affect your U4U status, just protects you from being expelled. Does this sound right?

    If you have an EAD, do you now have to file for another EAD under TPS?

    I'm finding the information so far pretty vague.....

  4. From my understanding there is an electronic database of "stamps" that many, but not all (Ukraine was one, don't so any longer) participate in. In light of this it is possible that there could be an issue. We have to remember that the program is to get people the people IN Ukraine out of harms way. Honestly, like what Boiler said, I highly doubt anyone is going to check this. Especially in light of many of these people now have no home to return to.

    Generally if they leave the US their humanitarian parole ends. They would need to start the process of U4U over again. There are some exceptions e.g. for school or if family member is terminally ill, etc. In these cases they can file for advanced parole.

    If they are your uncles/aunts, nephews/nieces, cousins and siblings, they cannot adjust status.

    Options:

    Temporary Protected Status - This would be the easiest, but it's for Ukrainians who have been in the US since 4/11/22. She missed that by 1 week.

    United for Ukraine - They specifically say this is for Ukrainians outside the US. I do know someone who was here on a tourist visa (6 month stay). They took a few days trip to Mexico, got U4U approved, then came back (2 year humanitarian parole).

    I-131 - Apply for Humanitarian Parole with USCIS, although has long lead times and cost $$$

    Apply for asylum - just to get her legal presence while adjudicated. Wouldn't actually want to complete the process

    CBP is squared away every time I have dealt with them, but USCIS is a bureaucratic nightmare. I tried calling to speak with someone but can't get past the auto prompts. I haven't had any luck getting consultation with local lawyers either, booked a month out. 

    I think I would be good to contact your Senator's offices. They should have resources to get answers from USCIS on the correct process for "re-parole" under U4U.

    With U4U they will have to leave the US before their parole expires even if they file I-130 from what I understand. There is supposed to be a "re-parole" process coming but I haven't seen any specifics yet.

     

    Also I-539 does apply to humanitarian parole from what I understand.

    It would be so simple to extend TPS to close the gap. Can’t do the simple way though it seems.

    USCIS, yes. I don't see the process is in place yet. I still would not expect a fee for U4U.

     

    But this I don't think would apply to the TPS. TPS would be a different process from my understanding.

    She also sets out the asylum process, but without commenting if Ukrainians will qualify, I can see how a few could, but not the majority. Unless they intend redefining how the words are interpreted. 

    What I found interesting was this is the first "official" that has made a statement that we should see a re-parole process at some point.

    This will be an interesting situation. From my understanding your first paragraph is completely correct. 

     

    As for U4U, technically it doesn't look like your MIL is technically eligible either. From USCIS:

    Ukrainian citizens who are present in the United States will not be considered for parole under Uniting for Ukraine. However, Ukrainian citizens present in the United States may be eligible for Temporary Protected Status (TPS).     It sounds like your MIL would technically have to leave the country for the duration of the application process. Sounds really crazy to me. In my opinion there has been no consideration my USCIS for this situation at this time.

    I think that is the way it is supposed to work. Two of my beneficiaries had exactly the same experience. One did not, it went on for almost 2 months until I was able to speak to an agent that "reclassified" the case, And then it was approved the next day.

    What made me feel unease was the formulation in the case status saying "we sent you a receipt notice or acceptance notice". In my case it was a receipt notice. Is that a sign that it will be denied or  kept unresolved for extended period of time?

    The receipt notice is the first step for all applicants. Normally if sufficient you should see a Confirm Notice in a week or less. The beneficiary should also receive a Confirm Notice in their email.

    Pretty much the same answer I got from the USCIS :(

    I guess I'm not really surprised. Good luck with the reapply!
