  1. Has she changed her name then? If she has then just send a copy of the name change along with the IDs and a copy of the marriage certificate. If she hasn't then I suggest going to your local IRS office and tell them what happened. Take a copy of your marriage certificate -they will be able to help you, otherwise call the IRS, sorry I can't be of much help. Good Luck

  2. Hi, I had the same problem at the NVC stage. They did not want to accept my marriage certificate because it was not from the registrar of marriages but from the courthouse's SUB-registrar. Anyway, I had the clerk from the courthouse write a note saying that the town (in India) where I married does not have a registrar of marriages and that our marriage is legally valid, signed, dated and stamped by the clerk. I also included a letter/statement explaining why the marriage certificate could not be obtained from the registrar and 2 sworn affidavits (one from my mom and one from my husband's dad) per the state website we could include the affidavits (for India) if the marriage wasn't oficially registered -it was, but I still included the sworn affidavits to be on the safe side.

    I recommend that you ask the clerk to write a note stating what you just wrote here...you can even type it and hand it over to them, so she/he can verify the fact, sign it and stamp it. They should do that...they have to do it. The IRS and USCIS are TWO Different agencies and do NOT care what the other is doing.

  3. That they'd tried to fit me in for April, but all dates are taken. That they'll try and fit me in for May.

    Hhhmmm, how could they say that? They knew April was fully booked since Mid-March. I hate when these operators gives us wrong info. Damn! just say the truth.

    I hope we both get our interview in May. Have you checked the appointment schedule for Mumbai? April has been posted since March 18th,

  4. What you must understand though is what is at stake here. We are in a process where we are waiting to be re-united with our loved ones and our lives are on hold until then. And standing between us is an agency that has assumed that every case is to be treated with suspicion unless proven otherwise. There are people who will be handing out their judgement only based on their opinions without any accountability. Therefore you cannot just assume that since you are right and you believe that tehre is nothing really to prove that everything will be fine. You have to prepare an argument to prove that your relationship is bonafide, that there is not any fraud and the burden of proof is completly upon you to provide. I would not take anything lightly in this process and leave it so that a reasonable person will understand the situation and rule in my favor.

    Similarly, no person in regular society will be able to help you much in this process unless they are familiar with the whole immigration process. since this is uncommon for the majority of people, you need to seek advice from people who have gone through this process themselves and are familiar with it or those who handle cases for people in this situation everyday and are familiar with it. You won't believe how many lawyers I have come in to contact with who claim to know the process and have given out wrong advice. Be careful in who you seek advice from as there is a lot at stake here. But the first premise here is that when it comes to immigration, we have to abandon the concept of innocent until proven guilty, we have to do the opposite and prove our innocence. With that mindset, I am sure each one of us will prepare to the best of our abilities and will leave no stone unturned and even if a process takes more effort but is safer in the eyes of the CO, it is really worth it.

    Don't just follow the advice of those who follow shortcuts. That is like someone saying hey you can shoplift from this store because there are no cameras. See I did it andI got this and that. Who knows that when you try if you will be as fortunate as that person or not.

    I really value the opinion of people here a lot as they have gone through the process and know it inside out. I would actually follow the advice Saylin gives me over what the agents at NVC or USCIS give me because she does in fact know more than even those who answer the phone.

    AGREE 100%. I had a lawyer at the beginning of this process that knows the immigration law and also prepares taxes (Good business there) BUT when I asked him if I could claim my husband on my return or file MFJ, he said NO. ONLY if he is from Canada or Mexico due to some agreement that only citizens from these countries are eligible for an ITIN. Later, I found Visajourney, and decided to do on my own. I got my husband's ITIN on Monday :yes:

  5. My wife is planning to file as married filing jointly and for this purpose I sent her a completed and signed W-7 but did not write her name in the delegate part. She said she was told by IRS that she does not need to send W-7 for ITIN to Austin, Texas but just send the whole thing (W-7 and tax return forms) to IRS.

    Do I need to send her W-7 form again with her name in delegate? It already took 2 weeks for her to receive mail from my country.

    Also, should she send the W-7 first to get ITIN for me and once she receives then she submits her tax returns?

    Well, your wife can write her name in the delegate section. It is better to be safe than sorry, so I would write it down. Alizon and Matt did not have any problems when they called the IRS to check on the status of their W-7 application. I DID, I couldn't get any piece of info from them, I gave them my husband's name, address, passport number, date of birth -I even argued that the ONLY part of information on that form worth of "stealing" is my SSN. I called 3 times. So, I do recommend writing it based on my experience but is up to you.

  6. you will not believe the run around we are getting trying to find out about civil marriage. the marriage registrar himself says that we must have a religious ceremony and then bring proof of that and then only will he register the marriage.

    can you please tell me a little bit more about your civil marriage process.

    Well, I didn't have a religious wedding we only had a civil ceremony -I'm not Indian though, I don't know if being of Indian origin makes a difference. But we had to hire a lawyer to do all the paperwork. OF COURSE, it was very expensive.

  7. Oh no! Sorry to hear that. You still have until the 15th of April to re-submit it. Can you just mail it out to them in Austin, instead of going through agents? I don't understand why they rejected from the IRS Local Office? Are they sending it to the Austin address? Did they include the copy of your wife's passport copy? That's strange. If I were you I will give it another try and mail everything myself to the Austin address. Good Luck!

    I would also advise that if the USC spouse will be calling IRS to check on the status of the W-7 application, the spouse MUST be authorized to do it. So, type the name of the USC spouse on the "DELEGATE" line and check the box "power of attorney" - then write wife/husband, otherwise IRS will NOT give any information. I was told this yesterday by one of the IRS operators. I called a few times without getting any info due to "privacy policies". Luckily, I got the number yesterday in the mail.

  8. yeah its better to send it via email...i lost almost 2 months waiting for packet 4 jst coz i sent them via courier....just fill out the forms...scan them n send them n do mention in ur email to get a confirmation email frm vfs once they get ur documents....gud luck

    Gugugugu, what did you include in packet 4? Are these the Docs we submitted to NVC? (PCC, Birth & Marriage Certificates, etc) Since, I already submitted the documents to NVC I don't need to send anything to the Embassy, right? I will bring copies with me when I go to the interview.

  10. it occurs that i never really got the answer i needed, we are not registered in spain, so my husband is still listed as single in spain, he needs the civil document from spain, which he has to renew, but how can he if he's listed as single? will our american marriage certificate suffice as proof?

    Ooops, I dint' read this part. Can he take a copy of your marriage certificate to renew his certificate? YOu can send him the original or the extract of your marriage certificate -you will wait for this Doc anyway to submit everything to NVC.

    my husband has not yet registered me, we've only been married less than a year and didn't know we need to do this for him to come to America??? so if i'm not registered with spain, he won't pass the interview???

    Is he registered in a census? If yes, does this certificate has an expiration date? If yes, was it before your wedding? If yes, then I think he does need to renew it as been marrried. If it has not expired then I don't think there's a problem. Double check with your husband and find out if he's registered in a census. If not, then you don't need it since it is ONLY available to those that are registered.

    What is this "Census" about? Is it like our census? Have you called NVC to ask about it? How about emailing those people that already completed the process and got a Visa?

    I'm guessing that this Certificate you get before getting married to prove that he was single/divorced and was able to get married, if he didn't do it then you don't need it now. For example, in India it is recommended to get an Affidavit from the Embassy stating that we are single/divorced and can be married in India. Sorry, I can't be of much help :blush:

    The marriage certificate is all you need to prove that he's married.

  12. You Must have the physical examination = 1600 rupees, PLUS blood work (1045 rupees), X-rays (350 Ruppes). The vaccinations will depend on what you need. Plan on having all of them even if you already had some. Well, I'm planning to spend the amount on the list hoping that it will be less :)

    Update on my w-7 status. Well, I contacted the ITIN department on March 19th, because i had not heard anything concerning my application. Now, mind you I had been calling every week to check up on my status, but they kept telling me it wasn't in the system and takes 6-8 weeks. On the 19th, a gentleman actually took the time to look and discovered my W-7 for my wife was rejected on feb 21. I had mailed it on Feb 8. He said that a letter was sent to me on the 27, but I told him I never received it and nobody there told me anything. Come to find out it was rejected because the acceptance agent was not certified to accept my application thus making his certificate of accuracy invalid. Also, they said that my wifes Identification Document(her notarized passport was no good). I told him thats nonsense, it exactly what they wanted. He suggested i go to an IRS office near me. I thanked him and went over. I spoke with the IRS guy and showed him the copy of everything i sent over. He looked over my return and documents and had no idea why they would've rejected it. He contacted the ITIN office and spoke with someone there. They cleared it up(I hope) and the guy said it would be taken cared of. The IRS agent made a copy of my forms and put a new acceptance form on it and sent it in. I was relieved it was finally taken cared of, but pissed because I never received any rejection noticed in the mail. So we'll see what happens from here.

    Hi, you got me worried. So I called IRS and they didn't want to give me any information because I am NOT the one applying for the ITIN. The operator wants my husband to call, WHAT!? I told her he is not in the States, "well he hast to call from overseas to give him the status of his application, this is confidential" she said. Did you have any problems with this? I can't believe it! Argh! She will not give me any information.

  15. Okay everyone, I have the awesomest of news, if there's such a word. My husband just spoke to an operator at NVC and got the confirmation that our case is officially closed. He was so shocked, that he asked the operator if he knew what he was talking about. In reply, the operator said yes, the case if officially closed, we did try sending it to the Mumbai consulate but it bounced back as there isn't a date available for an April interview. He's asked us to call again in two weeks' time or so for a May interview date.     Wow! Congratulations! It took them One Day to complete and to send it to Mumbai, that's awesome! I also sent my RFE on the 20th, hopefully, I got the same reviewer :yes:

Last time I came back, I took my wife's birth certificate with me as I needed that for DS-230 and then I also told my wife to mail me the voter id because losing a voter id in mail is better than losing a passport. I took both original to my bank and got them notarized and sent them with my W7 on March 5th with my return and today I already got her ITIN number in the mail (in just 2 weeks) :dance::thumbs: . Now just waiting to see a big fat deposit in my bank account :dance: and filing return jointly would also help during her interview at the embassy.

    This is Great! I also sent mine on March 5th, so I should be getting mine anytime soon. I sent a copy of the passport notarized by a US notary.

If timelines aren't complete, look at their signatures, if they have one. This is what I did.

    I MIGHT update the spreadsheet over the summer (when I don't have to worry about school), but I'm not sure. It would take a lot... Or perhaps I can start a separate spreadsheet for it, in order of country to make it simpler.

    Yes, I'm using this one, but I wasn't opening each person's timeline. I did check a few when you told me. I have a better estimate of when to expect an interview. THANK YOU! Gosh! Details, details -I wasn't paying attention. :-)

  18. That would be a LOT of work, especially going through all 500 lines on my spreadsheet :P

    Plus, keep in mind, it's country specific, so you'd have to look through them to find YOUR country. It's easier to use the timeline feature as you can sort by country. Then start looking at people's timelines closely. They have the case complete date on the timelines, as well as a packet 4. Just do your research. That's what I did, and then made my own little Canadian spreadsheet with important dates of case complete, interview date assigned/packet 4 received, and interview date. I then went further to see how long it'd take to receive my visa, so I added a "received visa" date on my spreadsheet :D
