I agree with the others. I have 14 years on my wife, they didn't bat an eye at that. Age is irrelevant when love is involved, especially in the latin culture.

Better yet passport stamps showing entries which is more than likely what the CO will be asking for at the interview.
Hah!. you beat me to it. Yes, passport stamps are what they will ask for. I showed the CO a copy of my old and new passport, she wanted to see the stamps is what i'm assuming.

On question 29, write none on every line underneath Name. On question 30, move your city up to the top and change font to make it smaller if you want, then underneath write N/A or none on every line under city or town. Do not leave anything blank.

Thank for confiming missing middle name. I think my beneficary name is too long.
It's pretty much the norm for the middle name to be missing. My wife and step-daughter's middle name was missing on their NOA1 as well, it's not a problem. It's normal. Just about nearly every NOA1 has the middle name missing. No issue at all.

I just mailed my i-130 package 4/2/12 to uscis and today i received text and email confirming my receipt and NO1 and it says my case routed to Vermont service center, how does Vermont center look for those whose cases were transferred there? any good news

VSC has been faster than CSC. I think the average has been around 4 months, but many others(including myself) have gotten their NOA2 within 3 months.

This OP has made some mistakes. Who hasn't? But it seems WAY over the top to be judging him so harshly! He seems to be trying to make the best of a bad situation for all involved but has become ensnared in a very difficult problem that hindsight will say he should have seen coming!
To the OP; You need a good lawyer that knows his way around the affidavit of support issue. Keep your head up and learn from your mistakes. Good luck!
Couldn't disagree more. A mistake is an when you do something unententionally, an error is a complete lapse in judgement and doing something you know is wrong. This was an error, and a big one. Committed for fraud. He married her, knowing it was doomed to fail just for GC's for all. Another poster said this but i agree, this is why it's so hard for real couples to get their approvals. I wouldn't call it being nice, I would call it being idiotic. Fraud is Fraud, no such thing as "Nice" fraud or "Bad" Fraud, it's still fraud.

I am hoping that I do not have the same problems you are. We got married on Dec 8th. I filed married joint return - I went armed with my completed 1040 income taxes form and W7 forms etc. and on the day my hubby had his biometrics we both stopped into the IRS (Buffalo, NY) and submitted the taxes along with the W7 form. She told us it could take between 4 to 8 weeks because of it being income tax season. Actually someone should write a pamphlet about everything that goes along with the visa journey and beyond including incometaxes, social security number, itin, drivers licenses - I think we will be all rather well learned after this process is over.

No, you should be fine. My problem was the acceptance agent's EIN Number expired so he couldn't accept W-7's anymore, meaning his "certificate of Accuracy" he submitted with my application was worthless. That screwed up my whole application, so I have to submit another one without his signature on the bottom. That's why i recommended to people to just go directly to the IRS and forget about acceptance agents. The guy who accepted mine was still on the IRS website when I went to him. Just a heads up to others.

I submitted a copy of Notarized by a foreign notary with an Apostille as instructed on notice CP566 ( first notice issued on Feb 20th, 2012)...
half hour ago, I talked with IRS. She was also suprised to get 2nd notice before due date. but she could not disclose the detail as it's ( W-7) for my wife until my spouse give me power of attorney. good thing is I will have 3 years of the due date of the original return ( without regard to extentions) to submit Amending tax returns ( Form 1040X)....So, It looks like its better to file my tax returns as married filling seperate for now and get ready for my AOS....

Just a heads up, I spoke with the IRS people about possibly just sending in a new return "married filing seperately" and amending it when she's here in May. But the women said that because i already sent in a "married filing Jointly" I cannot file "Married filing seperately". It can only be done the other way around. I'm not saying this is right but it's what they told me today, but at this point Im like whatever.

FINALLY got through on that hotline and they said ours was issued just a week and a half ago, so that's somewhat within normal mailing time from the US to Canada. I didn't check the delegate box either, but the IRS was willing to talk to me because I knew my husband's DOB and address and my own SSN.

I'm glad it worked out for you. I went back to check my forms again to see if I missed anything. Well, looking over the w-7, I saw that for mailing address I put her D.R. address and for residential I put "same". That explains that. As far as why it was rejected again, on the bottom of the W-7 where it says acceptance agent's signature, it still has the old signature of the other acceptance agent, even though the IRS resubmitted it for me. Now, at least i know what's going on. I need to resubmitted another W-7.

Oh no! Sorry to hear that. You still have until the 15th of April to re-submit it. Can you just mail it out to them in Austin, instead of going through agents? I don't understand why they rejected from the IRS Local Office? Are they sending it to the Austin address? Did they include the copy of your wife's passport copy? That's strange. If I were you I will give it another try and mail everything myself to the Austin address. Good Luck!
I would also advise that if the USC spouse will be calling IRS to check on the status of the W-7 application, the spouse MUST be authorized to do it. So, type the name of the USC spouse on the "DELEGATE" line and check the box "power of attorney" - then write wife/husband, otherwise IRS will NOT give any information. I was told this yesterday by one of the IRS operators. I called a few times without getting any info due to "privacy policies". Luckily, I got the number yesterday in the mail.
I think it was rejected again, because the original certificate of accuracy from the original acceptance agent was accidently included. I spoke with the ITIN department(number that i have from here) and they said to send the information back with the letter. I explained to her several times, I WON'T GET THE LETTER BECAUSE IT'S BEEN SENT TO DOMINICAN REPUBLIC. They stated they have no way of getting in contact with the dept because theres no direct number and i should sent them a letter and the entire package again. I said ok, but this time i'm going straight to the IRS.

P.S, I never checked the delegate box. When I call I just say i'm the husband and they ask me personal questions about her and me to prove i am who i said I am.

When did you submit the first ITIN request? The ITIN hotline won't even let me wait on hold to check on the status of our W-7 because there are so many people calling them.
I submitted it back on feb 8. It would've been done, but the acceptance agent's EIN number expired and they wouldn't accept it from him. However, they didnt' remove him from the site.

Just an update and some words of precaution to those wanting to file Married filing Jointly.
I stated in my thread before that I never received the rejection letter from the ITIN department. I went to the IRS on 03/19 after I found out it was rejected, and they gave their approval and sent it off again. On 03/26, the application was rejected again, even though it was the IRS sending it in. I found this out today, and the reason it was rejected was because person submitting is not qualified to do so(even though it was an IRS agent) and the fact that I didn't respond to the original rejection letter sent on 02/27. Come to find out that the reason I never received the letter was because it was sent to the address on the w-7 application. My wife's Dominican republic's address *sigh* Of course everyone know's how the mail system works there so there's no need going into it. My advice for people going this route in the future is if you want to be sure it will get done, drop everything off at the IRS and forget about "Acceptance agents" because the one I went to(Jean Barnell dumel) in no longer certified to be one, even though he was still listed on the dam IRS website. Learn from my mistake and save yourself some major headache.

P.S I went by the IRS offices today and looks like I will have to file Married filing seperately because of all this and amend when she's here.

I think my problem stems from the fact that the acceptance agent that is listed on the irs site was no longer qualified to to accept applications. But the dumb #### still did mine. Now, I'm jumping threw hoops just to get this completed, and it should have been done long ago. Also, i never knew there was a problem because I never received the letter they supposedly sent which only delayed my process further. I dropped a copy of my return and forms with the irs office across the street from the building and everything should be all set, but I don't trust none of these bastards.

That 2nd week of April prompt is not true... that I understand interview are schedule all month long. For me the bad part is I was guiding myself by Matt's timeline and it took him 10 days (counting weekends) to get info on his interview... and I am at 10 days and nothing ...

Hi, you got me worried. So I called IRS and they didn't want to give me any information because I am NOT the one applying for the ITIN. The operator wants my husband to call, WHAT!? I told her he is not in the States, "well he hast to call from overseas to give him the status of his application, this is confidential" she said. Did you have any problems with this? I can't believe it! Argh! She will not give me any information.

Yeah, initially they told me that also but I kept calling until they asked me my wife's information to prove I was who I was.

WOW. This is why it's so important to keep calling and speak to different people because most just won't go the extra mile for you but one will.
This is exactly why I chose to not do the whole w-7 thing, but I guess it's worth it for people who get a bigger refund. I opted to file married/separate and it was easier.
I hope this clears up soon, I have faith it will, seems like you spoke to a competent person who got the ball rolling. God knows you don't need anymore stress with the upcoming interview and all.

Tell me about it. This is all I need right now. The only reason I did this was because I could use the money, and timed my refund with their arrival. Now, it's in God's hands. The woman I spoke with today, said that I need to call back in about 3 weeks and if she doesn't have an ITIN number, they will just process my return with just me. I can understand If I make an error, I can deal with that. But this wasn't my fault, and was because of incompetence on their part. If the guy wasn't an acceptance agent, he shouldn't have been listed on their site. And the part about the ID was no good was nonsense because it was exactly what they asked for, a notarized copy of the passport. It's just so fustrating dealing with incompetence.

Update on my w-7 status. Well, I contacted the ITIN department on March 19th, because i had not heard anything concerning my application. Now, mind you I had been calling every week to check up on my status, but they kept telling me it wasn't in the system and takes 6-8 weeks. On the 19th, a gentleman actually took the time to look and discovered my W-7 for my wife was rejected on feb 21. I had mailed it on Feb 8. He said that a letter was sent to me on the 27, but I told him I never received it and nobody there told me anything. Come to find out it was rejected because the acceptance agent was not certified to accept my application thus making his certificate of accuracy invalid. Also, they said that my wifes Identification Document(her notarized passport was no good). I told him thats nonsense, it exactly what they wanted. He suggested i go to an IRS office near me. I thanked him and went over. I spoke with the IRS guy and showed him the copy of everything i sent over. He looked over my return and documents and had no idea why they would've rejected it. He contacted the ITIN office and spoke with someone there. They cleared it up(I hope) and the guy said it would be taken cared of. The IRS agent made a copy of my forms and put a new acceptance form on it and sent it in. I was relieved it was finally taken cared of, but pissed because I never received any rejection noticed in the mail. So we'll see what happens from here.

I put one passport photo in their own plastic baggie and paperclipped the baggie with the photo inside to the corresponding G325A. Tha's an option.

I can think of three scenarios:
1. *Maybe* the guy hasn't filed because he has some issue here in USA and he likes to fix those issues before she comes over
or
2. *Maybe* the guy smell that the girl can spend few bucks and he introduced the lawyer so that he can milk the cow?
or
3. *Maybe* he doesn't want her to come to USA and he can't find a way to tell her. He is living la vida loca in NJ.
Sooner or later we will find out.
Going by her posts and answers, i'm leaning towards No. 3. It sounds like he doesn't want her coming over here.

Hello VJ family,
