this wait....now 46 days.
it is so hard waiting for her.
tying up loose ends, getting her things shipped out.
saying goodbye, visiting family and friends.
it has just been too long since we been together.
we have rare fights. good news is they are less destructive, and no one needs to be right.
we seemed have learned its ok to leave it unsettled and open. no one has to "win"
still lonely and all that...it is hard. i wish she was here.

as i said and posted--he can as it states in the i485 instructions. and no mattere on tourist visa.no time to get one. and his country is part of the vwp . and it is clearly stated in the i485 instructions he can travel on it and make his choice. then we can fill out the forms and send in payment. and the intent doesnt matter, as he is clear to come on this as he is a minor. am i the only one to read the i485 instructions?
and yes, if it is done it needs to be done before the 90 days are up. after that it is a whole 'nother legal mess.
Look man, we told you our advice and you're explaining your way around it. But we're not telling you anything that's incorrect. If you're now telling us that he doesn't have immigrant intent when he enters under the VWP fine, but it's not us that you're going to have to convince. As I and a couple other people said, no one disputes that you can adjust status after being admitted to the U.S. This needs to be done before the stay on the I-94 expires--which may be 90 days or 6 months or 2 weeks. The problem is entering on the VWP with immigrant intent. As another person said, the child may be denied at the border or questioned more if it is clear that the child has an immigrant mother.

You're confused. What you are quoting is for people who are already here , whose circumstances changed. No one is saying AOSing from VWP is illegal. We are telling you coming with intent to immigrate on VWP is illegal.
You can do whatever you like but what you are suggesting is illegal. No matter, a minor coming on VWP with a mother who has an immigrant visa is very unlikely to be admitted in the first place. I'd make a backup plan, if you insist on using this method, for if and when your step son goes through customs and is denied entry while your wife is admitted.

and from what i have read --we need to file before his 90 days are up on his visit. and his mom wanted him to come and decide for himself. so he actually is not lying. he is unsure ,and their relationship is such she wants to let him make his own choice.
and i could not find any difference of child , or step child.
so the doomsayers ...we are not trying to do anything illegal.. he is her son and she is married to me. he is entitled to come , and there are a couple different ways to do this.
this fits out situation. and all the requirements are/will be met if he decides he wants to be here.

have your proof with you for the interview. i doubt you will need it. your situation is very like ours,we talked and then were apart for a long time and then POW! it bloomed
she can have a friend or relative co sponsor you, if her income is unacceptable source or not enough.
my girl be here in 50 days.
she has to visit family in poland,and then Metallica in Norway LOL then here she comes ! the shipping company picked up her things today .

i have a few form suggestions
you being an IT guy(i am an aspiring student for systems and network admin) i suggest print all teh forms
fill in by hand
check and check and check and check them !! then e mail to her and have her check them over and over.once they are correct have her sign and send you the originals for you to send in. it will save half the time in snail mailing back and forth.
they like clean and easy to work with forms.
we had delays(fights LOL) and i messed up sending in papers. but none of our forms were rejected or RFE's .
and once you have the forms correct... do them on the computer and print, then sign.
also do the research on all your forms..
you can have them all before they e mail you back. so if you spend down time getting them ready, as soon as you get an email, you respond with the next form ALREADY proofed and filled out and signed. it will cut down
the time frame of all this paperwork. do it so all you do is add money order for payment,and postage and mail it. no reason to wait for them to say "we recieved form blah blah blah". always have the next step ready to send them.
DO print the ds230 and fill it out as i described. it is a "live" PDF form. if you print or shut off the computer you have to begin all over again. make a correct hand filled in copy,and then do it on the computer and sign it.
ALSO make all biographical info the exact same as you go thru the process. you dont want to miss a job or residence date or something like that.
the forms are read by a scanner, i think that is why clean forms help your case be processed. sign in black ink.
i did have ONE mistake on papers. it was ONE digit in her employment history. be very very thorough in your forms for cleanliness and accuracy.keep copies and keep it
organized.

we got married
then filed for k3
they changed it to CR1 ...we did not know we should have done this. not sure if all get changed this way or not.
then we did all the forms and fees.
our local immigration office suggested we do it this way so she can have everything to work when she is ready when she comes over.
for us, it was painless. we had more pain on a personal level.. distance and time apart and fights. but we better and stronger now

If my wife adds me as a cardholder to a couple of her credit cards, does this help or hinder my credit here in the US?

i would advise if :
her credit is good or better--
and yours is no credit at all-- then do it.
it will benefit you.
if you are credit challenged like me...well dont screw her history by polluting hers with your history..
dont do it if your credit is bad or worse, it will drag her down if you mess up payments.
AND
everyone is entitled to one free credit report from each of the big three each year. you must contact them directly to request the free copy.

she is not immigrant mother, she is CR1 --my wife and i am US citizen, born here if that means anything in this discussion

his mother is already approved--visa in hand.
he is 16.
he can enter on visa waiver and then we can apply for AOS. this applies ONLY for under 21 children of either me the US citizen, or her with the green card she will receive.and he is coming a few months after she is.
the law is written such that there are means to not split families apart. his original plan was to stay with his dad and finish school, which is why we did not get him visa while doing her application.

It is illegal to enter the US on a non-immigrant visa with the intent to immigrate. No one is going to help you commit visa fraud.
no one is committing fraud of any kind.
so i have found a minor (he is) CAN enter on the visa waiver program and the his mother can apply for AOS.
there is even a program or situation where we can file both i130 and i485 at the same time and we need to do this with in the 90 day window once he arrives.
he is her child, and he is not barred from coming here .
i found out part of this info by searching HERE of all places.

i went to local immigration office today. they said fill out i130 and i485.

so we have her visa all set and ready, and now it seems the plan her son had with his dad are falling thru. and he is likely coming with , and i am fine with that. i suggested we get him a visa as we did hers but she said no he was staying in UK for education. so we did not get his visa.
can he get adjusted here on a tourist visa?
i am off now to search for more info but i thought it best to ask the experts first

she now has visa
but wants to see her family in poland first, and her cousin is getting married on cyprus end of june.
last saw her in oct of 2010
not very thrilled with more dates and travel adding yet another month of waiting.

My lovely Izabela was approved monday morning!
easy peasy
she got the nice lady and she asked how we met and oh my !! she told her everything.
and now to tie up all the loose ends.
i have been soooo tired . like i am emotionally spent. she been working her butt off i can imagine how she feels.
she is going to have a nice vacation when she gets here.
and i get foot rubbing duty LOL
i cant wait ...been a year and a half. she be coming beginning of june. she has to give notice to employer, see her grandmother and family in Poland and the obligatory Metallica concert in Norway .
her 16 year old son will visit in august and she is going to let him make his own choice to come here if he wants to.
we have had our fights and did not talk for a long time. i kept after the process and we finally made up and made our apologies. i know this is very stressful and i can advise if what you have is real
dont let it die and dont quit because of the long struggle. love is always worth it.
be strong and be right with the ones you need to be.
our next steps will be culture shock and the newness of nearly a stranger around the house. and she is also someone i know very well.
i blame the internet
i ll keep you all posted. i hope our accents dont melt into some horrible uncool accent.

hello everyone
i have a couple questions
first off am i correct in that the embassy mails my wife a letter she has to bring with her for interview? or is the one that i was e mailed one in the same? we have everything else in hand and ready.
second if anyone can suggest a shipping company for us.she will be shipping her household goods here. she is working double shifts every chance she can and doesnt have time for looking, and i thought it might be fastest to just ask here. thanks in advance

to take the weekend off for her interview. she needs a place to stay near the embassy.
i had a lot of this saved from before and i lost a lot of my e mails and links in my computer. i will look around here and see what i can find and a big thank you for any who post up useful help
and her interview is march 26th .
then she has her sons school graduation, and tidying up all her loose ends and a concert in Norway for Metallica..and a trip to poland for a visit to her family that is not in the UK. then she is coming ...yes....
