  1. OK well I'm really starting to get impatient here. Interview was Jan 12Th left with letter saying recommended for approval. IO said give them about 60 days and how they try to get it done asap, but they need to check where I will be doing the Oath at, in Memphis or in Arkansas. Well I'm still waiting. Did a e-request and got a fast reply saying I was approved and will be sent a letter 2 weeks before my oath. Now I'm trying to keep from going crazy, should I continue to wait, do info pass or talk to the senator/congressman or who ever I should talk too? Anyways any words of encouragement to keep waiting or other ideas are welcomed.

    Can you make an info pass appointment and find out what is going?

  2. It's not uncommon NOA-numbers not being recognized for first couple of weeks to a month. Usually problem is fixed after biometrics have been processed.

    Yes, this is correct. Some times it might take few days for the application to appear on their website. Give few days and try again later.

  3. 1) I recommend applying ASAP hoping you guys will be able to get an interview within 2-3 months. If you do, you'll only have to find a solution for the oath. Either you have your wife flying back to US or let her stay on her own in NJ for few months.

    2) Yes, you have to go through NJ if that's where you guys are unless you move to Texas, stay there for 3+ months and then file. That's not a solution for you guys.

    Easiest thing at this time is extend the apartment lease for few months until the Oath is done and then vacate the apartment. Have some one check the mail for you in your absence and let you know. Also she has to attend the Interview and Oath Ceremony. So it is best keep the apartment for few more months and keep the lease. Also make sure you have all the required documents to prove you both are married since you are applying based on 3 year marriage. They will ask for the lease, bank, utility and all kinds of statements and papers. Better start collecting all of them now and keep them ready.

    Ok so my receipt number starts with NBC* so surely it should be recognized after all it is the benefits centre. I've checked online and on the phone, am I putting it in wrong?

    That is correct number.

  5. i was not originally concerned about this matter, but suddenly, i realized i mistakenly put my philippine address in my philippine marriage certificate.. and its a mess to change that.

    so yeah i am just concerned that my marriage certificate has my philippine address, so do i have to write that address down in my n400 during that time period?

    No. You are going to write the current address where you are living in your N-400 Application. You could have been married at a different place and it does not matter. For N-400 purposes you put your current address. That will also determine which lockbox your application should be sent to as residents of different states has to send their application to different lockboxes. If you are unsure you can make an info pass appointment and ask for advice from Immigration officer. Or have an atty file your application and save your self from head ache.

  6. I had my interview after my second anniversary, my K3 visa was valid for Two years, is that the same as CGC?

    I am not sure about K3 and CGC are the same. But if you have attended the 2 year interview and removed the conditions and gave you a 10 Green Card I am sure they checked the details. I would say wait for the 5 year and apply for N400 based on 5 year category. If I were you, I would still talk to any atty or get the court documents and find out exactly fraud claim your wife put into the case. Does the annulment due to fraud caused a conviction? Or in future can they prosecute you for fraud and convict you? I think this is some thing you should take seriously and find out the details to make sure you do not have future problems. Most of the times when you apply for the job or security clearance they can do a background check.

  7. I believe once the child is born in US acquires the US Citizenship. At the age of 18 they can decide if they want to obtain citizenship of parents country depending upon the laws of that country. My questions would be how do you include the child in the passport? Get a US passport ( I guess that is not possible at least till they reach certain age ) or include in parents passport. If parents are citizens of 2 different countries does the child has to be listed in both parents passports so their respective countries grant benefits.

  8. I go to the courthouse and have the "Dissolution without children" the court annulled it, it's in her testimony she alledge it was fraudulent.

    But the court order was Marriage dissolved without children, don't know if Immigration is going to go into the details about why and what not,

    Do not goto court. Your state should have an office where they keep the vital records like birth, death, marriage, divorce. All it shows is a divorce or annulment and does not show the history. Not sure what state you are located in, try to find out the contact info. I know I got certificates from Virginia and New Hampshire vital records division. It is worth checking and see what it says. Again unless you are applying based on a 3 year married to USC not sure why they would ask for divorce certificate. My suggestion and best bet find out where is the vital records division is located in your state and get it. If you can not go in person you can also apply online and get the certificate.

  9. Thanks folks, I got the annullment decree and in her reason for annullment it was alledge I committed fraud.

    She had placed a publication in the newspaper and also sent a formal notice to my parents address, (they didn't see any letter from her or her lawyer) .

    I was and am a truck driver and usually go on the road for weeks at a time, I've contacted the courts about having the annullment overturn but they're saying it's been long ago (2006) and might be a futile effort on my part. Really confused and worried

    You can goto court house or state division of records and get a copy of the annulment record. It is different from decree and it just might say the marriage annulled with out any details. If that is the case then you are in much better shape. It costs only $5-$10 to get one of those and you can always show that to IO. I doubt they will ask for the decree from court. I would say get the certificate and see what says and then you can talk to an atty. I personally would not file for N400 until I check with an Atty and find out the details. Worst case you can remain as a LPR than getting it more troubles with out your knowledge.

    I am new on here but like a few advice if possible.

    I came to the US from Manchester England in 2005 on a K3 visa, my ex-wife is a USC, and received my ten year GC a few months later.

    My wife and I had a falling out and we took time apart, she filed for annullment base on fraud and was granted it. I wasn't aware of the annullment or her allegations of fraud,

    I wasn't aware of the annullment and only found out a few months ago, we're both on speaking terms and occasionally have a few romps.

    My question is can I file for my citizenship based on the 5 year rule, and will this revoke my GC? She's willing to write a letter stating that she was angry and annulled the marriage out of spite,

    Furthermore shouldn't I have been contacted to contest the annullment?

    You may want to meet with an atty with all the case details and seek advice. Not knowing what is the fraud charge and its base we can not make suggestions for you.

    just a quick question is a copy of joint lease required to file for N-400 based on 3 year marriage?

    we re moving to a new place and my wife doesnt have credit and the new apartment will be under my name only.

    will that cause any problems?

    Though your wife does not have credit she can be in the lease agreement. USCIS can be very picky for documentation if they are filing based on 3 year marriage.

We need some urgent help my sisters online line status reads oath ceremony schedule and a notice was mailed well that was last Wednesday March 21 it's now over a week and she still hasnt received it she is very worried as there is a oath ceremony coming up for April 20 , she did call yesterday and they said yes it was mailed but she has to wait for thirty days can she make an info pass to see if they can give her a print out. Oh she lives in Clarksville Tenn. She had the interview in Memphis . Any advise is greatly appreciated thank you.

    Some times it might take week or two for the letter to come. I am sure they will give sufficient advance time for the oath ceremony.

  14. We would love for them to fax it but it seems every number we have is an automated operator. We can been trying from monday and can not get through

    It is one of the autmated options. Not sure exact numbers but there is an automated option where you can request the transcript faxed or mailed to you. Search the board and you'll find information.

    1 passport photo, the filled out form, and a check.

    And don't even think about just applying for a passport book. You absolutely need to get a passport card as well. The extra cost is $25 if applied at the same time, and it will come 2 or 3 weeks later, but you need to have another document proving that you are a U.S. citizen in case something happens to your passport book, whether it gets stolen, lost, or damaged. The one thing you don't want to do is to take your Certificate of Naturalization out of the bank safe again once you put it in there. That document is irreplaceable, literally.

    Thanks Brother Hesekel. I am planning on applying for both Passport and Passport Card. It is worth it to carry it around as a proof of USC. In some of the Border states they can stop and check for the proof.

  16. Yep, you should be able to get a same-day or 24h passport. The extra fee should be the same as expedited; i.e., $60 on top of the regular fees.

    That is not bad. I'll call Boston office and make appointment so I can go there right after my Oath Ceremony. Besides the Naturalization Certificate, Drivers License is there any thing else I have to take with me when I goto Passport Office?
