  1. They MUST be original. Read part 5B of the instructions closely:

    5B: Provide original statements from you and your fiancé whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; and…

    Also read part 9 copies:

    Copies: Unless specifically required that an original document be filed with the application or petition, and ordinary legible photocopy may be submitted. Original documents submitted when not required will remain a part of the record, even if the submission was not required

    They ask for an ORIGINAL statement. Not a copy.

    You also need an ORIGINAL G-325A from your fiancé.

  2. Hi again! 401K accounts typically send you quarterly statements that have the things like date of opeing account, the deposits, etc. At least mine do. Although I would not feel comfortable using that as a "bank account" because it technically is not.

    A couple more things for you:

    -If you dont meet 125% of the minimum poverty guidlines now, you will need a co-sponcer.

    -Even if you do meet 125% of the minimum now, and you did not on your last year's tax return, you should get a co-sponcer. Because unfortunatly it is solely up to th CO at the interview if he believes you make a consistant salary to support the applicant. If he wants to be picky he can.

    -Make sure you include more information than the minimum. I know in Egypt they ask for things out of the minimum requirement.

    Include:

    Bank letter and account statements

    Employment letter

    At least 8 weeks’ worth of paycheck stubs or more

    Copies of income tax returns

    Any investment account statement

    I know some of the things are not "required", but I have seen cases in the country I'm petitioning in, Egypt, that the CO asks for things like tax returns and pay stubs even though they are not required, and it delays the visa. I can't imagine India would be all that different.

    They ask for an ORIGINAL statement. Not a copy. Don’t waste 3-4 months for them just to return it back to you. It will only take a week or less to get the letter from India.

    You also need an ORIGINAL G-325A from him. Better wait the extra week now than waste a whole lot more when they return it.

    BTW, the customer service department at the USCIS is never helpful. They always tell you to just read and follow the instructions.

  4. Hi there! Use a 2 hole punch with a fastener. Sometimes called ACCO fasteners. A punch can be purchased at Office depot for $10. Also use tabs at the bottom of each section. Check the link below. It is instructions straight from the government website.

    In preparing your packet, please take note of the following:

    -Do not use binders or folders that cannot be easily disassembled.

    -Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.

    -The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.

    -Avoid submitting originals unless specifically required.

    -Avoid submitting oversized documentation when possible.

    can you provide some thought about this

    A question for those of you that have experience with intrviews in Mexico. If the USC does an intent letter in English, and the beneficiary shows up for the interview and doesn't speak English, do you think the Consular Officer will have questions as to the beneficiary's understanding of intent? In Ukraine, there would have been questions unless there was a translation matching and signed.

    Hi! I honestly dont know for sure. Thank goodness my fiancée speaks English. BUT, you ALWAYS wanna be on the safe side when it comes to this. If he knows absolutley NO English, you could either send a certified Spanish translation of the letter with your fiancé (which in my experience comes stapled and stamped with a copy of the original), or your fiancé could say that he understands what is there because it was pasted into google translate, and have him bring a screan shot like the one below. If your fiancé speaks any English, it shouldnt matter at all. The CO probably wont ask, but its always better to be safe than sorry.

  7. You guys have nothing to lose. Get married legally in Mexico and apply for cr1 visa. Age difference is an obstacle, but you can overcome this if you can prove you have true relationship. K1 may not be the route for you. But if you do go that route, make sure you accompany her to the interview at the embassy. It’s going to be hard to prove the visa isn’t only for immigration purposes. I am sure you are very much in love. Gather as much evidence as you can and go for it. Any possible red flags must be discussed and dealt with. God bless your journey.

  8. A cruise may not be a good idea as with a K1 as it is a single entry visa. Gotta reset your Canadian outlook on US entry/exit. Until you obtained Advance Parole or the GC you would not be authorized to enter the US.

    What a lot of K1 couples do is have a small legal marriage shortly after entry to be able to move on to the Adjustment of Status phase and then plan a large® wedding party/celebration when they no longer have to try and guess about visa issuance.

    I agree with Anh map. RETHINK your cruise wedding! If you do a cruise wedding and he steps foot out of the US, he will NOT be allowed back in. Most cruise lines are owned by foreign countries. I would hate to see you go through the stress and the wait for him to be stuck outside of the US and not let back in. With a K1 visa you MUST get married inside the US, MUST! Otherwise if you want to get married outside the US marry him now, and you'll have to apply for a K3/ Cr1 visa.

    Also, the process takes anywhere from 5 months to 1 year if your lucky.

  9. yea :( he was born outside the US 29 years ago now we cant go there ,,, what do u think if we send his mother passport copy there is mention his name when he came to US when he was 1 year old. and we can send weddings pictures? they are together...

    Use the mother's passport and the wedding photos. You can never have too much evidence. Also get notarized affidavits from both the brother and sister. As well as notarized affidavits from their parents, grandparents, other siblings, or relatives. Google this: "notarized affidavit sample"

    There are many samples that you can use to fit your needs. Most banks have Notaries. Send both their passports too.

  10. Hi! It means the service center your case will be handled at. Unfortunately you won’t know until they send you your 1st NOA (notice of action) and no it is not your local office. You really don’t have any way of knowing. I just put the Dallas facility's address, and my petition was approved quickly.

    Just make sure everything is organized, that you send loads of proof! Always send more than the minimum.

    I'm not sure how to get the birth certificate if they are not born in the US. Perhaps contacting the registry department in the City/Country they were born in.

    Otherwise you could possibly use notarized affidavits from both the brother and sister. As well as notarized affidavits from their parents, grandparents, other siblings, or relatives.

    How about any other evidence that they grew up together? Pictures maybe?

    Send as much evidence as possible.

    8. No do not put your middle name here. Other Surnames used means other last names you have used. Like in a prior marriage, or any other LAST name you have used that is not on your passport. Otherwise put NONE. Make sure in #6 that you have your last name or names as it is on your passport. And #7 put your 1st and middle names.

    9. Also put NONE unless you have any other middle names not on your passport.

    33. Put NO, because you don't have a school you intend on attending, but it doesnt really matter.
