  2. can somebody help me. i just recently filed for divorce because my wife abandoned me last year Dec 2011. my 90 days roc wont be til Oct 2013. i recently got hired and my employer has been pushing me to visit our office in the philippines but i have now this tremendous fear that i might have a problem re-entering or my recently filed divorce will affect me (how will they know when i just filed it a month ago) so i asked a relative who works in an immigration law firm.

    "The immigration officer at the port of entry (airport) has the discretion to revoke/cancel your green card at the entry if they discover that you have filed for divorce. Unfortunately, there is no way for us to know what kind of information the immigration officers at the port of entry know. Regardless of your purpose of the trip (whether personal or business), the immigration officer may or may not revoke/cancel the conditional green card if knowledge of the divorce is discovered. (The immigration officer will for sure ask you about the status of your marriage because you are currently a conditional resident.) But of course, the only way you will really find out if you will have a problem is once you are there. I strongly advise against traveling overseas for fear that the immigration officer will discover the filing of the divorce during the two year conditional period. If discovered, Im almost 90% certain your 2-year conditional card will be cancelled at the airport. "

    please help me. i feel miserable and helpless. like another good opportunity is going to get wasted again. i had to let go so many good opportunities in my life all because my sole future depends on my wife who abandoned me. i thought i will be ok because we are living separately now and can self petition. but because my boss eagerly wants me to fly to the philippines and i think of s good excuse not to fly, i only have one option- to quit,

  3. My gc's 90 day window is next year june 2013. I just filed divorce last month because my wife abandoned me. Currently our situation isnt doing good. My company is sending me to the philippines for a business trip this september. But im worried that i might have problem re entering. Many friends are telling me be careful as my could have called uscis and secretly informed them that we are now separated. Or they could give hard time and interrogate me. Worse is,not let me in.I dont want to compromise my life because of crazy wife. A friend who is a lpr through family had a bad experience at the airport coming back from the phils last week. It drives me crazy.

    Can they not let me in eventhough im a legal resident?

    Please help me. Ill appreciate any assistance

  4. I just filed my divorce papers because my usc wife abandoned me. She started becoming abusive, acting crazy and weird. and this is my dilemma. I need to travel bacl to mycountry for a family emergency but fears that she might have done stupid stuff, maybe like making up stories and reporting them to uscis just to hassle me with my re entry.im reading some entries and some of them were quite given a hard time when held,at the airport for question.

    Is there a way where I can make sure that im issue free before I leave the country?

    And im just conditional resident. Can say stop me from re-entering??

Me and my USC wife had already filed our divorce paper 2 weeks ago. she became uncooperative and hard to deal with in every way. i caught her 2x fooling around and doing drugs which resulated to our separation. i got my conditional card Oct 2011 but she decided to abandon me last dec 2011 and move somewhere else. and now that we are separating, the fear of her retaliating never stops. this is why i posted something about travelling as i have to go back to my country for a serious family emergency but fear that she might do something stupid and report false information about me and that i may have a problem coming back. i am conditional and i feel helpless and have no choice but to submit myself to whatever her condition is.

    whats the advantage/disadvantage of filing, divorce and self petitioning as opposed to just waiting for my ROC next year June 2013 but got no evidence to show after she left december 2011. marriage was entered in good faith. i have tons of evidence prior to dec 2011. will the journey be tougher?

  6. When your divorce is final, if you're on a conditional green card, you're supposed to file the ROC as soon as possible. You will need to prove the marriage was entered into in good faith. If does not require your soon to be ex-wife. You can find many posts in here where the marriage broke up and the sponsor wants to send the beneficiary back. They're told over and over they can't. Save your evidence, avoid you soon to be ex-wife, finish the divorce, and apply to remove conditions.

  8. Yeah. I already have the temporary visa and currently on pending divorce petition. I dont even know if it will be an easy ROC since crazy wife wont bother cooperating with me when I file my roc next july.

    She abandoned me and decided to live a life of her own went to school and declared separated to get financial help, filed tax separately.

    Hi. I think im still in the right category since im in an ROC Status..

    OP- you won't have any trouble as long as you hold a valid greencard. You will need to file for ROC at the usual time even if not yet divorced.

    i hope you guys can help me with my dilemma. Me and my USC wife are in a really bad terms and we ended up filing for divorce. I am planning to go to my country because of a family emergency. However i fear alot that my crazy wife might find out that im leaving the country, do some stupid stuff to prevent me from entering. i know she is capable of doing it but because i already have started my life here, (which she is ruining by the way) i dont want have any problem in coming back. is there any way to check if theres any pending complaint or issue against me by anybody? or anything that i can do to have a smooth re-entry?

    please advise

  10. iposted something few weeks ago about my case. divorcing before ROC because ofmy USC's wife abandonment. i talked to a lawyer last night and asked for hisadvice.

    Herewere my questions and his answers

    1) DoesFiling tax as ‘married but filing separately’ affect my ROC? I know this issort of a red flag for them.\

    2) Doesit matter who files for the divorce in ROC? Me the immigrant who got abandonedby my abusive wife or my wife who would not bother wasting her time at allgoing through the paperwork and court appearance etc. i pointed out that I wantto file it myself so I can tell the explain the real deal. How I caught her withother guys, drinking and smoking pot in our apt when im not around, using ourbank money and abandoning me. She lives and work now in San diego while I livehere in LA financially struggling. My worry is I don’t want them to think thisis just bogus, now im applying for ROC after ive received my GC. This isn’t whatI wanted my marriage to turn out.

    He told me that it doesn’t matter.Its better if I file it myself that way I can tell them whats really goin on,and since why wife wont care doing the whole course of divorce. He said I shouldn’tworry about this

    3) Whatsgonna happen to me after divorce?

    We will start building thepackage we will file

    4) Whenshould I file the ROC? Right after I received the divorce decree or should I stillwait the 90 day thing before the ROC

    Its better if we wait for the 90days period. Coz if I file it too soon after I received the decree, they wouldnot process it the same way its submitted within that 90 day period. This totallyconfused me.

    I hope somebody can help me as looking, consulting, comparing different lawyers’ advice isexhausting.

  11. Will filing tax under ‘marriage but filingseparately’ affect Roc?

    I hope somebody can help me here. Im married toa USC for a year now and have been a gc holder for 5 months. Although weentered marriage in good faith, things didn’t work out fine. My wife decided tojust abandon me and move back to San Diego after a couple of arguments after Idiscovered her fooling around with other guys ( I have evidence), alcohol, andpot etc. As I live alone here in Los Angeles, its quite a struggle tofinancially support myself. We both mutually decided that this set up is betteras she has another guy now.

    My question is

    1) Since we need to file tax and wetechnically ‘separated’ what effect will this do to my ROC since we are filingunder ‘married but filing separately’

    2) If she files divorce and granted therequest got approved, do I still need to wait for due time to file for ROC orcan I file a waiver as soon as I get the divorce document?

    3) Is ROC for a divorced petitionedimmigrant like me difficult? Will there be interview?

    26 - On September 26, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

    27 - On September 27, 2011, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST

    STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    in short, it jumped from card/doc production -> Decision -> Post Decision -> card production again. now i dunno which to follow.

  13. IO said she needs further review of the docs. From 180, she cut down to 30 days..and that ill be receiving something in the mail. I94 was taken by the way during interview. Few minutes after, got a notification saying this:

    Card/ Document Production

    On September 21, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283. This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/ document is produced and mailed to the applicant. You can expect to receive your card/ document within 30 days of the approval of your application.

    Does that mean shes done with the review?? Of this is just the status they mark once done with the interview but havent made the decision yet, which I doubt. Called customer service, said it depends on case. Huh?
