They didn't asked for my I-94 but because I came on a VWP, I told them i never had it in my possession. You can also photo copy the passport stamp of your last point of entry / passport photo I.D page.

Unless your case is extremely worrying I.e you have a bad criminal background / have tried for a visa before, an attorney isn't really needed.
Please tell us more about your case, you'll find that VJ has a lot of good respectable people whom have all been through what you're going through now. So please tell us some of your background.

Make sacrifices to pay the payments. My wife sponsored me and she used to go out every thursday night in new york city, when i came and we decided to do this, she couldn't do that anymore to pay for the costs. It gets better once it's all sent off and done with.

We sent our entire package off together, the I-130 processes through-out your entire AOS case. When ours was filing, we received the first notice of action for all of them, then was able to check up online for the I-485, but the I-130 was never available for viewing online (strange)...

I think I covered everything.
Most importantly, don't stress out about any of this, nothing is worse than working yourself and your wife/husband over this. As long as you haven't killed anyone, committed terrorism you should be fine. But if you had any convictions relating to drugs and violence, be cautious because the Interviewing Officer has the authority to deny your application.

Be ready to answer any questions about why you overstayed, etc. But the way I see it is, you've had your EAD approved and you're married to a USC. All will be forgiven.

I had several update vaccinations. My T.B test came back as reactive (meaning I had come into contact with TB at some point in life) so;
With Vaccinations, CHEST XRAY, Blood tests and the check up itself, I think it was around $500? But we live on Long Island, so it's not exactly cheap...
I think you also have to get them translated so when you send them off.

You should still show up at your USCIS office for the interview. Just in case.

I never filed Police Records, they do the background checks for you... Well that's what I thought anyways. But I don't have a criminal background or any police reports filed against me. But if you have something in the past that may have gotten a report, then it's probably time to make some phone calls.

Your wife will need to earn 125% of the poverty guideline income.
If your wife is unable to prove her income or she doesn't make enough, then you will need to file the I-864 (which your wife will file.) then I-864a which will be for a "co-sponsor" to sign and submit their income / assets. The second document is basically a fail safe, saying "if for some reason your wife can't provide for you, the second person will agree to support you with their income / assets."
You will need to file the I-485 Adjustment of Status
Your wife will need to file the I-130 Petition for Alien Relative.
You will also send the signed I-864 and I-864A.
You will fill out and sign the I-765 EMPLOYMENT AUTHORISATION DOCUMENTATION
You MUST send the I-693 Medical Examination by an approved USCIS Civil Surgeon. (You can view the list of Civil Surgeons which are able to perform this examination on the USCIS website)
(I never sent the medical straight away, BUT you have over-stayed for quite some time, it's best to get it all over and done with.)

SEND IN A CHECK FOR THE EXACT AMMOUNT OF MONEY REQUIRED TO PROCESS YOUR ENTIRE PACKAGE
TO HELP ENSURE YOUR PACKAGE IS PROCESSED SMOOTHLY, WRITE ON THE BOTTOM OF THE CHECK WHAT EACH FILING FEE IS E.G;

SEND YOUR ENTIRE PACKAGE TOGETHER INCLUDING CHECKS MADE PAYABLE TO U.S DEPARTMENT OF HOMELAND SECURITY, in a large envelope. You can choose to send it off on express service or not.
YOUR I-485:
Send in the copy of your I-94 or I-94W this is usually a slip stapled to your passport.
If you are unable to find the I-94/W, then photocopy the main passport page of your photo identification and your MOST RECENT United States issued stamp. (When you last arrived into the states)
PLEASE READ THE INSTRUCTIONS ON THE ACTUAL DOCUMENTS YOU'RE FILING. THEY WILL HELP YOU.
P.S Since you're married to a USC, I don't think you need a lawyer, unless your past is cause for concern... Like a criminal record.

Like he said above. A is the answer, you're married to a U.S citizen, so a visa becomes immediately available to you.

Your interview will be different, what state are you residing in right now?
They didn't ask me anything about intentions of marriage, they simply asked my wife how we met.
It shouldn't be an issue for you, if you know you came as a visitor with no intentions of marriage, you should be fine.
My wife simply added me to her Verizon account, you ring up customer services and ask to be added to the bill. All that they will do is add your name to the billing statement.
You need to send off for your I-765 EMPLOYMENT AUTHORIZATION CARD - This will honestly help you both out so much more. You'll receive a card, which enables you to get your SSN and you can then apply for other joint assets. The card is FREE with your pending I-485 application. So send it off! Chances are you may receive your EAD card, a month before your actual interview date.

Don't forget to file for your EAD card also I-765, when this arrives you will have hopefully a month gap between it's arrival, to your interview date.
You can get a SSN with your EAD card, you can add yourself to bills etc then also.
Don't ask to be the primary name on the t-mobile account, ask them to just add your name to the bill, as you're both married. I'm assuming your T-Mobile plan has two phones / sharing the same plan?

If they're a registered USCIS civil surgeon, don't worry. Lol. They know exactly what they're doing. My TB test stayed raised, which meant I had come into contact with the virus some point in my life. It's best to look for a radiologist in your local area, and check prices just in case something comes back.

The I.O who interviewed my wife and me said, "A previous conviction doesn't necessarily mean an instant denial, but I'm not letting any murderers, rapists or drug dealers in my Country."
As long as you can safely say "NO" to any of the major questions they ask on the I-485, you should be fine.

You don't need an SSN to get a bank account. You only need two forms of picture I.D. It clearly says on the SSN website that a number is not required to apply for bank accounts / school etc etc.

Get your name jointly signed onto the phone bill, Verizon let my wife put my name on the phone bill, while I did not have an SSN.
You can also get a joint bank account as long as you have two forms of I.D.
I do not know if this was covered earlier, but do NOT let the catholic charity, or whatever it is, try to help you "for a fee". That's such a scam. You said they provide you with the documentation (so does USCIS for free) and they send it off for you? (So does the USPS for a $1.44 tops)
At the end of the day you're married to a USC, you have a child together and have been living together for over two years. I don't think anything says marriage / relationship, any better, than having a child together.
The documentation should be easy:
I-485, adjustment of status.
Your husband will fill out: I-130 Petition for Alien Relative and I-864 Affidavit of Support.
Your Father in law or whoever else is sponsoring you will file along side your Husband, by signing the I-864A Affidavit of Support from Additional member of household. (He does live in the same household as you both?)
I-693 Medical Examination - Will be filed by a doctor which HAS to be pre-approved by the USCIS Civil Surgeon section, on the USCIS.gov website.
(If you want a quick and easy process, you will send this in with the rest of the package.)
Also send in the I-765 Petition for Employment Authorization This EAD (Employment Authorization Documentation) should arrive before your initial interview, providing your I-485 petition is pending smoothly.
Your I-485 should include a copy of:
- Passport Stamp
- Passport Picture ID
- I-94 showing your last arrival date.
There are other things to include also, but these must be added for extra guarantee. If you can't find your I-94W, the passport page showing the stamp and the passport photo will be enough.
Good luck and DO NOT panic over this. I was just as worried as you because my wife and me were in a similar situation.
Met online, Known eachother for years, lost contact, regained contact, arranged to meet, fell in love, married within three months. We sent out our AOS package a month after my Overstay period. USCIS understand different people have different situations. As long as you haven't entered the country illegally, you'll be fine.

If you can't get the I-693 before the I-94 date, then like mentioned above, either arrange to be seen in another state / city location.
Or,
Send it off without the I-693 and wait for a RFE requesting the documentation. This will delay your overall progress and it is still just as risky.

In my interview they never even asked to see my SSN. Just say you applied for one and are awaiting the arrival of your card.
As for utilities etc that are joint. You have more than enough proof that you're together. All me and my wife brought with us was a Verizon phone bill in both of our names and a Bank letter which had both of our names on it also.
I want you to breathe and take a step back, relax you'll be fine.

P.s unless your case is a cause for concern I.e you have committed some crimes in the past. Don't bother hiring a lawyer if the paperwork seems straight forward to you. If you need any help or advice filling it out, take the paperwork to your local uscis office and request a ticket. The I.o's at the front desks will be able to assist you.

If you're married to a USC all will be forgiven. You don't need a drivers license. In the interview they may ask to see your I-94, your Social Security Card and your Employment Authorization Documentation.
