  2. A child who is:

    • Born to a US citizen who did not live in (or come to) the United states for the required period of time prior to the child's birth, or
    • Born to one US citizen parent and one alien parent or two alien parents who naturalize after the child's birth, or
    • Adopted (stepchildren cannot derive or acquire citizenship through their stepparents)
    And is permanently residing in the united states can become a US citizen by action of law on the date on which all of the following requirements have been met:
    • The child was lawfully admitted for permanent residence (*Children who immigrated under the IR3 or IR4 categories must have had an immigrant petition filed for them on their behalf before their 16th birthday.[...])
    • Either parent was a United States citizen by birth or naturalization** (The "one US citizen parent" rule applies only to children who first fulfilled the requirements for automatic citizenship (other than birth abroad) on or after Feb 27, 2001. In order to qualify for automatic citizenship (other than at birth abroad) on or before Feb 26, 2001, both of the child's parents must have been United States Citizens either at birth or through naturalization[... ]
    • The child was still under 18 years of age; and
    • The child was not married;and
    • The child was the parent's legitimate child or was legitimized by the parent before the child's 16th birthday.[...]
    • If adopted [...]
    • The child was residing in the United States in the legal custody of the United Citizen parent (this includes joint custody); and
    • The child was residing in United States in the physical custody of the United states Parent.
    I just see the part where it says "two alien parents who naturalize after the child's birth) because your child was not born to one US citizen parent. But the second part (the note I added) makes it seem like as long as the child was born after 02/27/2001, they can naturalize because 1 parent did even though it contradicts the previous part.

    So I'm confused. :) I'll ask hubs when he gets home too. He may be able to explain it to me better since he speaks govt jibber jabber, being a govt employee.

    I'm sure of this and to be even sure i spoke with an officer during my naturalisation interview and he said he's automatically a citizen after I become one. More so, this happened to a friend of mine, so I know about it.
  3. IMO it looks like both you and your wife would need to be citizens before your child can become one.

    bottom of page 13 and bottom of 14 seem to explain it.

    I could be wrong of course and would love for someone to point out where I may be missing something.

    If u look at 2nd section automatic citizen after birth but b4 the age of 18. Then see 2nd row it clearly says it.

  4. I agree with my wife having 2yrs 1st and then 10yrs but not my son. He should have the 10yrs. I'm filing for his citizenship right after mine.

    You have the endorsed visa in your passport that acts as a green card for 1 year do you not? Or did you adjust your status?


    The longer you wait to return it and fix it properly (both of them) the longer it will take to get it back.

  5. Both SS cards arrived yesterday exactly one week after application.

    Now i can file my tax return.

    jewel4life BECAUSE OF HIS POST, I WENT AND APPLY SS FOR DAD, BECAUSE MY DAD'S STATUS KEEP SAYING PENDING/REVIEW. JUST CAME BACK FROM APPLYING SS CARD FOR DAD, AND WHEN I GET HOME AND CHECK ELIS IT IS NOW OPTIMIZED. I REALLY BELIEVE APPLYING SS WILL WAKEN UP YOUR SLEEPING pending review STATUS ON ELIS.

    NO HARM IN TRYING GUYS. GO GET YOUR SS CARD TO GET YOUR ELIS STATUS OPTIMIZED.

    Grab your receipt number from ELIS (starts IOE then numbers) and see if it comes up with anything on the USCIS case status checker: https://egov.uscis.gov/cris/Dashboard/CaseStatus.do

  7. I had my interview today and the whole process lasted 10mins except for waiting for oath letter. My appointment was for 1230pm but i arrived 1200pm and i was done 1210pm.

    Went through security check like the airport and dropped off my interview letter in a box. I was called in for fingerprint immediately and the woman to interview me was just waiting for me at the door.

    She took me to her office and she went as below:

    Raise your right hand and swear to say the truth, which i concur.

    Please sit she said

    Q1: Please write ( We pay taxes)

    Me: I did

    Q2: She showed me a paper and asked me to read the 1st line

    Me: We pay taxes to the the government

    Q3: What is freedom of religion

    Me: answer

    Q3: When was the constitution written

    Me: answer

    Q3: How many US senators are there

    Me: answer

    Q3: What ocean is on the east coast f the united states

    Me: answer

    Q3: Name one state that borders Canada

    Me: answer

    She went through my form like 1minute and said all good.

    She said you have passed and handed me a paper saying congratulations.

    She asked me to wait for 1hour to get my oath letter.

    After 50mins i was called to come pick up my oath letter and i checked to make sure all is fine then walked out.

    Yeepee.

    They are actually there to make you pass every step after staying this long to get it and nothing to trip you.

  9. I'm not sure if this helps - but I'm also concerned about my married name appearing on the green card, so I checked the USCIS website. Apparently you can update your profile (after you log in, the link is on the left of the page), so I did. Now my married name is my primary name and my maiden name is noted as an alternative. I don't know if this will work though, but I guess it's good they have a record of both names instead of just my maiden name. smile.png

    Yes I did that this morning after making the payment by viewing profile and updating the information immediately. I was going to update you guys when I get back home from office.

  10. I came through LAX Jan 27th.

    I didn't have to fill any form in at POE. they took my finger prints i signed something and that was it.

    So you did fill the elis form online with your maiden name and have you received your green card yet?

    To me it seems the online form will be used for the green card printing and it will require extra time and money to change name from maiden to husband. That's not good.

  11. Hubby said that upon point of entry yes this is possible. They give you a form asking for you name, signature etc that you want to appear on your green card. He said that this stuff will be mentioned in the predeparture orientation. I hope it's still the same process though. smile.png

    Yep i hope too, that's why we need someone who's been through point of entry recently to answer if they still give the form.

  12. Hi! I used my maiden name because it's the one on my passport and lately that's the one embassy has been using for me (even if I started with my married name when I applied). I think the maiden name is okay for now. Not sure what will be printed on my green card though... I also prefer my married name. Hopefully they can update it in the future. smile.png

    Ok thanks. Can it be changed at the point of entry as to what you want on your green card? I know this to be possible before this payment policy prior to coming in.

    Does anyone have experience with filling out form for $165 immigrant visa fee prior to departing?

    I was trying to do for my wife and wondering if the maiden name used for visa application should be used on the form or my wife should use my last name now. The reason i'm asking is because i'm not sure if that will be the name they will use for green card printing or not, as we will like for her to change to my last name.

  14. Interview experience:

    We got to the consulate 5:35am for 7am interview. We got on line at 6:15am and we got inside about 7:05am. Medical envelopes were opened at the gate and some other docs like birth certificate copies, marriage cert copy, passport photo, international passport, medical envelopes and a form to fill at the gate was also submitted at the first counter inside. Meanwhile, while the docs were been collected at the first counter, she already saw approved on her file.

    After 1hour 30minutes, she was called to a counter where a lady is and asked to make a oath and fingerprint. She was then asked the following questions:

    What is your husband's address in the US?

    What is your address in Nigeria?

    You said your husband works at British petroleum. That was to confuse me but he works in another related company, I said no and mentioned it.

    When did he propose?

    When was the first time he travelled to the state and with who?

    How did he get into the states

    You're approved and she gave a white paper and circled where to pick passport from next week.

    Advise is to pray to God, be prepared and know your partner well.

    I wish the rest of you guys well with your interviews.
