Not sure about your civil surgeon question (someone else in the LA area might be able to answer that) but when I sent my AOS package, we provided a copy of our marriage license with the clerk office's embossed seal which proves it had been used. We received an RFE to provide the actual marriage certificate 5 months later. We sent a color photocopy of the certified copy and it was good enough.

  2. You can apply before you have less than 15 days remaining on your I-94 or AFTER you have received your green card. You can't apply in between.

    Having a social security number won't allow you to work (you need EAD to work) but it will allow you to get started in the U.S. You would be surprised how much easier things get once you have your social: open a bank account, get a joint bank account, a driver's license (depending on your state), add your name to utility bills, car insurance, etc. Which, by the way, are proof of bona fide relationship you would provide should you be among the 50% K1 holders who end up having an AOS interview.

    Once you are married and have your GC, you can go change your last name should you choose to take your husband's.

  4. Long story short, they need the USC's paperwork because need to prove to USCIS you are entitled to petition for your wife's AOS; which is to prove your status in the U.S. And your identity. Everything listed on the interview letter is mandatory. The officer who will conduct the interview needs to confirm his copies match your original documents. That includes both birth certificate, which are listed as mandatory documents and not a part of the "unless already provided" section. What was done for your K1 is done. Now you are dealing with a new office for a new petition.

    You should make an Infopass appointment and ask them about providing the birth certificates. Depending on what they say, you might have to reschedule your interview, which means both your wife and daughter's immigration benefits will be on hold. And anyways, you need a copy of original birth certificates for your records, so why not order them already?

    May I add your letter clearly states (third line, in bold and underlined characters) : "failure to bring the below listed items will result in the denial of your application." Now personally, that is something I wouldn't chance.

  5. Also, if the overall money amount you still have in Canadian accounts is over 10 000$, you need to declare the value of your accounts, bonds, etc. in Canada. The form is TD F 90-22.1. It has to be sent by mail separately to the Department of Treasury before June 30th. I believe you are not taxed on this amount unless its value is greater than 150 000$.

  6. Your eligibility is based on your marriage and him not showing is a major problem. Read your interview appointment letter. It specifically says you have to attend with the USC. As I said in your other post, you know what day it is, so you can make arrangements for him to be available or reschedule your appointment. Be aware that rescheduling your interview will incur further delays for all your pending immigration benefits.

  7. That's an interview appointment. Both spouses are required to attend and the letter will provide a list of documents for you to bring.

    As I said. If you are adjusting status based on marriage to a USC, attendance of both spouses is mandatory. Your interview appointment letter will provide the details. You know which day it is already so you can make arrangements for him to be available. Or you can wait to receive your letter and reschedule at another time. They usually schedule 90 days ahead thus it will delay your AOS and any pending immigration benefits.

  8. No, no email yet. Considering the level of need required to request speediness, it seemed silly to ask. Idk. Do you think it would be worth it?

    Worst case they will tell you you should have returned the passport sooner. What is there for you to loose but a couple minutes to write an email?

  9. About 2-3 weeks. Anything that goes through their mail room sits there for a little while. I had to courier them my passport last year (my medical was not ready the day of my interview in Montreal and they offered for me to keep my passport and mail it along with the results) and it took a little over 2 weeks before they mailed my passport back with my visa.

  10. You should have your Vaccination sheet (DS-3025) still. If you don't, you can ask the civil surgeon's office who did your medical to provide you with a copy. If your vaccinations were completed you can submit DS-3025 only with your AOS. The USCIS office will have a copy of your K1 papers and your sealed envelope. They will know your K1 has been activated within less than 12 months.

  11. Please note that regardless of what anyone says, a name/D.O.B check is NOT apparently enough for US Immigration services. (according to my lawyers that is)

    Your immigration lawyer is wrong. I had mine done at a local police station in Quebec last year and they never took my fingerprints. It was satisfactory to the US consulate in Montreal. Unless you have a criminal record or someone with your name has one, a basic name based police check is fine.

  12. I don't know if it could be a 6 months validity for the consulate but it is 12 months for AOS.

    You can use the same medical for AOS by submitting your Vaccination sheet (DS-3025) only if your vaccinations were considered complete at the time of your medical and if your AOS package is submitted within a year of the medical.

  13. As a volunteer without employment authorization, you cannot hold a position or do a job that would be otherwise paid. Or be paid later for a volunteering position you had while EAD/GC was pending.

    I would refrain from getting too involved in his business prior to receiving your EAD/GC. Also, you have to file paperwork when you are hired which require your EAD. Don't get in anymore trouble and wait to get your EAD in the mail.

  14. You will have no problem traveling with your green card in your married name and passport in your maiden name until it is time to renew your passport; just make sure you are also carrying a copy of your marriage certificate. And airfare is always booked with the name as it appears on your travel document. If you are traveling internationally and using your passport, tickets must match the name on your passport or you might have issues being admitted in a foreign country or let alone board on the plane.

    Also, be aware you cannot use the simplified passport renewal form to renew a passport with a name change. You will need to find a guarantor in Canada to certify (sign) your photos, making the renewal process from the U.S much more complicated.   15. Depends who gets there first, but really, I concur; your fiance should either take a cab or look into public transport to meet you downtown. Montreal is bilingual, he won't have any issue with that. Most can now accept credit cards, he just need to ask the driver prior getting in the cab (so no carrying around Canadian dollars)

    It looks like VIA Rail makes a stop at the airport, but I would call them and make sure you can connect there: http://www.viarail.ca/en/useful-info/related-services/montreal-airport-shuttle. Otherwise, you want to go downtown and get off at the Montreal downtown stop on ''de la Gauchetiere''. There is a subway stop right in the building, you could meet your fiance there.

    You can find an interactive subway map for Montreal here: http://www.stm.info/english/metro/a-mapmet.htm. Pretty easy to use and get around but if you have an early morning appointment, buy your tickets 1 day ahead. Automated booths in stations are often not in function.
