After 14 months of waiting, my wife s i130 petition was finally approved and sent to the nvc last week! I have 2 questions I need help with:

1) I just submitted the i864 and the DS260. Now what comes next? And how long until she gets an interview date? She is in Peru?

2) big question. I was able to submit my most recent tax return and it shows I make double the amount required for the 2 of us. I started a new job as of February of 2023 though and I submitted scanned copies of the last 5 months of paychecks as well as a written letter from my new boss at the new barbershop that I will be expected to make at least double the required income. My question is that I hear they also want W2s and 1099s and I don t have copies of that for last year. Does that really matter or will I be okay with what I submitted?

This is taking place in Peru. Please help me understand this, thank you.

Hi,

I am originally from Peru living here in the United States as a US Citizen.

Last year, I submited the i-130 form for my wife who is currently in Peru and the petition just got approved last month and now I am in the process of filling out the i-864 affidavit forms.

My personal situation: I am a physical disabled individual, never worked before and my only source of income is SSI $950 a month (Suplemental Security Income), no other income and not personal assets. I am not required to file taxes and I asked my niece who is also a US Citizen to be my wife's sponsor.

Last year, 2022 was my niece's (sponsor) first time filling taxes and she made around 50K.

Question 1:

Can my niece be good enough to be my wife's sponsor with one year only of income tax?
She is still employed and currently working.

Question 2: Form i-864 for myself (the petitioner)
Part 5: Question 7
My current individual annual income.

Is this referring to work income only? or should I add my SSI monthly payments?

Question 3: Form i-864 for myself (the petitioner)
Part 6: Question 20
My current annual household income is:

Should I add my monthly SSI payments? Does SSI payments counts as annual household income?

Question 4: Form i-864 for my niece (the sponsor)
Part 6: 23.A
Have you filed a federal income tax return for each of the three most recent tax years?

I answered to this question NO because my niece only has one year of income tax.
Did I answered this correctly?

Question 5: Form i-864 for myself (the petitioner).
I am not required to file taxes and my SSI payments are below the poverty line.

1: Should I include my social security statement where it shows all the years that I never report income?

2: or should I attach my social security benefit verification letter where it shows my current SSI payments?

Filling out this form is very important for me since I don't have the money to hire a lawyer and I have a special need to have my wife here with me.

Embassy Appointment Scheduled but need to correct info on DS-260

The addresses of 3 of my MILs children were unknown when the DS-260 was filled in, so we put unknown, just to expedite the process. Now we are afraid that this may cause a problem because we now have the complete correct addresses.

How do we fix this problem? I tried going back to the CEAC and see if I could do it there, but it's not letting me do it. I just get a message to call, email, and fax to the Lima Embassy. Has anyone else had this problem, and how did you handle it? Does anyone know the email address of the Embassy in Lima?

Thanks in advance

Thanks! We just received the notice from NVC that everything is in order yesterday, so we are just starting our wait time to the interview. It doesn t look like there is a lot of info re time frame online, but hopefully it doesn t take more than a 2-3 months.

The docs that took time were mainly on my end with some of the tax records I needed to submit, but it sounds like you re all set on that front. I m not sure how long the police records are valid for, but it took less than 2 weeks to get them online and we did it after we received the USCIS approval so it shouldn t hold things up if you wait until you get the formal USCIS approval. We did find out though that for Peru they require two extra certificates in addition to the police records. The three criminal record documents they require including the police record certificate are called: 1) Certificado de Antecedentes Policiales, 2) Certificado Judicial de Antecedentes Penales, and 3) Certificado de Antecedentes Judiciales a Nivel Nacional. This is the state department website that explains that they are needed for Peru:

https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Peru.html

We googled each form and there are instructions on how to get each online and it was pretty straightforward luckily.

Lastly, I m not sure I understand your final question, but I don t think there s a way to bypass the NVC processing and interview date if you re applying from abroad. The visa isn t issued until after the interview is completed based on what I know.

Hello @Sj33 my husband and I just received the notice from NVC yesterday, I've been searching for estimated timeframes for the CR1 visa interview appointment everywhere but there isn't specific info about it and your case is the most recent one I've found. So, are you still waiting for the interview date? I hope no, I was hoping it doesn't take more than 2 weeks.

Thank you in advance for your time!

Hello, everyone, I got my conditional green card on on 11/05/2019, I sent my paperwork to remove the conditions on my greencard on October 25, 2021,, since then I got a paper that stated that my green card will be valid 2 years after expiration date on 11/05/2021, meaning, it will be valid until 11/05/2023. I received same letter of extension on april this year. I guess this is a reminder that will be valid until November this year. Doesn't seem that they are giving me another 2 year extension, but I was wonder if anyone has a similar situation. I live in NYC and I am still waiting but I am worried that the time of that extension will be over soon. Does anyone receive another letter before their GC expired? how long do you think it will take me to receive my GC or should I request information somehow or sent another paperwork?

Thanks.
