My fiancee and I met in-person in January and November 2019. We completed the K-1 visa application and we were scheduled for an embassy interview when the pandemic hit. By the time we were both vaccinated more than two years had passed and our application was closed. Now we have to start the application process again. I'm hesitant to fly because of BA.5. Nolo's Fiance & Marriage Visas says:

The meeting requirement may also be waived if
the U.S. citizen spouse can show that arranging a
physical meeting would result in extreme hardship
to him or her. This exception is usually granted only
in cases where the U.S. citizen suffers from severe
medical problems that would make an overseas visit
difficult.


Can we apply now and claim the waiver with a promise to travel when BA.5 has passed (two months, ojala)?

In case you don't know what BA.5 is, it's the most contagious variant of COVID to date. It's also the variant most able to break through in vaccinated people.

My fiancee is getting her second jab as I write this. We had been scheduled for her K-1 visa interview on December 31, 2019 but her grandmother had a series of strokes and looked like she wouldn't live more than two weeks so we cancelled that appointment, intending to reschedule. Grandma didn't die and then COVID shut down everything. Now that my fiancee is getting vaccinated we requested a new interview appointment. The response was:

"We regret to inform that after almost two years of no activity on this petition, it was terminated and purged from our records. You will need to file a new petition for the beneficiary."

Has anyone gotten this message? What did you do? The only option I can think of, other than starting the petition process all over again, is to contact my congressperson. I expect that an immigration attorney would be a waste of money.

Visa appointment scheduled but no email with notification letter

Hello

Today I received an email stating that my appointment date was already scheduled and that they sent me notification on January 4th, the thing is the following, I did receive an email from the embassy on January 4th but the email said that they would send me notification when appointment date was available, nothing else, no appointment letter, no nothing. Has anyone been through a situation like this, suggestions will be much appreciated!! Thanks in advance!

K1 Visa Marriage Question

I understand that the K1 visa is meant for those couple who will get married within 90 days of entering the USA.

Does the marriage have to take place in the USA?

The reason for the question is that this as a debate in a WhatsApp group that i am part of.

Some folks seems to think that once your visa is approved that you can get married in the Foreign country if you wanted and then enter the US before the 90 days and legalize that marital union.

The way i always understood this is that the beneficiary has to enter the USA and the marriage will need to take place before the 90 days upon entry.

Hi,

My fianc is Cuban and since Trump shut down the US Embassy in Havana, I believe that I am supposed to have my fianc be interviewed in Guyana. I am not entirely sure if this is the correct Embassy. Does anyone know how to pick the correct Embassy to be interviewed at?
