Hey, I'm sponsoring my husband for his green card. I'm a US citizen. When I filed the I-864 I met the income requirement. My husband has already had his biometric appointment and received his EAD with no restrictions. He now is working and he alone meets the income requirement. Our interview has not beed scheduled yet. So my question is can I take a break from work to go back to school for my masters degree? I'm his sponsor but now he makes enough income to meet the requirement. Would there be a problem with that?

I came here in 2022 with a K1 visa, got married one month later, lots of bad things happened on the marriage and did not applied for GC. Got divorced. Now I will apply for the consular process thru my actual U.S citizen husband. But I want to know what should I send to the waiver as proof of extreme hardship?

I know it need to be sent after the I-130 approval, but as the most hard part of the process I want to get things prepared since now.

Hey everyone. It's been a while since I've been here. I'm sorry if this has been posted a lot, but I would like a refresher. My wife wants to bring her mom over here to the U.S. for a while to basically help her get her health back on a better track. She suffered a stroke and year ago, and everything since then, her health has been declining. My wife's plan is to have her over there for about 3 to 6 months or so. I know about the I-130 form, but her intention is to not have her mom stay here permanently. What visa, or form would be the best wat to apply for this situation? Would it be a B-2 visa? Or form I-131 humanitarian Parole? Much help appreciated. Thank you!

Hello, I am a USA citizen sponsoring a Brazilian fianc for a K1 visa. Unfortunately I have some convictions from 13 years ago for selling a drug. What should I include with my i-129f to avoid denial or RFE?

I found this requirement on the IMBRA:

If the petitioner indicates that he or she has been convicted by a court or by a military tribunal for one of the specified crimes by checking one or more of the boxes in Part C., question 2 of Form I-129F, or USCIS ascertains through relevant background checks that the petitioner has been convicted, the petitioner will be required to submit certified copies of all court and police records showing the charges and dispositions for every such conviction.

I m having a hard time determining exactly what is required in documentation. I have court stamped paperwork showing I was initially charged with several counts of Trafficking that were dismissed: VD District Dismissals w/o Leave by DA No Plea Agreement

Would it be important to include that the reason for dismissal was the drug I was in possession of had been misidentified? The court had the drug tested in a lab, once properly identified as 4-MEC my charges were reduced to PWISD Schedule 1 and Delivery of Schedule 1

I was sentenced to 1 year of probation, which I violated on the 10th month with a Defrauding Drug Screen/Test misdemeanor. This charge was dismissed as well, but my probation was extended by 1 more year and was then completed successfully.

I understand I will need a document verifying that the probation was successfully completed? Is this true? I reached out to the probation office, and they provided me with a document stating the times of my probation, but it doesn t specifically state that it was completed without further issue.

I also have letters from a drug counselor and psychologist confirming that I was in treatment with them at the time. Would it be appropriate to include these letters as well?

If anyone has successfully been able to sponsor a K1 visa with a felony background, please comment and share what documentation was needed. I would love to avoid a denial or RFE

Hi!

We're trying to decide which visa is the best for us: K1 or CR1.

According to my research the K1 process is taking from 6 to 8 months from the initial filing to interview, is that right? While the CR1 takes at least a year (+ we gotta wait until we get married to start the process).

The case would be processed at the Rio de Janeiro Consulate and we both live together in Brazil, does anyone went through the visa process while together in another country? I just know that we need a joint sponsor cause I (the beneficiary) don't earn any income in the US.
