Timeline

I thought that I would start a new thread since many of us have both I129F and I130, and aren't sure how or when the USCIS will be applying its new policy. I suppose petitions approved after 10/23 only would make sense, as that's when the policy was implemented.

Hopefully this will help us see what the USCIS is doing, and whether we can actually rely on what our NOA2's say. And whether or not we need to file the I824. Once people start having to file the I824, maybe we can include that too to see how long that takes.

Should I also include whether each person has an approved I129F?

I'll add more people later, since I'm working off of the I130 timeline, and not everyone's signature indicates whether they are pursuing both. Let me know if you want to be added, or if you know how to format, feel free to add yourself :)

Hi I guess since I have not been approved I have not been keeping up with what happens after the NOA2. What is the deal with this new policy and why are some of them detained at NVC? Does this mean that now Im going to have to wait longer I been wating since june and still nothing? How am I affected? More bad news on top of bad news for me? Desprately wanting to know some one please enlighten me.

Hi Dip Sticks, sorry you haven't heard anything good yet :(

It's not absolutely clear what the criteria are at this point, it seems like what would make the most sense is that they would only retain an approved I130 if there is already an approved I129F. But it's possible that they might just decide that anyone who has filed K3 wants to file Adjustment of Status and not pursue the I130 at the consulate if they aren't super explicit on their I130. I REALLY hope not. It's especially frustrating because it's not like I can go back and update my I130 to tell them that I definitely want it to go the NVC.

Anyway, if they decide to retain an approved I130, supposedly the NOA2 is supposed to tell you that. Then you can file the I824 asking to have it forwarded, or if by that point you have an approved K3 you can choose to Adjust status instead.

I guess they just saw so many I130s going to the NVC and coming back b/c people were adjusting status, but I think it makes no sense to create this new policy without changing the form. Apparently making new forms or editing forms is a Huge deal for them, since we all still have to use the fiance(e) form for spouses. Okay, now you've got me ranting...

I hope I get my NOA2 soon so I'll know what I need to do.

Retained as per the NOA2 received in mail today.

Interesting if you track your petition after approval at USCIS. The K3 for stopped any further touches after NOA2 date, but the I-130 was touched repeatedly...this may be them putting the file in storage?

On an interesting note...the NOA2 for the I-130 for me states, "The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status"?!?!?!?!?! Even better, the I-129F states that the visa petition has been forwarded to the NVC and then will be forwarded to the counsulate in the foreign country.

Is this something that you received too ADK0290? I am wondering is this is a USCIS mistake (I made no such indication on the I-130) or is this statement in relation to the I-129F? The letter does go on to state that I can file an I-824 if I so desire to have it forwarded to the foreign embassy. Basically, this confuses the heck out of me. Not a huge deal as long as it does not screw with my K3 in any way, or else I just may have to file that I-824.

Anyone with input on this strange statement? Again, absolutely no indication was made on that I-130 that could make them believe that my wife was in this country.

That seems to be the standard language on all of the petitions - as if it's our fault :) Just because they choose to presume that our spouses will adjust status. That's exactly the same as what everyone else who's been retained that I've heard of has received.

I would really hope they wouldn't - and they shouldn't according to their new policy - but I wouldn't put it past them. Let's hope not!!

According to the letter, our I-130 has been forwarded to NVC. They have also assigned me a case number on Dec 6.

So we can start emailing them about the choice of agent and the fee bill when the automated system says they have sent out our package?

My number starts with MTL, so I guess it's Montreal! haha

Feb 25 - Biometrics

Jun 1 - Approved! (Decision date was May 26, 09)

Now waiting for green card...
