Hi all

I have a question for you guys and gals,

My birth surname is not one I use now and have not used since I was 4. I remember my mum signing some stuff to say I am now known as a different surname. My passport / drivers licence / national insurance number etc all show my surname now so will this be an issue as I have never had documentation to show my name being changed officially anywhere.

I had the same problem.... my mum remarried when I was 9.... I was known as my step-fathers last name and like you I had my passport, NINO and bank details in that name.... I had never used my birth last name as an adult....

When I completed all the forms I had to use my legal birth name as my maiden name but I had to put my know as last name in the box for other names used.... I also had to have my marriage licence here in the States in my legal last name...

I explained all of the above to the interviewing officer and it was no problem.... but I did get my passport changed as soon as I was married that way my birth certificate and marriage certificate and passport all linked together....

Better get it changed to what you know at your official records place, otherwise when you file you will have to list your official birth name and then list any other alias or names used and explain it.

This is known as "common law usage" and is actually quite legal and acceptable in the USA as LONG as you have some various forms and affidavits etc. to indicate your "known as name".. and as long as your "common law name usuage hasn't been done because of illegal methods"

For example all of my children have always used my (maiden) name as their surname (this is not what their birth certificates are in though).

They have Australian passports issued in their common usuage name

They also have bank accounts issued in this common usage name

For this (Visa process) and also for anything else that we have ever had to do

Not only do I attach a copy of their passport to everything, and also a copy of a page of their bank statement

We have a letter from their school that states that is they name they are known as and have always been known as

We also have an affidavit from a family friend that states they have always known them by this name

We also have an affidavit from both myself and also their father that indicates this as well.

I just attach all of those extra sheets of paperwork to everything else that I put together, as well as (indicate) - other names known as on forms.

(getting ahead of myself I know <grin> but want to get everything ready

and organised - so MUCH paperwork/costs when there is me AND kids involved)

13/1/2008 - The estimated date on my timeline for adjudication NOW SAYS 21st March... OUCHIE..

29/1/2008 - WOW the estimated date on my timeline NOW says 7th April.... COME ON FOLKS.. PLEASE UPDATE YOUR TIMELINES IF YOU HAVEN'T DONE SO... your updates help give number crunchers like myself something to gauge. 4th feb - all these approvals MUST be doing something, my timeline NOW says 2nd April...

5/2/08 - YAY YAY YAY.... NOA-2 approval via email from CRIS... WHOO HOOOOOOOOOOO.... the "estimated timeline said 31 March this morning just as an FYI for you all)

9/2/2008 Flying to Ohio to spend a bit of time with my darling man to arrange our wedding and also just to spend some time together :-)

......

31/5/2008 Our Wedding day (we think) <grin>

So if I keep my name as is when I get married will my SO need to change her name to my birth surname or to the one I am known as now?

Sorry for the questions but I do not want a denial on something that could be rectified by changing my name by deedpoll.
