Does anyone receive an RFE while his/her EAD is pending? If so, does it really take USCIS 3 months to process your EAD after they receive your response?

We didn't receive an RFE. It does take USCIS that long to grant the EAD. Sucks, doesn't it? My husband hated the wait.

We actually had two infopass appointments and I don't know if without them he'd have been approved in 80 something days. You can complain if it's been 91 or more days and you still don't have your EAD.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

The answer is 'no' it typically doesn't take 3 months for them to process the EAD after receiving your response... The RFE notice they send says it can take that long, but in most cases processing resumes pretty much immediately after receiving the response... :thumbs:

We received an RFE in June 2006 (AOS filed in May 2006) for Pras' birth certificate (which took a week to get from India). Three months sounds about right--hear EAD and AP arrived in September 2006, but only had use for 1 month (superseded by conditional GC which arrived in-hand by end-October 2006).

2005/07/10 I-129F filed for Pras

2005/11/07 I-129F approved, forwarded to NVC--to Chennai Consulate 2005/11/14

2005/12/02 Packet-3 received from Chennai

2005/12/21 Visa Interview Date

2006/04/04 Pras' entry into US at DTW

2006/04/15 Church Wedding at Novi (Detroit suburb), MI

2006/05/01 AOS Packet (I-485/I-131/I-765) filed at Chicago

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

2006/10/27 Pras' conditional GC arrives -- .5 to go (2 yrs to Conditions Removal)

2008/07/21 I-751 (conditions removal) filed

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

2009/07/23 Pras files N-400

2009/11/16 My 46TH birthday, Pras N-400 approved

2010/03/18 Pras' swear-in
