Hello everyone,

I have a very special situation. I partitioned my wife to the US as my fiancée and got married. Now she has the 2-year temporary green card. We are waiting to get her the permanent green card.

However, I want to pursue business opportunities her country origin; Dominican Republic. If she and I were to move there in the next two years, can she get her permanent green card? How will I do her affidavit of support?

I the last few months, I have pasted some opportunities to relocated to oversea offices in my company trying to get her the green card. I would really love to pursue these opportunities and career advancements. Please advice.

You file to lift conditions within 90 days before the expiration of the conditional card, there is no affidavit of support involved, you already filed that when you adjusted status.

Maintaining Permanent Residence

You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

  • Move to another country intending to live there permanently.

  • Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

  • Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

  • Fail to file income tax returns while living outside of the US for any period.

  • Declare yourself a “nonimmigrant” on your tax returns.

If she/you have intentions of not living in the US pemanently and don't show such then she wiil be denied the ten year card.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If she/you have intentions of not living in the US pemanently and don't show such then she wiil be denied the ten year card.

I think the problem would be no US address and therefore where would she do biometrics , maybe its different for changing from a 2 year to a 10 year GC, but when i renewed my GC i had to get fingerprinted again.

Nov 2nd 2006 met online

June 28th 2007 sent 1-129f to NSC

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

If your wife is no longer maintaining her permanent residence in the US, she won't qualify for the 10 year card. You will want to google "maintaining permanent resident status" and become well informed.

Facts are cheap...knowing how to use them is precious...
