My conditional greencard expires mid December.

I'm filing through Texas and according to USPS my package was received on October 5th. (Blimey that was also the fourth anniversary of my coming to the USA on my K1 visa!)

Texas is listed as currently working on sending receipts for packages received September 16th.

I am supposed to be taking my toddler to visit his grandparents in England for December, culminating in Christmas. They are so excited to get to see him. I have yet to book my flights and am getting very nervous that I'm not going to be able to go if it's taking so long for TSC to issue the all important receipt so I'll be able to return to the States okay.

Does anyone know, if I don't hear from TSC, is there anyway to get USCIS evidence that I am a legal resident and entitled to proceed through immigration? Am I screwed or is there some way to get permission to leave and return to the States if I am caught in Texas limbo?

Thanks

You can make an Infopass appointment and get an I-551 stamp in your passport if you don't get the NOA1 on time.

Also, your I-751 is going to be transfered from TSC to CSC, as all I-751s filed in TSC have been since about July 1. From what I see on the list on the other thread, the last person to get an NOA1 from CSC via TSC was pedroh, who filed his I-751 at TSC on Sept. 10 and received an Oct. 4 NOA1 from CSC shortly after that date. So based on that, you would probably receive your NOA1 in early to mid-November.

No guarantees, though, so, again, if you don't get it, just make an Infopass appointment to get the stamp.

Phew, thanks for the reply, that gives me some hope.

Don't suppose you also know if I can apply for that stamp now so I can go ahead and book my tickets, or do I have to wait a certain length of time before I am allowed to apply for it via Infopass?

Thanks so much

That I'm not sure of, given that TSC is transferring petitions. Normally, you'd have an NOA1 from TSC in the system by now, or perhaps (an image of) a cashed check with the case number on it. That would probably be enough for the district office to issue a stamp. But rather than being logged into TSC, your petition is now en route to CSC (actually, it's probably sitting in a box at the TSC loading dock waiting for Earl to come by in his pickup next week and take your petition and some chicken coops to California). So I think you will have to wait until at a minimum you have a cashed check with a number on it from CSC. But I'm quite far from certain about that . . . .

Wow that's classic.... you do realize that the receipt number would be issued with the NOA1.... and when you have the NOA1, you won't need the stamp anymore....

not that i know this for sure, but from my experience in LAX and JFK July 2007 officers were looking for a stamp in my passport even if i had NOA1 letter and one even asked if i have "returning letter" - the one required for people absent for 12+ months, even if my trip was less then 11 months.

but they still let me through with only NOA1 in hands.
