As so often: I-864 Income Quesion

Hi all!

My wife is filing the I-864 these days. She has definitely not enough income, so my dad in law will be my co-sponsor.

I just need a confirmation that I am calculating right:

The household of my dad in law is 4 (himself, his wife, the little sister of my wife + MYSELF). The poverty guidelines says for a household size of 4 = USD 20,650. But he would need 125% of that, right? That would be USD 25,812.50.

I am right?

What about all this "multiplied by 3 or 5 times" etc? Is that just for assets? I am sure his income would easily meet the above mentioned 25k! Do we need more? Do I need to multiply it by 5 times (USD 129,062.50?!?!?!)???

03/10/2008 Welcome Letter (Form I-797C, Notice of Action) arrived

03/15/2008 Another Welcome Letter (Form I-797C) arrived... what a waste...

03/20/2008 Received I-551 (green card) via snail mail

03/24/2008 Received social security card via snail mail

10/20/2008 Moved from Seattle to Mobile, AL

06/18/2009 Wife filed for divorce

10/07/2009 Divorce was finalized

12/17/2009 Filed I-751 to remove conditions on residence under waiver

12/25/2009 Refiled I-751 because USPS returned the filed to me (hmpf!!!)

12/31/2009 Vermont Service Center received I-751

01/27/2010 Received the Biometrics Appointment Letter. Never received my NOA1.

02/01/2010 Biometrics Appointment in New Orleans, LA.

04/24/2010 Approval of Removal of Conditions! No RFE or interview. Yes!!!

I don't know the numbers but, yes, you're right with the calculation of household size -- adding only yourself to the existing household members. And yes, he needs to show income at 125% of the guideline.

The 3x (or 5x) multiplier is only for assets. You don't need to report assets at all if the income is sufficient.

Sep 11, 2007 ...... sent I-130 to Rome Embassy (USCIS District Office)

Oct 4, 2007 ........ received letter, I-130 approved and forwarded to Consulate in Naples

Oct 25, 2007 ....... received packet 3 by e-mail

Feb 1 2008 ....... got called for March interview but asked to postpone because not yet ready to move
