Hello All!

A few weeks ago, my fiance (who lives in Vietnam) had his interview at the consulate. During the interview, my fiance was asked questions about how we met, how many times I'd been to visit him, how long my trips there were, whether he had any immediate relatives in America, whether he had any evidence of communication, and then whether he had any photographs of us together. My fiancee submitted a pile of photographs of us (about 20 photos of our more memorable outings and engagement). The interviewer didn't even look at the pictures but stated that we didn't have nearly enough photographs for my having been back twice!

My fiance was denied a visa during that interview, but was given a form which said that: "Based on the information ascertained during the interview and documentary materials, consular officers do not believe that there is a bona fide relationship between petitioner and beneficiary. If you have any other evidence to present which would convince a reasonable person that the relationship exists for a reason other than immigration, please submit it."

What 'evidence' are they looking for? Should we submit all documentary evidence that we have, or should we limit our submission to something specific? Any insight provided would be much appreciated!

Passport stamps, boarding tickets, pictures, phone bills, anything which would show that you two have had a relationship before and after you filed the I-129F and also if your fiancee didn't do a NEW letter of intent, then he should do a new one and send it to you, stating that he still intends to marry you and stuff.

2008/12/03 - No news on if they received my case back (RFE), no news on my EAD or AOS. Starting to get severely annoyed.

At least they are giving you a chance to overcome, instead of a flat out denial, with petition returned to the USA.

A related question. Should the mentioned evidence be submitted with P3 or P4? If not, based on what does a VO make a decision as to what color the slip is going to be?

Anything you can possibly come up with that shows a real connection between you two. Letters, phone bills, emails, instant messenger logs, receipts for gifts, mementos...anything you can possibly think of. Inundate them!

Note OP is dealing with consulate in Vietnam.

In your case P-3 clearly tells you what to send back, (DS-230 part 1, and OF-169), P-4 tells you to submit P-4 forms to the personal at the medical, and they pack these documents in the sealed envelope with the medical results to take to the consulate. You bring all relationship evidence to the interview, (FOR CHINA Gunagzhou)

"The Kitchen SinK" is that not the truth *lol*.

Sometimes I think that they are overly picky.

When it is a matter of National Security and something came up....well then you could see.

Mail order bride/husband...yah maybe.

But sometimes they are a bit overly .... on some things.

Phones Bills are great..we have three years worth. Passport stamps are also good...not too many people would waste the kind of money the airlines are charging to travel back and forth because they have nothing better to do.

Have friends write letters as well. We did that and we opened a website with all of our family members and friends on it. That was over two years ago... anybody can access a computer these days even the Embassy *sarcasm*.

I think that we should Bill the Embassy for all of our phone calls as well *wicked grin*. We joke that we should take stocks out in Verizon and AOL *lol*.

Send in those phones bills, surley you have spoken on the phone.

Thanks. When I read some posts on CFL that VOs didn't even see the relationship evidence brought by beneficiaries to their interviews before they issued their decisions. Do they already make up their minds before the interviews?

* It seems as if the VOs have already made up their minds before the interviews as to whether the beneficiary will pass or fail. My fiance told me that during his interview, he was asked if he had any phone bills to prove that we had been communicating before our engagment. He said he did, and handed over all the phone bills he had. The officer didn't even look at them! Same thing with the pictures - the officer asked if we had any pictures from any 'outings' but then didn't even go through them; just said that we didn't have enough photographs for me visiting there twice!

Also, in response to the 221(g) RFE, should my fiance re-submit ALL the evidence he had at the time of the 1st consulate interview along with NEW evidence, or should he just give them the new evidence?

PS: I would be moody too if my job was to be the grim reaper of people's love lives!
