Hey all.

So I think I have decided I am gonna visit my fiancee for 45days on the VWP :)

(Keeping in mind that I have already visited 2x, 87days at a time on the VWP this year)

And I am wondering if a Dr appointment would count as ties to my home country?

Also keeping in mind that I am unemployed, out of school and live at my parents house, what other kind of evidence of strong ties can I get?

You may very well be denied or your I-94W may be limited to a much shorter duration. You have already been in the U.S. for almost half of the year, you are abusing the VWP.

Your use of the VWP is exactly why many are turned away when they honestly want to enter for a short visit and can't show ties.

Excuse me?

My visits to the US is not going to influence the chances of other people getting into the USA or not.

And I am abusing the VWP how? Because I visited 2x in my whole life this year?!

The terms and conditions of the VWP are that you can travel visa free for BUSINESS or VACATION. It is a vacation, to be with my fiancee.

If it was against the rules, then the Immigration officer wouldn't of let me in for my 2nd visit for 3 months.

I think you seriously need to reconsider your attitude towards others.

While the terms and conditions of the VWP are business or pleasure for 90 days or less, they'll also look at your previous visits for the year and how long you've stayed for. If they believe that you're using the VWP to spend more than the allowed maximum time you're given in the US, they might ask you to shorten your visit or even deny you entry. The officer at the POE may believe that you have intent to stay despite the ties you may have to your home country.

I don't think it's so much an issue of how many times you've come into the US, but so much an issue of accrued time that you've spent in the US already.

A doctor's appointment may not be enough to prove ties to the home country - could you get a letter from your parents stating that you live at their residence and you intend to return within a specific time?

Yes I can get a letter from my parents VERY easily. They support me 100% on this, so that wouldn't be a problem.

The fact that you have visited twice in one year for nearly the max on each visit is likely to get you turned away the third time unless you have VERY convincing ties to your home country.

A letter from your parents and a doctors note probably won't be strong enough.

I think it is likely that you can expect to receive a pretty tough grilling at Immigration. As others have pointed out, you have already spent close to 6 months in the US already this year.

The Immigration Officer may ask where you are staying and with whom, and if you mention the fact that you are visiting a fiancee they will be wanting to see some extremely strong evidence of your ties to the UK before even considering granting you entry.

In fact they may well already be aware that your K1 application is in process in which case it would help to have copies of all paperwork that has already been submitted to show that you are, in fact, taking a formal route to marriage and potential immigration.

A doctor's appointment will NOT be sufficient evidence. The fact that you have no job, no mortgage and are not studying will not help either. :whistle:

Following is real life experience.

The problem with the VWP is that there seems to be no hard and fast rules as to how many times you can enter on it in a year. Some years ago a colleague in the company I worked for was pulled over and advised to get a Business VISA as he was making a lot of trips (non longer than 2 weeks). All trip were business trips.

I went over in July 06 for 9 weeks (straight through), November 06 for 11 weeks (straight through) and May 07 for 9 weeks (pulled over!). Told I was living in the US. Convinced them that was not the case (I took early retirement. Visits were easy for me. NO questions on my life in the UK). Then told I was abusing the VWP and that although they would let me in this time I should get a VISA if I planned to come again.

We are in the K1 process now but I would still like to go again but will not try! Is there a flag against me? I have no idea. The thought of being turned around though is not very appealing!

There have been others on here that have said they visited the same amount of time as Jakey, some even longer.. They were abusing it and still got in. So those of you who are married already, it may be a bit easier for you to just point blank say "you are abusing it and thats that" dont you remember when you couldnt see your loved one? I beleive he is in the same shoes as you married folk were at one time. So instead of just saying "you are abusing it." try to help maybe?! Give some advice maybe?!
