Hey all.

I have been in the USA got 6 months on the Visa Waiver Program, 3 months at a time (to be exact, 87 days at a time) (visited 2x)

I am from the UK, am 17 going on 18 this November, have never been deported, don't have any form of criminal record, and my petition is pending at the CSC.

I am currently unemployed and I am WANTING to go visit my fiancee within 2 weeks.

I am intending to stay for 1 month on the Visa Waiver Program.

My question is:

What are my chances of getting through the POE considering I have been in the US for a long time this year (long visits)

What forms of strong home ties can I bring? (I am living with my mum and stepdad, am not in school and have no job)

Hey all.

Well this question gets asked often,while your K1 visa is pending there are no garuntees you will get in. You can still however give it a shot.

You can take ties such as school/Collage letter, workletter, any types of contracs you have such as phonecontracs,bankletters. Basicly anything you can think of that proves you are still tied to your own country.

You may have a tough time since you have spent so much time in the US recently. My fiance did the same thing as you (2 visits at nearly 90 days with 2 months in between) and when he came for the third visit (after a 3 month wait), they gave him a tough time in secondary. But, its worth a shot. Just keep in mind if they do turn you down you can never travel on VWP again and will be responsible for your return flight. Personally, I think the stance the immigrations officers is a bit much - they told my fiance that they don't think he's a terrorist, just that he spends too much time in the US. Its not like he's milking the US system, pays his own way and all. Good luck to you!

Well, what kind of evidence of strong ties can I bring with me? Especially as I am unemployed and not in school.

This would also be my last time VISITING until hopefully the visa goes according to plan.

I last left America after a 87 days visit on July 21st 2007, and am wanting to visit for 31days in a week or so.

Any further help would be truely appreciated.

P.P.S Also, I have heard that at some airports, the rejection rate is higher then others, I am planning to go to either Newark or Cincinatti, which do you suggest?

My husband visited me three times while the K-1 was in process, each time for the maximum of 90 days. We entered via Newark each time. On the first two trips, he was not stopped or questioned beyond the norm.

On the entry for the third visit, he was stopped, questioned, and cautioned not to try entering again without the visa. Fortunately, we got the visa after that, so we didn't need to worry. During that questioning he was asked to provide ties to the UK (bank account, letter from work, and all of our visa paraphernalia such as the NOAs we'd received, the medical information, and the interview letter from the Embassy). We have also been stopped since then (we didn't pursue Adjustment of Status and currently live abroad) when entering the US; nothing major, just the same where we are asked to show ties to the UK.

I agree this is a bit much! I believe the max is 180 days in one year so that might have had a bearing on the immigration officers comments. Though if there was 5 months in between total then it's arguable the third visit should trip over into a new year's allowance. But anyway, really they should be happy that he's left the country twice already. It shows he has a respect for the system if anything. No overstay, no infringement on the VWP.

To the questioner, return ticket within 90 days (which you have) you could also have your parents write a letter that you are staying with them permanently, copies of bank statements, mobile phone contract etc. Get what you can together and take a copy of the K1 application to prove that you are going through an appropriate method of entering legally outside of the VWP at some stage in the future. There are no guarantees, but it's best to be as prepared as you can be.

If it helps at all, I was asked a few questions last time I visited. The immigration officer asked who I was visiting, I said 'my fiance', she said 'when are you getting married', I replied 'oh next year hopefully, if our K1 visa application gets approved'. She wished me luck with the application and I went on my way.

Wow, that is amazing that your husband managed to get in for a total of 270days :o

Wish I could have the same kind of luck hehe, but I don't have the same kind of ties that you have (letter from work etc).

As a matter of interest, what kind of questions was he asked at the POE? If you know :)

Amazing, yes - and I wouldn't recommend it, as on every subsequent visit, even though it's been almost two years, we still have to travel armed with documents! The big thing that got us through was evidence of the visa application in process and where we were with that.

Questions he was asked: how long are you here for, where are you staying, where are you working, are you looking for work in the US, how much money do you have with you? Essentially, they were determining whether or not he was leaving, whether or not he was working illegally, and how he was supporting himself. If he hadn't had all of the information about his job, financial status, and visa application he would not have been let in.

Last year we were also stopped and questioned due to the expired K-1 in his passport, but that's another story.

I know this is demanding of me, but I am calling (requesting) for everyone else with the same kind of situation that I have and has visited the US during the I-129F process.

Also has anyone here been denied entry at the POE trying to visit whilst on the VWP?

Also has anyone here been denied entry at the POE trying to visit whilst on the VWP?

My friend got denied entry while she wanted to go see her fiance.

She said the experience was not nice at all,she had to go into an office with them and got asked tones of questions for like 3 hours straight after that they asked her for her emailpassword.

Hi,

I am here now for 6 months on a B1/B2 visa and had been in the US for about two months this year before I arrived in September for 6 months. I had no problems, and my POE was Newark, which I always fly through as I have never had any problems there. Whilst I worked here at the UN in NYC it was renowned for being an easier POE and lots of my international friends from work entered through Newark for this reason, but it always depends.

You can read my other posts for details, as I don't want to bore people by repeating myself ;-). As for your situation, its really your judgement call, but I suppose being younger, with no ties, might cause problems, and like the lady said, you don't want them hassling you every time you enter hereafter, but if you have a spare £300 knock yourself out, you might get lucky!
