Hi,

Together with my finacee I went the the whole K1 visa process and finally after six moths I got my inteview at the US Embassy in Brussels on Monday ... so you can imagine I am very excited.

Can someone share his/her expierience what the next steps are?

Great thing that we finally can life togheter but I also have to find another job in the US.

What about the workpermit?

Do I have to pay for it?

When do I get it? When will it become permenant (is it two years after the wedding date)?

If you got some tips they are more then welcome.

Many thanks for your help...

Best Regards

Patrick

You can apply for work authorization at the same time you file for Adjustment of Status. The fee for Adjustment of Status is $1010 whether or not you apply for work authorization. There used to be a separate fee, but that changed July 30, 2007. The actual employment authorization (EAD) will normally take around 60-90 days to receive and will be good for 1 year. If your AOS is not complete before you need to renew the EAD, you can apply for another EAD within 90 days of expiration without any additional fee.

Once your AOS is completed, you will get a permanent resident card and will no longer require an EAD. If you have been married for at least 2 years when the AOS is completed, you will get an unconditional card that doesn't expire fore 10 years. If you have been married for less than 2 years when the AOS is completed, you will get a conditional card that is good for 2 years from the approval date and then you can apply to remove the conditions within 90 days of the card expiration and get the 10 year card.

The next steps after getting K-1 visa are:

  1. Enter the USA (If you enter through JFK airport you MAY get a 90 day temporary work permit)
  2. Wait a few weeks, and then apply for Social Security number, (THIS IS NOT A WORK PERMIT)
  3. Get married with in 90 days of entry.
  4. Visit a civil surgeon to have vaccination records transfered to a supplement.
  5. File for adjustment of status (I-485, I-765 (FOR WORK PERMIT) and perhaps I-131 for a travel document) Pay $1010
  6. Several months to a year or more you may interview for green-card, and receive the green-card.
  7. Then about 21 months after getting the green-card you will file to lift the conditions on the green-card
  8. About 34 months after getting first green card you can apply to be come a US Citizen.
