Hello,

I had a question regarding my K1 NOA2 that I just received. In it there is a validity period. I was wondering what this means. After the validity period does the petition have to be in the foreign country?

It says on the NOA2 till when it´s valid, it should be a expiration date on the top part somewhere.

It says on the NOA2 till when it´s valid, it should be a expiration date on the top part somewhere.

I saw the expiration on the notice (7/31/06), however I am unsure what it means. Does it mean that the request for K1 visa has to reach the foreign consulate by then or does it mean that my fiance must receive the K1 visa from the foreign consulate by that date.

Generally 4 months, so im guessing you were approved march 31. it has to reach the foreign consulate by than. The interview can take longer than that to get and if it no fault of your own, meaning you sent in packet 3 and such and its just taking them a long time to schedule the rest, they automaticly extend the date past the 4 months. It's been mentioned on here that you can also write to them requesting an extension. So no you do not HAVE to receive the k1 visa by that date. If your consulate processing times are generally less than 4 months you shouldn't have to worry.

Technically it means that your fiance must enter the US before the petition expires. However, Consulates routinely extend the validity of the petition as long as the case is being actively pursued.

IOW, not something to worry about these days.
