Letter of Explanation -No Income

Hi everyone,

I´m finally going to start the application process for my husband (Spanish). I was wondering if anyone had any sample letters explaining why they were not required to file. I´ve only filed taxes once working as a student, and my father took care of that.

Although I did work in 2006, I did not have a working visa in Spain. Additionally, I only worked two hours a day as an English teacher for half of the year. My fiancee´, now husband, was working full-time and was able to provide for both of us. I know that I would have to pay the late fees if I filed and the self employment taxes which I think is ridiculous considering the little I made.

I was wondering if anyone had an opinion as to what is best for me to do. How long would filing take to process? We are going to the embassy in late September. We are hoping he´ll have the visa by January if everything goes well.

Thanks in advance,

Sonia

Sonia,

we are in a similar situation. My wife (USC) stayed 1 year illegally in Italy and gave english lesson, paid under the table.

We are not going to count this income. We still have to write the letter, but we will write that she was visiting me in Italy and she did not work.

My suggestion is to try to get the sponsorship using assets, considering the strenght of Euro compared to US$ it should not be difficult.

Otherwise go for the joint sponsor (one of your parents or relatives, or also a friend....)

Jul 25th 2007 - I-130 petition filed to Rome
Aug 20th 2007 - notice of acceptance and file sent to Naples
Oct 2007 - Appointment in Naples (very easy interview, no problem)
Nov 21st 2007 - Entered the US in Chicago
March 2008 - Received Permanent Resident Card

Sept 2009 - Filed I-751 to remove conditional status
Oct 2009 - Biometrics done
Jan 2010 - More document requested
Feb 2010 - Green Card received

Feb 2011 - Filed for US citizenship

Oct 2011 - Naturalization application was lost by USCIS

Nov 2011 - Case re-opened

March 2012 - Approved, citizenship!

Thanks Qwain,

I guess I´ll just deal with the taxes when I arrive back in the U.S. in October. I think my father has a friend who knows about immigration issues and filing taxes. I´m just not sure what to write in the letter.

As for the joint sponsor, I will definitely put my father and maybe my uncle just in case.
