hi to all,

my question is not for me but for my friend. To give u some details, my friend (single without children) told me that her boyfriend (USC) hired a lawyer to help them process their application. The lawyer submitted the form I-130 to petition my friend who is still USC's fiancee. My question is, is it ok to apply this way? I thought the form I-130 is for alien relative and I-129F is for fiancee.

Any thoughts?

Feb. 09, 2009 - NOA1 (I-751 Receipt Notice)

Feb. 13, 2009 - NOA2 (Biometrics Schedule)

Mar. 05, 2009 - Biometrics Done / Touched

Apr. 11, 2009 - Received Congratulatory/Approval Letter (04/07/09)

May 14, 2009 - Touched (Card Production Ordered)

May 20, 2009 - Touched (Approval Notice Sent --- WEIRD)

May 26, 2009 - Green Card Received.

No, it will eventually get denied. You would file I-130 only if your married.

I-129F is for the fiance visa

That's what I thought... they'll get Denied. If they start a new process and submit the right form (I-129F) is there a possibility of being approve or will the previous application (I-130) will make it difficult for them to get a visa? My friend and her fiance is alittle scared about the thought of getting denied that's why they hired a lawyer. Unfortunately, the lawyer doesn't seem to help. :wacko:

any suggestions?

I-129F is the fiance'e visa and 1-130 is for K-3 which is spouse of the USC.That lawyer is a fraud. Tell your friend to read first from the USCIS website before hiring a lawyer.
