hi guys ,

i am a US citizen and i have girl friend back in India. we are getting married in DEC. i am going back to india this OCT. so my questions is that if i want to file for my gf to come here in USA from new Delhi. how long do i have to wait. and whats a Residency Requirement now days. i heard a rumor that instead of 90 days they just changed to 180 days before i file ? is that true please advice me here, i am planning to get my gf here soon as i can. please reply....thank you in advance.

Hello b_4desi,

What you are referring to is the direct USCIS filing at the Delhi Embassy. There is a minimum 6 month residency requirement, and the full details are here at the Delhi Website:

There are other routes availble to you that do not require you to be an Indian resident. You can file the I-130 here in the U.S. and pursue the IR1/CR1 route or the K-3 route.

If you are getting married in India then you need to look into a K3 or a DCF (Direct Consular Filing). On a K1 - she can come here as a fiancee that means you can not get married in India and have her come here. Entiende? The residency requirement for DCF may be what you are referring to in your question but you have posted it in the K1 forum. You may need to check into the consulate website for that requirement or hopefully someone else may know it from their recent filings. Maybe they can move your question to the correct forum. The I-130 timelines can be seen by looking up the petitions on the VisaJourney.com timelines. I think you can expect anywhere from 3-5 months.

Everyone wants something faster :) so if it makes you feel better, everyone on line before you is thinking the same thing you are... can the line go faster? please?

i think six month is a long time because you cant apply a file till 6months gets over and after 6 month i think it will take about 2-3 months more to get a visa and all the rest of stuff.

if i want to file a i-130. when can i file that soon as i get to india? or do i have to wait for a while? i hope i can do it soon as i get there because i am going in Oct and i will be there till end of Jan. so thats 3months right there or may be i can stay there for 2 more month and bring my gf here in usa. so after she comes here in usa she will have to wait for 2 more years to get a green card huh?
