Hello,

 

I got an RFE because joint sponsor filed Jointly with his wife and we didn’t prove that the money is his not his wife. We only submitted tax return transcripts with form i864.

 

joint sponsor is retired his wife doesn’t work she doesn’t contribute Much to the Income. 
 

he is sending his 1040s bank statements proof of assets and a new i864. 
 

Does the wife of the joint sponsor has to file for I-864 A even tho she isn’t contributing her income ? 

The joint sponsor is not eager to send the documents again and it’s been 20 days since we received the RFE and he is stalling so asking for a new form now is going to be so hard.

Yes.  Many times, USCIS will require an I-864a when the joint sponsor and spouse file jointly .  Since they file joint taxes, she is party to the agreement between them and the US government.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

as I said in laws are not super excited to share those kind of documents. So is a denial guarantee if I don’t submit that ?  

Sounds like they have doubts about the ability for the government to collect from the joint sponsor if needed.  I would find a different, well-qualified joint sponsor asap.   Submit all the required documentation for the new joint sponsor.  Yes, they can and will, without hesitation, deny you if you do not sufficiently answer the RFE.  This is not a time to hesitate.  You get one shot. 

 

A denial will mean resubmitting a complete new package and a new payment.....hopefully before they an NTA.

So what I meant is : the joint sponsor is my father In law, they are not excited about sharing their tax documents etc that’s why asking for a new form now is going to be a nightmare

Then, I would absolutely find someone else.....otherwise, your FIL can pull/revoke the I-864 at any time prior a Green card being issued......
