Hello,

My wife entered the US on a CR1 visa on March 2024 and we now have a pending I-751 for Removal of Conditions filed in December 2025.

 

We are looking to apply for N400 at the end of this year. 

 

Would we be able to apply for N400 in December 2026 and file for I-131 Re-Entry permit shortly after? 

 

So we would basically file for N400 and the Re-entry permit in December and leave the US in January 2027 and return to the US for the N400 interview and oath ceremony. 

 

Any insight would be appreciated.

First, please fill out your Timeline. 

 

Second, you can file for I-131 anytime. 

 

Third, the N400/I751 combo interview may have cause for denial if your travel history show you have little intent to reside in the US.

I think this is a questionable plan.  There is no guarantee that the I-751 will be approved without an interview......and there is no guarantee the I-751 will be approved during a combo interview.  Therefore, you could have to return to the US for biometrics, then an I-751 interview, and later an N-400 interview. 

 

Unless you plan to be outside the US for longer than a year, why bother with a re-entry permit?  Afterall you have said "So we are out of the country for two months in the spring and two months in the fall as we visit and stay with her family in South Korea while we are in Asia."

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
