Good morning everyone, I’m a little confused and hoping someone can help clarify. I received an FE Review requesting my Schedule C and W-2, which I had already submitted with my affidavit back in October. I went ahead and resubmitted all the documents again.

 

Today, I received another FE Review stating that I need a sponsor, which was also already submitted with my son’s affidavit since his income is being counted with mine and we are in the same household.

 

However, less than a minute later, I received two emails saying that all required documents were submitted and that my case is now Documentarily Qualified (DQ).

 

I’m confused—should I still submit what the FE Review is asking for, or does the DQ status mean everything has already been accepted?

What exactly did it say? Did you say you do need a joint sponsor or you MAY need a joint sponsor. If the latter, that's a standard message that you can disregard if you're confident you meet the financial requirements.

This is what the FE Review stated:

 

The income reported on Forms I-864 and I-864A is considered insufficient to overcome the public charge grounds of inadmissibility for visa issuance. A joint sponsor may submit Form I-864. For more information, visit https://nvc.state.gov/aos and https://www.uscis.gov. You must meet these requirements at the time of the interview.

 

Note: You, as the sponsor, and any other sponsors, household members, and joint sponsors may submit additional evidence for the applicant to present at the time of the interview, such as:

 

  • Other income
  • Assets
  • Proof of current employment

 

 

Documents can continue to be uploaded through the Consular Electronic Application Center (CEAC).

 

However, after receiving this FE Review, I also received another email stating that my case is now Documentarily Qualified (DQ), which is why I’m confused. Our household size is 4 (including my husband), and our combined income is almost $70,000, which is well above the required amount.

 

Should I ignore the FE since the case is now DQ, or should I still upload additional documents just in case?

Right, so that's the standard message - search the forum to find other threads but you'll see it's very common. It just means be ready if a joint sponsor is needed at interview, but if you're confident you don't need one, then you can safely ignore it.

If that is a direct it is not the standard message that can often be ignored.  Maybe it's an interpretation instead of a quote.  However, the DQ message would be legit.  I'm confused, in that there seems to three incomes being counted, petitioner, petitioner's child and the foreign spouse beneficiary.  Is the beneficiary's income going to continue from the same source once they are in the USA?

In thread I linked to above (about the same message) your response was "You received a stock message that is always sent when the latest federal tax return does not show enough on the "total income" line.  If your current income is clearly sufficient, just ignore the message".

Oh, you're right.  They changed the message a little lately, I guess.  The old one says something to the effect that they are unable to determine that the income is sufficient.  

 

I'm still questioning the stated income total and why/how the foreign spouse's income is being included.

 

It seems the initial review missed the schedule C, but adding a schedule C would not change the "total income" number on the tax return.

I apologize for the confusion. The income being counted is mine and my son’s; my husband’s income is not included in what we earn. However, he is counted toward the household size for the income guidelines, which is what I meant. As for the first FE, I’m not sure why they requested Schedule C, but it is the second FE that concerns me, as I was worried they were requesting another joint sponsor.

They are not. If you are confident you have submitted a well qualified affidavit of support package, I would disregard the message. You are now document qualified, and in the queue for an interview.
