US B1/B2 visa in admin processing since 2 years

I applied for a US B1/B2 visa in November 2023 at the Munich Consulate, to visit my brother, who is a US Citizen. This visa is only for tourist purposes and I have no intention of staying there.

It has been 24 months and the visa has still not been issued. Every time I write them an E-Mail for an update they say that admin processing is still going on and that this process is carried out by the state department and out of their hands. They ask me again and again to be patient.

 

Here are some particulars about the case I would like to share:

 

• A short while ago I acquired German citizenship through naturalization and now I am a German-Pakistani dual citizen.
• I had a previous F-1 visa denial in 2016, which I mentioned on the DS-160.
• At the time of application I had been living in Germany since the past 5 years and held permanent residence. I studied here and was working a full-time job. I had a apartment I was renting, bank account, friends here etc. which would show my intention to return.
• I suspect I work in a TAL field, though not sure. I have a Masters in Electrical engineering and specialized in RF/Microwave engineering.
• My brother is a naturalized US Citizen, he has been living in the US since 2012.

Some of the questions I have:

• How should I proceed?
• Since I have now acquired German citizenship, can I then use the Visa Waiver program and apply for an ESTA? Or, when I mention the 2016 denial or the 221g in 2023, will the ESTA get refused and I will be told to apply again for a B1/B2 visa at the consulate?
• How can I file a Writ of Mandamus by myself, or through a freelance lawyer? Since this is not a immigration case and not that critical, I would not like to spend more than 500$ for this.

TAL and Pakistan will be the reason, but 2 years is a very long time. It's crazy as you couldn't adjust status anyway through your brother, and would be several decades away from a visa via him. 

 

You can file WOM yourself, there is a guide on here that you can use by a lovely forum member that's done it themselves and helps others - have a hunt and hopefully you'll find it.

 

You can try ESTA, might want to give that a go first, but you will have to declare the previous denial.

Could you please provide me a link the guide for filing the WOM, if you happen to have it or have come across it? Thanks.

Also, on a related note, should I inform the Consulate that I acquired a new citizenship?

You can inform the consulate, it's probably worth a try.
