Hello everyone, I filed I-824 to request USCIS send my approved I-140 to NVC for visa processing, and I received the I-797 approval notice of the I-824 after one year on Aug 15 2025. But my I-140 status is still under "Approved", not yet changed to "the case was sent to DOS" after 1 month waiting. Does anyone know how long does it take for USCIS TSC send/forward my I-140 to NVC DOS. Could you guys share your timelines processed at USCIS TSC? or any advises will be much appreciated.

Reason for asking what EB visa this is for is because there are numerical limits 

 

 

The overall EB visa limit for Fiscal Year (FY) 2025 is approximately 150,000 visas, set by the Immigration and Nationality Act (INA), with each of the five EB categories receiving a statutory percentage of this total. For FY 2025, the EB-1 and EB-2 categories have already reached their numerical limits, meaning no further visas or green cards will be issued for those categories until the fiscal year resets on October 1, 2025, when new visa numbers become available.

Yes right, but my case is still stuck in DHS USCIS, and showing the status of "case was approved" not yet arrived in DOS NVC yet, according to my understanding the status of my case should first showing "the case was sent to the department of state" then job of DHS USCIS is completed and should be handled by the DOS NVC which relates to the visa numbers issue you have provided here. 
My question is when will my case status update to "case was sent to department of state" after "case was approved"? especially if the case was processed at DHS USCIS TSC. Its already around 1 month waiting now? some people say need 4-6 weeks or 4-8 weeks? anyone has the real experiences?

Thanks. If your petition was approved in 2022, what’s the reason for such a big delay? I know the I-824 took a while but what happened between 2022 and 2024? 
 

I’m sure your case will be sent to NVC soon but it usually takes several weeks.

Thanks appleblossom. There is no delay in my case until now, every step is under my control and processed under reasonable time frame. I chose AOS, but later I changed my mind, that's why I filed I-824 to request DHS USCIS to send my approved petition to DOS NVC for visa processing. I wonder anybody can share their timelines so that I can make a better schedule based on the timeline. I want to know the timeline between the case status of "case was approved" and "case was sent to department of state". My Case is processed at DHS USCIS TSC.

So is there a typo in your timeline? It says petition approval in 2022, but then you didn't apply for the I-824 until 2024? What happened in the two year gap, did you apply for a visa or start the AoS process?

 

I'm just double checking you abided by the rule about applying for a visa within a year of one becoming available.
