Good afternoon,

 

Visa bulletin is out for October 2025. 

 

Showing F2A date as of February 2024.

 

If an applicant with PD of August 2nd 2023, does this mean they are current and can get a visa?

 

The applicant turns 21 in November this year, but should have 4 months of age calculation. Applied in August 2nd 2023 and approved December 7th 2023.

 

How does this work, should the visa be issued before they are 21 years old, or to be current before they are 21 years old?

Can you please help me understand more. 

 

Their DOB is November 10th 2004. They will turn 21 on that date. 

 

Does this mean they have a year to take action from that date? or they could still age out if a visa is not issued by November?

The only date that matters is when a visa becomes available to them - so 1st October. It doesn’t matter how long the visa takes after that as they’re protected under CPSA once they become current. https://www.uscis.gov/green-card/green-card-processes-and-procedures/child-status-protection-act-cspa

They havent paid the IV fee or submitted DS260. Does this disqualify them? or they can do it now

They can’t do either until they get the Welcome Letter. But are you sure they haven’t had that already? They should have done a long time ago.

Welcome lettee for NVC? I think they received the email a while ago. But they had war in their home country since last year and they had to flee. They were unable to obtain any documents and submit applications.

Ok, as long as they’ve had it. They’ll also need to submit docs though.

They received the welcome letter in December 2023. They havent taken any action due to war and leaving home. Since they will be current in October 1st. Can they still send the docs and pay the fees now? I asked them if they received any NVC or USCIS termination letter and said no. They said they just logged into their case on CEAC and were able to pay the fees.

The applicant is my brother from 1 parent and 1 step-parent. He is not married. I am helping them but i am not a pro at this. I keep reading that the 'acquired action date' has passed.

Ah, I see, I thought ‘they’ was plural.
 

There isn’t even a visa available to him for a couple of weeks.

Does he have 1 year to pay the fees and submit documentd from when the priority date becomes current? in this case, October 1st of 2025? so in theory, he have till october 1st 2026 before his case will be terminated?

 

Can they pay the fees now or should they wait till 1st week of October 2025?

Unless there’s a reason he wants to wait, just pay it now, and get everything submitted. That could have been done anytime after the Welcome Letter was received, he just can’t get a visa until October. 
 

Which consulate will he be interviewing at?
